( "Contractor "), as provided therein. The County and Contractor agree to renew /amend the provisions(s) as indicated in Section 2 below: Section 2: The contract is specifically amended as follows The contract amount shall be increased by an additional $ 230,000 for labor, equipment and materials to provide emergency slope erosion repairs to the New Hanover County Landfill to bring it back within permit compliance requirements, as per the attached quote. These services shall be provided at an hourly rate plus the cost of materials and a one -time mobilization fee. The number of labor hours and materials for this protect are estimated for purposes of this amendment, and may fluctuate once the work is performed The new contract total amount is not to exceed $2.505,000. Section 3: The renewal /amendment is effective September 21, 2018 through November 30, 2018 . All other terms and conditions set forth in the original contract shall remain in full force and effect for the duration of the term. D &1 Enterprises, Inc. is currently the Disaster Debris Management contractor for New Hanover County. We have been activated on our contract and are currently working for the County in an effort to load, haul and dispose of debris, cut trees and remove stumps as a result of Hurricane Florence. D&J Enterprises, Inc. is engaged in full time road building, paving, grading, civil engineering, dirt & rock hauling employing 200 full time employees. Contractor will haul in suitable sand and use heavy equipment to place sand in the damaged areas of the landfill cap. Contractor will achieve a 3:1 slope as per the guidelines set by County representative. Clarifications: 1. County will be responsible for marking the working limits and will provide locating and marking of existing utilities within the work area prior to mobilization. 2. Proposal is based on one (1) mobilization /demobilization and one move around with being able to begin work and continue in a linear and uninterrupted operation. Delays, holdups, standby, move arounds other than the one mentioned above or remobilization will be back charged as additional work in the form of a change order at hourly rates. 3. County is responsible for all necessary permits and fees associated with permissible construction activities onsite. 4. Construction schedule is based on six — ten hour work days. 5. No allowance has been made for, nor will D &J Enterprises, Inc. assume any liabilities for liquidated damages. 6. Bid proposal does NOT include and bonding for the project. 7. Mat placement is NOT included in the price. 8. D&J Enterprises, Inc. is not responsible for Acts of God; including ash, embers, and smoke traveling beyond the legal required distance per local /state regulations. 9. The County should take any means necessary to correct the compliance issues occurring at the landfill. As we saw, severe cover erosion and associated uncovered waste, uncovered waste at and near the working face, and leachate problems are a major concern. It is understood that some staff members are not able to get to the site, leading to an already increased workload. Therefore, the County should explore all avenues available to ensure compliance issues are addressed, reducing impact to public health and the environment. Please let us know if we can be of further assistance.
