Board of Commissioners - May 18, 2020 ITEM: 1 NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: 5/18/2020 Consent DEPARTMENT: Engineering PRESENTER(S): Jim lannucci, County Engineer CONTACT(S): Jim lannucci SUBJECT: Adoption of a Resolution Modifying the Implementation of the Stormwater Services Program BRIEF SUMMARY: On December 16, 2019, the New Hanover County Board of Commissioners authorized the establishment of a Stormwater Services Program for the unincorporated area of New Hanover County effective July 1, 2020, to include a Stormwater Services fee on the tax bills which will be mailed in August 2020. As a result of the impacts of COVID -19, residential property owners (who may be unemployed /underemployed), businesses (that may be struggling financially), and non - profits /churches (that may have experienced a decrease in charitable giving), have experienced financial hardships. The inclusion of a Stormwater Services fee on the August 2020 tax bills would add additional financial obligation to these groups. In order to support the community during this time and not add any additional financial responsibility, staff proposes the following modification to the Stormwater Services Program implementation: 1. The implementation date for the Stormwater Services Program will remain July 1, 2020, with a special revenue fund established July 1, 2021. 2. Initial Stormwater Services fees will not be included on the August 2020 tax bills, but will be included on the tax bills that will be mailed in August 2021. 3. In accordance with the county's current management of stormwater, property owners will continue to be responsible for maintaining the drainage ways on their property through June 30, 2021; however, the county will work with the property owners to delay work, where feasible. 4. For FY 2020 -2021, the Stormwater Services Program will primarily focus on the following: a. Emergency Watershed Protection (EWP) grant funded work in the approximate amount of $4,700,000. b. Installation of culvert and related ditch work as part of the Military Cutoff Extension project. c. Completion of priority projects based on available funding. d. Develop a list of stormwater capital projects to begin on or after July 1, 2021. e. Completion of Stormwater Services Program ordinance and technical manual. 5. The county will assume maintenance responsibility on July 1, 2021. 6. Addition of the following 13 positions effective July 1, 2020, with partial funding for FY 2020 -2021 in order to begin providing maintenance on July 1, 2021: Program Manager (one position) Permit Assistant (one position) Technician (eight positions) Inspector (two positions) CAD /GIS Specialist (one positon) 7. Due to COVID -19 restrictions, bidders were instructed to mail their bid to the Finance Office located at 230 Government Center Drive, Suite 165, Wilmington, NC prior to the 11:00 AM, May 1, 2020 deadline and if they were dropping off their bid, to take note of the limited walk -in hours Monday- Friday from 10 AM to 2 PM for the Government Center. The bid opening at 11:00 AM EST, May 1, 2020 was conducted using Microsoft WebEx. Three bids were received in response to the solicitation. Staff requests that the commissioners award the bid and contract to Carolina Cleaning & Restoration Services, the lowest responsive, responsible bidder whose bid totaled $399,912.37. The county received two grant awards for hazardous debris removal and watershed restoration for specific bodies of water in New Hanover County related to Hurricane Florence. The federal grant was from the Natural Resources Conservation Service in the amount of $3,627,109.20 and the state grant was from NC Division of Soil and Water Conservation in the amount of $1,099,124. The federal match requirement will be provided by the state funding; therefore, the project is 100% grant funded. RECOMMENDED MOTION AND REQUESTED ACTIONS: Adopt resolution awarding bid to Carolina Restoration & Cleaning Services in the amount of $399,912.37 and authorize the County Manager to execute the contract, contract form to be approved by the County Attorney. Currently, the county has certain supplies, materials, equipment, and apparatus that are surplus to its operations. A complete list of these items including a description is attached as Exhibit "A ". Following board approval, non -profit organizations will have the opportunity to inspect and purchase certain property prior to being sold by auction. Afterwards, all remaining property will be disposed of according to the procedures prescribed in Chapter 160A- 270(c) which authorizes the disposal of personal property electronically using an existing private or public electronic auction service. Staff proposes to utilize the services of GovDeals, an online internet based provider servicing governmental entities. Any items not sold electronically will be disposed of by any other method authorized by the statutes including discarding. Non - profit organizations will have an opportunity to inspect and purchase certain property prior to being sold to the general public. Board of Commissioners - May 18, 2020 ITEM: 4 - 1 - 1 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION DISPOSAL OF SURPLUS PROPERTY WHEREAS, New Hanover County owns certain personal property itemized on attached Exhibit A that is no longer functional for governmental purposes; and WHEREAS, the New Hanover County Board of Commissioners is desirous of declaring the property surplus and disposing of the property as authorized by North Carolina General Statute (NCGS) 160A- Article 12; and WHEREAS, following the board's approval, the board wishes to allow non - profit organizations the opportunity to inspect and purchase the property prior to being sold by public auction; and WHEREAS, following the board's approval, the board wishes to donate a 2011 Ford Crown Victoria police vehicle to the Navassa Police Department located at 334 Main Street, Navassa, NC 28451 according to the procedures prescribed in Chapter 160A -274 which authorizes the disposition of real property and personal property to other government agencies; and WHEREAS, all remaining property will be disposed of according to the procedures prescribed in Chapter 160A- 270(c) which authorizes the disposal of personal property electronically using an existing private or public electronic auction service; and WHEREAS, items not sold by electronic auction will be disposed of using any other method authorized in the NCGS 160A- Article 12 including discarding the items. The contractor for the project, Integrity Builders, has provided a change order for an increase of $43,037 for additional water service requirements, additional ductwork coating in the pool equipment storage room, electrical work for the pool pump house, and additional asphalt and fencing for the trail. Per the agreement with the City of Wilmington, increases in construction costs must be approved by the County and city. The city has approved the change order and agrees to reimburse the county 40% of the shared cost ($36,737), which is $14,695. The Northern Regional Park capital project that was part of the FY19 CIP plan is complete. The County will use $28,342 of the project savings to pay it's 60% of the shared cost ($36,737) and 100% of the Echo Farms trail- related cost ($6,300). The purpose of CCPT is to identify and address gaps or deficiencies in services and resources for children and families, as well as build public awareness through multiple resources, including providing our findings and concerns for your information and support via this annual report. Child abuse and neglect are extremely complex social problems that require well - planned strategies for prevention and communities that are responsive to these problems. Our report is intended to provide a starting point for you and others who care about "our" children and families. There is no single answer or approach that can prevent child abuse in our county. However, we are encouraged that the information contained in this report will provide you with valuable information in order to make the best decisions on behalf of our children. Twenty -one local agencies represent our CCPT. During 2019, these agencies met 14 times and extensively reviewed select cases. These cases were selected as they represented serious unmet needs of families in New Hanover County who were receiving services as they were unable to meet the needs of their children. These case reviews also serve to bring to the surface underlying problems that impact the entire community. Unfortunately, the recurring identified gaps and barriers are basically the same as we have brought before you over the past several years. In addition to those members mandated and designated by NC G.S. 7B 1406 on our letterhead, the statue provides for appointment by the county commissioners of an additional member from and up to five at -large members. The PAG unanimously recommended the New Hanover County Board of Commissioners and NHRMC Board of Trustees narrow its focus to Atrium Health, Duke Health, and Novant Health, and begin developing letters of intent (LOIs) with each of the three recommended proposers. While the group is recommending the three partners for further due diligence, no proposed partner will be eliminated, pending additional public input and further evaluation. On Monday, May 11, 2020, the NHRMC Board of Trustees received this recommendation and, in turn, unanimously approved the PAG's recommendation. Leadership from the PAG will attend the Commissioners' May 18 meeting to make a similar presentation, offer a recommendation, and receive direction from the New Hanover County Board of Commissioners. RECOMMENDED MOTION AND REQUESTED ACTIONS: Approve the PAG recommendation to focus on and develop LOIs with Atrium Health, Duke Health, and Novant Health. In addition, county staff is recommending the board include direction, asking PAG leadership to return to the June 15 meeting for an update on its progress with site visits and development of LOls. County staff is also recommending the board direct staff to schedule a public hearing as required by the North Carolina General Statutes to receive comment on all six proposals — suggested hearing dates are the evenings of Monday, J une 8 or Monday, J une 22 with a staff recommended date of Monday, June 22 when COVI D -19 restrictions on gatherings will likely be loosened under the Governor's Order and we can accommodate a larger gathering in a safe manner. Included in the package was $150 billion in aid to state and local governments. Of that amount, $4 billion was allocated to North Carolina. Subsequently, the N.C. General Assembly passed, and Governor Cooper signed, HB 1043, providing allocations of $150 million to local governments (with an additional $150 million held in reserve) to be used toward expenses incurred to respond to the coronavirus. The third quarter of fiscal year 2020 will be presented which includes financial activity through March 31, 2020. As an overview, the county's general fund has received $244.5 million, or 77.9% of budgeted revenues and has expended $205.8 million, or 68.7% of budgeted expenditures. Major revenue sources of ad valorem and sales tax were trending above target for the third quarter, but is expected to be significantly impacted by COVID -19 in the fourth quarter. The full impacts of COVI D -19 on these revenue sources will not be known until the beginning of the next fiscal year. Fire Services and Environmental Management funds have received $14.4 million (86.5 %) and $16 million (65.5 %) of budgeted revenues and have spent $12.2 million (73.6 %) and $15.8 million (64.8 %), respectively. Included is a summary of revenues and expenditures as recorded by the County for the General, Debt Service, Environmental Management, and Fire Services Funds. This information is provided to help keep you abreast of the financial status of the County on a regular basis throughout the fiscal year. Thus, six months of sales tax has been received through the third quarter and represent 52.3% of budgeted sales tax exceeding the two previous fiscal years. • Other Taxes exceed prior year collections in both the dollar and in the percentage of collection through the third quarter as real property transfer taxes continue to grow beyond expectations in addition to higher than anticipated vehicle rental and heavy equipment tax. • Expenditures in most County functions are lower as a percent of budget than prior year. Economic & Physical Development and Transfers are not distributed evenly by month. Rather, expenditures are paid when due. DEBT SERVICE FUND HIGHLIGHTS: • Ad valorem tax collections through the third quarter generated by the 6.47 cent dedicated tax rate was approximately $22.1 million, which is higher than the previous two years. • Debt service is paid from this fund when those payments come due. ENVIRONMENTAL MANAGEMENT FUND HIGHLIGHTS: As with the General Fund, many revenues and expenses do not fall evenly throughout the year for Environmental Management. • Charges for Services are slightly lower than prior year at $12.5 million collected through the third quarter. This can be attributed to the additional activity that occurred in the prior year as recovery efforts from Hurricane Florence continued. • Reimbursement for Hurricane Florence debris pickup has been received to reimburse the usage of fiscal year 2019 fund balance related to these expenses. • Operating expenditures are lower as a percent of budget than prior year at 56.1% while capital expenses are not made evenly throughout the year and equate to 34.6% of the capital expense budget. FIRE SERVICES FUND HIGHLIGHTS: Again, as with the General Fund, many revenues and expenses do not fall evenly throughout the year for Fire Services: • Collections of ad valorem tax are higher than prior year at $10.5 million through quarter three and represents 100.6% of budgeted ad valorem revenue. • Sales taxes are received from the State two and one half months following the month in which they are collected by the vendors across North Carolina. Grievances and complaints over the period dropped and represented personal are now more involved in the overall process. • Assumed overall responsibility for the Company's Welding and Quality Inspection programs. The welding program obtained full recovery from a self- imposed shutdown of activities a year prior. The welding program is now fully engaged and capable of supporting the testing needs of the business. The Quality Inspection program increased its capability by greater that 50 percent and is now considered one of the best programs on site. This is a significant change from their old reputation of barely supporting the needs of the customers and the program. • Routinely used to lead or participate in task groups to evaluate and improve below standard performing organizations within KAPL. Maintenance Manager (12/94- 4/96). Directly responsible for the overall maintenance and operating schedule of the nuclear plant and support equipment. • Reduced the length of planned maintenance shutdowns by 33 percent while increasing the amount of maintenance performed by 25 percent during these shutdowns. • Developed and implement methods to safely conduct maintenance during operating periods that historically were performed during shutdown periods. Reduced the number of shutdown periods by 33 percent. • Reduced the plants out of commission and restricted use only equipment to historical lows. At the time of final shutdown the plant had zero out of commission and restricted use equipment. Never been achieved before except at initial startup in the early 1960's. • Coordinated operations affecting other site organizations including discharge systems to New York Waterways. Improved overall operation of the system such that no State Pollution Discharge Elimination System permit violations occurred during this period.
