The Environmental Management Director and the Chief Financial Officer have no objections to the franchise request. The decision to approve the current solid waste franchise agreement was considered against the implications of House Bill 56 and its impact on the county's ability to control the flow of solid waste. Staff believes that private solid waste collection companies will ultimately make post -2020 final disposal decisions based on two factors: price and convenience /location. The New Hanover County landfill is competitive in both areas and will continue to seek methods to control costs while offering cutting -edge services to the public. The initial franchise period would run for seven years. The first reading was approved by the board unanimously on November 13, 2018. This program purchases services to assist fathers to become better parents and to support their children financially. The program works with non - custodial parents referred from Child Support and the New Hanover County Child Support Office and is 100 percent funded through child support enforcement incentive payments. North Carolina earns incentive payments based on the Child Support Program performance as compared to other states in the nation. No County match is required. BA 19 -036 increases the budgeted amount for the Low Income Energy Assistance Program ( LIEAP). The amount budgeted is based on estimates from the state. The allocation for the fiscal year was more than anticipated. This program assists low income households with the cost of heating expenses. Eligible households receive a one -time LIEAP heating assistance payment made directly to their heating vendor. The target population is persons age 60 and over or disabled persons receiving a state service through the Division of Aging and Adult Services. Household income must be at or below 130 percent of poverty. County departments of social services take applications during the specified time period of December 1 through March 31 or until funds are exhausted. The program funds the LIEAP benefit payment and is intended to cover all administrative costs. There is no County match for LIEAP payments. (nowAptim Environmental & Infrastructure, Inc.) began monitoring seven (7) tidal creeks within New Hanover County on a monthly basis in November 2007. The information presented in the annual report focuses on the results of this monitoring between the months of July 2017 and June 2018. The creeks included in this study are Pages and Futch Creeks, which drain into the Atlantic Intracoastal Waterway (ICW) and Lords, Mott, Barnards, Smith, and Prince Georges Creeks, which drain into the Cape Fear River. Along with examining the data collected from the past 12 months, long term trends have been assessed using data obtained by Aptim Environmental & Infrastructure, Inc. In addition to the continued sampling from the seven tidal creeks, three sampling sites from within Airlie Gardens were included beginning with the 2015 -2016 sampling efforts. The property, located within the Bradley Creek watershed, includes a 10 -acre freshwater lake. The lake receives input from several stormwater culverts which serves to manage runoff from a nearby development. The purpose of this presentation is for County staff and AP TIM staff to present data from the FY 17 -18 monitoring program as well as trends from past monitoring years. In general, the dissolved oxygen levels within each creek have not changed notably from year to year and continue to be non - problematic. Turbidity and chlorophyll -a were also not problematic in any creeks. However, Entertococci bacteria remains a concern with 5 of the 7 creeks showing an increase in bacteria levels resulting in poorer water quality. The only existing long term issue that has been persistent has been the high levels of bacteria in the Pages Creek watershed in the Bayshore neighborhood. In spring 2018 staff applied for the no -match Duke Energy Water Resources Fund for additional testing in Pages Creek to determine the source ofenterococci bacteria. Staff was notified in October that the application has been deferred until the next funding cycle to allow staff to provide additional information on remediation options if the bacteria source is identified. Prior testing indicated the contamination found in Pages Creek is from a human source. Examples of remediation could include resolving discharge from leaking or abandoned septic tanks in the area or working with CFPUA to repair any compromised waste water infrastructure. Action items would be proposed once a full report pinpointing the source is completed. Nineteen (19) monitoring stations within seven (7) tidal creeks in New Hanover County were monitored on a monthly basis for physical, chemical, and biological parameters of water quality. The results presented in this report are described from a watershed perspective. In order to provide a quick - glance assessment of the water quality within a particular sampling station and watershed, a rating system has been established for a number of parameters. This quantitative system assigns a rating of "GOOD ", "FAIR ", or "POOR" to a sampling station depending on the percentage of samples exceeding the State standard for dissolved oxygen, turbidity, chlorophyll -a, Enterococci, and fecal coliform bacteria. If the recorded value of a parameter exceeds the State standard less than 10% of the times sampled, the station will receive a "GOOD" rating for the parameter. A "FAIR" rating is assigned when a parameter exceeds the State standard 11 -25% of the times sampled. Parameters measured that exceed the State standard more than 25% of the sampling times are given a "POOR" rating. As displayed in the table below, turbidity and chlorophyll -a were determined to be "good" within all watersheds throughout the study period. Dissolved oxygen was deemed to be "good" in Motts Creek, Pages Creek, and Smith Creek while Barnards Creek, Futch Creek, and Lords Creek were all deemed to be "fair ". Prince Georges Creek demonstrated "poor" levels of dissolved oxygen during the study period. Enterococci was problematic within three of these watersheds- Motts Creek, Pages Creek, and Prince Georges Creek. On the other hand, Futch Creek, Barnards Creek, and Lords Creek were deemed "good" for Enterococci. Since 2008, dissolved oxygen levels exceeded the State standard within surface samples 36 %, 22 %, 19 %, and 10% of the time within Prince Georges Creek, Pages Creek, Futch Creek, and Motts Creek, respectively. Dissolved oxygen levels were better within Barnards, Smith, and Lords Creek where samples exceeded the dissolved oxygen standard 9 %, 6 %, and 4% of the time, respectively. Enterococci bacteria has been a chronic problem within several of the creeks monitored in this study. Board of Commissioners - December 17, 2018 ITEM: 13 NEW HANOVER COUNTY BOARD OF COMMISSIONERS CHEMORS CONSENT ORDER RESOLUTION WHEREAS, New Hanover County and the entire Cape Fear region learned of PFAS and emerging containments, and most specifically the containment known as Gen X, are present in our drinking water source — the Cape Fear River; and WHEREAS, the most consequential source of Gen X is Chemours, a manufacturing plant along the Cape River in Bladen County, North Carolina; and WHEREAS, since the presence of Gen X was reported local, state, and federal officials have been advocating for research, water treatment, and enforcement of PFAS and Gen X; and WHEREAS, the entire region, including residents of New Hanover County have also been calling for more research, water treatment, and enforcement of PFAS and Gen X; and WHEREAS, the North Carolina Department of Environmental Quality (NCDEQ) along with others have been negotiating a consent order with Chemours; and WHEREAS, said negotiations ostensibly have included no local, state, or federal officials from the region or specifically New Hanover County; and WHEREAS, the absence of these officials has resulted in a proposed consent order that is far from comprehensive; and WHEREAS, the court is accepting comments on the proposed consent order until December 21, 2018; and WHEREAS, the Cape Fear Public Utility Authority (CFPUA) has identified deficiencies with the proposed consent order to include but are not limited to: 1. The proposed order does not resolve the problem of PFAS contamination in drinking water supplies for New Hanover County; 2. The proposed order fails to provide a solution for the citizens of New Hanover County who continue to be exposed to PFAS compounds at levels higher than 10 parts per trillion, individually, and 70 parts per trillion combined; 3. The proposed order does not address river sediment contamination, nor does it suggest possible remediation solutions; 4. The proposed order does not address damages to groundwater in New Hanover County through the contamination of the Aquifer Storage and Recovery (ASR) site. Board of Commissioners - December 17, 2018 ITEM: 13- 1 - 1 NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby calls on NCDEQ to demand Chemours return to the negotiation table and reopen the agreement for the purposes of including more requirements for research, water treatment, and enforcement of PFAS and Gen X in the proposed consent order. NOW, THEREFORE, BE IT FURTHTER RESOLVED, that the New Hanover County Board of Commissioners does hereby endorse incorporating statements to address concerns as noted by CFPUA in the proposed consent order between NCDEQ, Chemours, and others. NOW, THEREFORE, BE IT YET FURTHER RESOLVED, the New Hanover County Board of Commissioners calls for the following at a minimum be included in the final consent order: 1. Chemours reimburse CFPUA no less than the cost for the new Granulated Activated Carbon filtration System at the Sweeney Water Treatment Plant, estimated at $46 million, and the potential for additional GAC filtration systems installed at the multiple wastewater treatment plants in NHC, and other associated costs with planning and operations for these plans; 2. NCDEQ develop a plan of how to address the PFAS and PFOA (C8) build up in the riverbed sediment and in local ground water and crops; 3. Installation of under counter Reverse Osmosis systems, or, bottled water distribution to homes affected by PFAS contaminants, until CFPUA water can be cleaned; 4. Long term monitoring for all PFAS and PFOA in CFPUA water supply; 5. Medical monitoring requirement, which may take additional action by the Legislature to make happen.
