SUBJECT:
First Reading: Approval of Solid Waste Franchise for Wall Recycling, LLC.
BRIEF SUMMARY:
New Hanover County requires a county issued franchise to collect solid waste. Pursuant to Section 44 -55, the
applicant has provided information about his business organization, equipment, personnel and fiscal responsibility. The
Environmental Management Director and the Chief Financial Officer have no objections to the franchise request.
The decision to approve the current solid waste franchise agreement was considered against the implications of House
Bill 56 and its impact on the county's ability to control the flow of solid waste. Staff believes that private solid waste
collection companies will ultimately make post -2020 final disposal decisions based on two factors: price and
convenience /location. The New Hanover County landfill is competitive in both areas and will continue to seek
methods to control costs while offering cutting -edge services to the public.
The initial franchise period would run for seven years. A second reading is required.
RECOMMENDED MOTION AND REQUESTED ACTIONS:
Approve franchise.

Scope of Business:
Our primary business is to provide roll off trash containers for the removal of construction waste
from residential construction sites. In addition, we provide roll off trash containers for demolition
projects, renovation projects, concrete removal, roofing tear offs, along with garage, attic, and
general homeowner cleanup projects. We have been in business since 2010, have experienced
exponential growth over that time, and we are extremely grateful for the opportunity to conduct
business in New Hanover County. We have never been late on our payments at the landfill or
county taxes. We have built a reputable name and are probably one of the top accounts at the
New Hanover County Landfill.

In August 2018, Wilmington Christian Academy requested a Sheriff's Deputy to provide law enforcement security,
serve as a mentor, and act as a liaison between school administration and New Hanover County's Sheriff's Office.
The Sheriff's Office would like to request (1) one Deputy position. This is a revenue generated position. No budget
amendment is needed.

Section 2: Explanation
BA 20 -041 budgets funds received via payroll deduction or personal contributions from employees at Cape
Fear Public Utility Authority ( CFPUA) and other community partners for the CFPUA Assistance Program.
The program is 100 percent funded by CFPUA employees and community partner contributions along with
contributions from the city and county. The maximum benefit per eligible household is $500 per fiscal
year. These funds may not be used for deposits. Eligibility is based on need and funds available. Funds
remaining at the end of the fiscal year are carried forward to the next fiscal year.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County, North Carolina, that the Ordinance for Budget Amendment(s) 20 -041 amending the annual budget
ordinance for the fiscal year ending June 30, 2020, is adopted.

Section 2: Explanation
BA 20 -042 budgets an increase in ROAP (Rural Operating Assistance Program) grant funds of $35,472.
These funds will be used to increase the number of trips provided within the EDTAP (Elderly and Disabled
Transportation Assistance Program). New Hanover County received a larger allocation for FY20 only
because other counties did not utilitze their FY19 allocation. There is no county match required. Due to
requirements of federal and state funding, the additional allocation must be used to supplement current
county programs and cannot be used to supplant General Fund appropriations.
BA 20 -043 budgets an increase in funding for the RSVP (Retired Senior Volunteer Program). The
Corporation for National and Community Service increased the county's funding by $7,500 to be utilized to
recruit, retain and recognize additional RSVP volunteers who will be serving in the community. There is no
county match required. Due to requirements of federal and state funding, the additional allocation must be
used to supplement current county programs and cannot be used to supplant General Fund appropriations.

BA 20 -046 budgets a federal HSGP (Homeland Security Grant Program) passed through the NC
Department of Public Safety. The award amount is $2,500 and will be used to upfit the Toolcat and
hauling trailer so that additional equipment can be carried. The trailer would have metal fabrication work
done to allow multiple implement attachments (snow plow, debris grabber, pallet forks and bucket) to be
safely mounted for transporatation with the Toolcat to an incident. Currently there is no racking system on
the trailer to transport all of the implements in an efficient manner. Emergency lighting would also be
placed on the Toolcat so the operator could safely utilize the equipment near roads and highways. This
equipment could be used to remove ice /snow from fire stations, EMS base and other parking lots which the
NCDOT does not plow. Additionally, during hurricanes or tornado events, this equipment can be utilitized
with chainsaw crews to cut downed trees and remove the debris to clear paths to critical infrastructure
needing refueling. There is no county match required for this grant. Due to requirements of federal and
state funding, the additional allocation must be used to supplement current county programs and cannot be
used to supplant General Fund appropriations.

New Hanover County has the opportunity to apply for two different grant funding opportunities, both
New Hanover County has the opportunity to submit Letters of Intent (LOI) for grant funding opportunities associated
with Hurricane Dorian disaster recovery efforts. The projects are intended to enhance resiliency and support
community mitigation efforts across the region. New Hanover County was notified of this opportunity on January 13,
2020 and LOls to participate were submitted to North Carolina Emergency Management by the due date of January
31, 2020. The Board is being asked to ratify the submission of the letters of intent at this time.
• Project 1 — HMP -DR #4465 Project: Resilient Infrastructure — NHC Military Cutoff Culvert Installation

The results of this analysis completed by Sungate Design Group in response to Hurricane Florence flooding
that occurred in the subdivsion along Smith Creek recommends placing a 66 -inch RCP adjacent to the
south side of Culvert No. 2 (1 @ 11' x 7' RCBC). The 66 -inch RCP should be placed 1 -foot above the bed
elevation as to allow the daily flow to only pass through the 1 @ 11' x 7' RCBC and the 66 -inch RCP to be
used during flooding events. The outlet channel from Culvert No. 2 to the downstream side of Culvert No.
3 should be widened from a 6 -foot base ditch to a 10 -foot base ditch. It is also recommended that New
Hanover County investigate removing the 3 @ 36" HDPE and the earthen embankment located between
Zest Court and Peppercorn Court just downstream of Culvert No. 1.
• Project 2— HMP -DR #4465 Project: Resilient Infrastructure— NHC Southern Castle Hayne Project (lannucci)

Hanover County will request bids for the elevation work and will oversee construction on each property. 5% of
the award will be used for project maintenance and administration.

On a quarterly basis, county staff updates the Board of County Commissioners on the financial status of the
county. The second quarter of fiscal year 2020 will be presented which includes financial activity through December 31,
2019.
As an overview, the county's general fund has received $167.1 million, or 53.5% of budgeted revenues and has
expended $127.2 million, or 40.7% of budgeted expenditures. Major revenue sources of ad valorem tax and sales tax
are trending above targets while overall expenditures are lower than expected targets. The Fire Services and
Environmental Management funds have received $9.3 million (55.8 %) and $11.1 million (45.6 %) of budgeted revenues
and have spent $8.9 million (53.5 %) and $4.8 million (19.5%), respectively. Further highlights can be found in the

As the chart highlights, many revenues are not received, nor expenses paid, evenly throughout the year.
• Ad valorem tax collections through the second quarter are approximately 75.8% of budgeted amounts which exceeds the
last two previous years.
• Sales taxes are received from the State two and one half months following the month in which they are collected by the
vendors across North Carolina. Thus, three months of sales tax has been received through the second quarter and represent
24.9% of budgeted sales tax.
• Other Taxes exceed prior year collections in both the dollar and in the percentage of collection through the first quarter as
real property transfer taxes continue to grow beyond expectations in addition to higher than anticipated vehicle rental and
heavy equipment tax.
• Expenditures in most County functions are lower as a percent of budget than prior year. Economic & Physical Development
and Transfers are not distributed evenly by month. Rather, expenditures are paid when due.
DEBT SERVICE FUND HIGHLIGHTS:
• Ad valorem tax collections through the second quarter generated by the 6.47 cent dedicated tax rate was approximately
$17.1 million, which is higher than the previous two years.
• Debt service is paid from this fund when those payments come due. Due to additional borrowings that occurred in fiscal
year 2019, the increase in debt service expense was expected.
ENVIRONMENTAL MANAGEMENT FUND HIGHLIGHTS:
As with the General Fund, many revenues and expenses do not fall evenly throughout the year for Environmental Management.
• Charges for Services exceeded prior year at $8 million collected through the second quarter. This exceeds the two previous
years in both dollars and percentages collected.
• Reimbursement for Hurricane Florence debris pickup has been received to reimburse the usage of fiscal year 2019 fund
balance related to these expenses.
• Operating expenditures are lower as a percent of budget than prior year. Overall expenses are lower than prior year due to
the significant expenses incurred in the prior year related to Hurricane Florence. Capital expenses are not made evenly
throughout the year.
FIRE SERVICES FUND HIGHLIGHTS:
Again, as with the General Fund, many revenues and expenses do not fall evenly throughout the year for Fire Services:
• Collections of ad valorem tax are higher than prior year and represent $8.4 million through quarter two and represents 80.3%
of budgeted ad valorem revenue. This is greater in both dollars collected and percent collected then the previous two years.
• Sales taxes are received from the State two and one half months following the month in which they are collected by the
vendors across North Carolina. Thus, three months of sales tax has been received through the second quarter and represent
24.8% of budgeted sales tax.
• Operating expenses are consistent with previous year's expenditures as a percent of budget while salaries are slightly higher
than prior year.
• Debt service and capital expenses occur when related capital assets are needed and payments are due.

BRIEF SUMMARY:
During the Board's February 3, 2020 meeting it approved the Wave I nterlocal Agreement Amendment 2, which
included an appointment of a nine (9) member board comprised of the city and county managers, city and county
attorneys or their designees, city and county finance officers or their designees, executive director of the W MPO, a
County Commissioner, and a City Councilmember. The Board is being asked to appoint a County Commissioner to the
board. The County Commissioner will also serve as the Wave Board's representative on the W MPO.
The City Council during its February 4th meeting approved the Wave Agreement Amendment 2 with the amendment
that it appointed former City Councilmember Paul Lawler to serve as the City Council's representative on the board.
RECOMMENDED MOTION AND REQUESTED ACTIONS:
Make County Commissioner appointment to the Wave board and direct the Clerk to the Board to amend the 2020
Commissioner Appointment list to reflect the Board's action.

TOURISM DEVELOPMENT AUTHORITY
Number of Members: 15 voting members: 5 ex- officio members and 10 members appointed by
the Board of County Commissioners. The five ex- officio members are the Chairman of the Board
of County Commissioners, the Mayor of the City of Wilmington, and the Mayors of the Beach
towns or whomever they appoint by each elected body. The other ten members are in the
following categories and must have experience in promoting travel and tourism:
a. Owner /manager of a hotel of 150 rooms or more in the Town of Wrightsville Beach
b. Owner /manager of a hotel in the Town of Carolina Beach
c. Owner /manager of a hotel in the Town of Kure Beach

e. Owner /manager of a hotel of fewer than 150 rooms in the City of Wilmington

Statute or cause creating Bureau: On October 3, 2002, through House Bill 1707, the North
Carolina General Assembly directed that the New Hanover County Board of Commissioners
designate the Cape Fear Coast Convention and Visitors Bureau as a Tourism Development
Authority (TDA) to promote travel, tourism, and conventions in New Hanover County, and to
administer related tourism expenditures. The TDA shall take effect and come into creation on
January 1, 2003, with all those powers, rights and duties set forth in House Bill 1707, Session
2001. The Authority shall hereinafter be known and operated as the New Hanover County
Tourism Development Authority d.b.a. Cape Fear Coast Convention and Visitors Bureau.

Regular Meetings: The second Wednesday of each month, at 4:00 p.m. in the Finance
Conference Room #500, at the New Hanover County Government Center, 230 Government
Center Drive, Wilmington, NC.
Statute or cause creating Commission: County Commissioners endorsed the formation of
this Commission on 12/16/1974. (Minute Book 16, page 67) The County Commissioners
assigned the Commission the responsibility of studying and preparing recommendations for the
best use of the Room Occupancy Tax Funds to be presented to them for approval. The
Commissioners expanded the membership by adding a Kure Beach representative on 4/16/1984
(Minute Book 19). Furthermore, the Commissioners added a member of the NC Shore & Beach
Preservation on 5/16/2005, County Finance Director as special appointee on 2/16/2004, and the
Figure 8 Homeowners Association president or designee as an ex- officio member on 7/1/2013.
Purpose of Commission: To investigate, initiate, and support general water resource
development projects to include but not limited to:
1. Port, waterway and river improvements supporting the shipping industry;
2. Beach nourishment and conservation in conjunction with inlet management; and
3. Water resource development projects that will serve industry; encourage tourism;
commercial /charter fishing; recreational boating and mitigate the threats of storms and
flooding
Brief on Functions: The Commission will cooperate closely with the U.S. Corps of Engineers,
the N.C. Division of Water Resources and other federal and state agencies in the pursuit of
projects that may benefit our community. The Commission will also work with elected officials
including federal and state officials and such groups as the NC Water Resources Congress and
NCBIWA in order to obtain support, approval, and funding as appropriate. The Commission will
pursue these projects with full consideration of potential environmental effects. Finally, the
Commission will make every effort to fully inform and provide recommendations to the County
Commissioners, Wilmington City Council, and Beach Town Councils.

Assigned responsibility for recovery of the Fuels Components Manufacturing Operation following a Zirc Fire event in July
of 2004 that shutdown the facility. Re- established safe operating conditions and controls returning the operation to full
production. Established an operational structure that recovered and exceeded 2004 production by 40% for the year
Global Logistics Manager, Global Nuclear Fuels (12/2002 — 8/2004)
Responsible for all aspects of moving incoming raw material and outgoing customer delivery of nuclear
materials around the world from both the USA and Japan facility. Responsible for the design, modifications, testing, initial
licensing and construction of the RA -JII bundle shipping container for use in the USA and other foreign locations based
on the current Japanese designed container. Both the container project and operations of Logistics required interface with
governmental agencies (Foreign and Domestic) for licensing and approval of operations /construction. This position was
also responsible for the Environmental Projects initiatives. During my tenor the CaF2 Lagoon cleanup project was
completed. This was the single largest Environmental Project in GE at the time. Project was maintained ahead of
schedule and under budget.
Emergency Preparedness and Security Manager, Global Nuclear Fuels (5/2000 — 12/2002)
Responsible for overall Security and Emergency Response capability for the Wilmington, NC Nuclear and Aircraft Engines
facility. Upgraded the site's security plan and physical protection scheme based on the events of 9 -11. Numerous GE
corporate and Governmental agency reviews of the new security measures and plan identified this site as a best practice
within GE and industry. Also during this time I program managed the licensing and initial construction of the new nuclear
powder shipping container (NPC) an $8MM Capital Investment project. Running this project required extensive travel as
well as interface with governmental regulatory agencies (Foreign and Domestic) getting license approval and construction
Work Experience and History (Knolls Atomic Power Lab, Inc. a Lockheed Martin Company
(Previously a GE Company))
Radioactive Materials Laboratory Manager (2/99- 5/2000). Assumed management of the Naval Reactors Radioactive
Materials Laboratory due to performance and personnel issues within the laboratory. Fully responsible and accountable
for the Radioactive Materials evaluation program. Responsible for the testing and evaluation of new structural and fuel
materials for the NR program. Also responsible for post decommissioning material evaluations to ensure equipment and
material performed as expected during their lifetime. Line manager responsible for a $14M equipment, facility and
capability upgrade.
KAPL Advanced Engineering Program (9/97 - 2/99). 3 -year company sponsored program to obtain an advanced degree
in an engineering discipline. Must be selected for the program by company senior managers based on sustained

Shift Supervisor (10/91- 11/93). Senior supervisor assigned to the plant on each shift. Direct representative of the Plant
Manager and has commensurate authority to cant' out his duties and responsibilities. Responsible for 4 plant site
operation when on shift during non - standard work hours
Nuclear Plant Engineer (6/86- 10/91). Assistant to the Shift Supervisor responsible for the day to day operation,
maintenance, training, and testing of the nuclear power plant including all support systems. Directly responsible for
operations during watchstanding. Qualified Shift Supervisor and Nuclear Test Engineer while on shift during this time.

Section 2: Explanation
BA20 -052 budgets appropriated fund balance to support the recent request of New Hanover County
Schools (NHCS) for the following resources: $218,170 for local payout of Superintendent contract;
$64,000 for two new permanent investigator positions to focus on Title IX, harassment and bullying
complaints; $14,250 for a new permanent administrative assistant position to record and file these
complaints for retrieval and tracking; $40,000 for mental health support through the purchase of Darkness
to Light manuals to continue staff training; and $22,000 for a new permanent professional standards
investigator position. All positions will be established within New Hanover County Schools with an
effective date of March 1, 2020. No new FTEs are being requested for the county at this time.
Section 3: Documentation of Adoption
This ordinance shall be effective upon its adoption.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County, North Carolina, that the Ordinance for Budget Amendment(s) 20 -052 amending the annual budget
ordinance for the fiscal year ending June 30, 2020, is adopted.
