April 22, 2020
New Hanover County’s Technical Review Committee (TRC) will meet Wednesday, April 22, 2020 at
10:30 a.m. at 230 Government Center Drive, Suite 110, to discuss the below items.

10:30 a.m. Item 1: Congleton Farms – Preliminary Plan Modification – Perform Res. Development
Request by Clayton Properties Group, LLC to modify the Congleton Farms performance
residential development in order to incorporate a buffer area around an eagle’s nest by
relocating 35 lots within the subdivision. The property is located within the 6000 block of
Myrtle Grove Road, consists of approximately 68.9 acres, and is zoned R-15.

Commercial site plan for a 4,000sf office/warehouse building.
The property is located at 6640 Gordon Road, consists of 2.3 acres, and is zoned
I-1.

Commercial site plan for a Boat/RV storage lot within the Masonboro Commons
Shopping Center.
The property is located at 6400 Carolina Beach Road, consist of 1.9 acres, and is
zoned B-2.

Subject: Congleton Farms – Preliminary Plan Modification – TRC Review
The following comments have been received for the April 22, 2020 TRC meeting.
Please note: following the TRC meeting, a revised preliminary plan addressing each of the below items
must be resubmitted prior to receiving preliminary plan approval.
Planning, Ron Meredith 910-798-7441
1. Please update the plan with the following general corrections:
a. Please label the area between 136 and 133.
b. Please label all utility easements.
c. Please update Utility Note 4, Landscape Note 1, and the Private Road Certification
to reference the Unified Development Ordinance (UDO).
d. There appears to be a dashed line south of lot 103. Please label or remove this line
if it is not necessary.
2. Please include a sidewalk down one side of the proposed Marvin Road per Section 6.3.3.K
of the UDO.
3. Please communicate with the Post Master and Building Safety in reference to the cluster
box location. There may be additional standards from Building Safety.
4. Flood Plain Comments:
a. There is a very small portion of the overall tract located in the northeastern open
space area and the rear of lot 170 that contain a delineated SFHA. The applicable
FIRM shows the area in an AE zone with 12’ Base Flood Elevation (plat note says
10’, however). Any structures within this area will have to meet requirements in
Article 9 of the UDO with a Regulatory Flood Protection Elevation of 14’ (unless a
LOMC/LOMA/LOMR is obtained).
b. If any fill is to be placed on site prior to the development of individual lots or
structures within delineated SFHA’s, a floodplain development permit is needed
in advance of the placement of fill, and must adhere to 9.8.2 E. Fill proposed
during the development of an individual lot or structure can be reviewed and
approved with each respective permit application.

2. The unpaved roads must meet. Appendix D Section D103.1 access road with a hydrant shall have
a minimum road width of 26’ exclusive of shoulders. It is noted that the project began following
code requirements and subsequently deviated.
3. Appendix D103.2 Grade - Fire apparatus access road shall not exceed 10%

1. Land Disturbing Permit has been issued.

1. Utility Plan Review required by CFPUA (alignment change will need to be reviewed).
2. CFPUA water and sewer available
3. At this time capacity is available.
4. DWQ permit application will require a Planning FTSE; as we are working towards incremental
capacity upgrades at the downstream pump stations.
5. Capacity is also dependent on the analysis of the pipe collection system (gravity and force mains).
6. A capacity determination can be provided upon submittal of the NC DWQ FTA/FTSE Application
Form and a Preliminary Plan, this determination does not guarantee capacity.
7. Capacity is issued to projects on a first come, first serve basis, when capacity is available, the plans
meet Authority requirements, and the NC DWQ FTA/FTSE forms are signed by the Authority.

1. NCDOT has no comments as the proposed subdivision is private and as long as the proposed still
falls within the approved TIA scope.

1. Will a change in the site plan require additional permitting from the Corps? There is a valid JD
for the site, but it is difficult to determine if additional permitting is necessary.

1. New Hanover County Schools will need permission from the HOA to use these streets for bus
routing. Without permission we will continue to use existing bus stops at the clubhouse on Lt.
Congleton and along Myrtle Grove Rd @ Lt. Congleton Rd.
