Oppose project Public Comment Logan Homes proposal is beyond reasonable growth/development with nearly 300+ homes/apartments on only 51 acres. Their proposal is ripe with misleading information, and inaccuracies, provided to those charged with making the decision. Oppose project Public Comment This is not the first time I have entered a complaint regarding this project. Changing the zoning will adversely impact the surrounding neighborhoods and threaten additional flooding. Just look at the mess of the project at the corner of Edgewater Club Rd. and Porters Neck Rd. The developers there are at least conforming to the existing zoning. But, not one tree was left standing - the land was raped and denuded. Now, we are facing another deluge of building that will do the same. Please insist than any development going in the area conform to the existing zoning and that the environment of trees is not destroyed. When the next hurricane appears, we will be flooded if this is allowed to continue. Pender County has put limits on development and we need to as well. The interchange at Futch Creek and Market Street with the Michigan U-turn in place is overcrowded with multiple accidents and deaths. Traffic at Porter's Neck Rd intersection is at a standstill in 5:oo in the afternoon with cars backed up to Walmart and/or Marsh Oaks. Laney High School is the most over crowded high school. Oppose project Public Comment This project will only lead to future problems for NHC and the residents of the Ogden, Bayshore, Porters Neck, and Hampstead communities. The traffic is already too heavy for this area and there is such limited space up here, there is no way to redesign traffic flow to take into account this large number of additional cars every day. Schools and public services (fire, water, safety) will be significantly overcrowded. Not to mention that it seems like the only new businesses getting developed are car washes and storage. The local gas stations, grocery stores, and restaurants CANNOT support this large of an increase in a short time. My bigger concern is flooding and water issues. We lose power regularly just because of rain and trees going down. Add onto that a huge development of too many homes and apartments, and it will be a nightmare. I live in a neighborhood near (I am not on) Pages Creek and we already have significant flooding and standing water issues just from the current residents in this area. I have been upgraded to a flood plain even though I don't live on the Creek. The water flow issues are enough that this entire neighborhood (Marsh Oaks) will all be considered a flood plain before this development even gets finished, and will significantly reduce property values in this area. The infrastructure needs to be in place first, not being a scramble to deal with 5-10 years after the mistake of letting Logan Homes build occurs. Oppose project Public Comment With the existing growth in this area, this development would create huge traffic problems. At a minimum, it would require the roads in the area, especially Porters Neck road and the circle to be greatly expanded to handle the additional traffic. Porters Neck road would need to be 4 lanes. Currently, any utility work being done in that area even just for a day or two causes huge traffic delays and backups. I oppose the construction of this development in such a limited area. This is not NAMBYism. We have valid reasons to be concerned, namely: 1). Incomplete traffic analysis conducted on behalf of Logan Homes based on limited scope and timing, 2). Approved developments in the Porters Neck communities will add over 500 new homes, none of which were factored in to the Traffic Impact Analysis. 3). The Murray Farm development includes apartments that have no access to network streets and will not be served by public transit; therefore, they will be unconnected and auto-dependent. 4. The Porters Neck community has the most restricted access per capita in the county with only one full intersection at Market Street and limited access via Futch Creek to US 17. Please represent the 1000's of families in Porters Neck and reject this development as its proposed. Please consider number [3] on that list: Welcome density, but not just anywhere. Dense development, particularly dense residential development, works well when it adjoins service, has direct access to a well-connected network of streets, and is served by transit. Conversely, dense development, whether residential or commercial, adds heavily to traffic congestion when isolated, unconnected, and automobile dependent. Logan Homes’ is proposing dense development in Porters Neck, an area with the most restricted access per capita in New Hanover County. Apartments included in The Oaks at Murray Farm will have no direct access to network streets, they will not be served by transit, they will be isolated, unconnected, and automobile dependent. In short, these proposed apartments in Porters Neck are exemplary of “dense” development in every negative sense of the word. You will soon hear several arguments regarding quality of life and environment. There are even credible arguments regarding risk to life itself. Out of respect for others from my community and your time, I am attaching three single page position papers all related to traffic that advocate: (1)Apartments as part of The Oaks at Murray Farm are detrimental and unfit for this area. (2)The Traffic Impact Analysis was incomplete and describes what’s missing. (3)The Proposed new Futch Creek Rd access to US-17 may risk life itself. I chose to submit information in this format to prepare you, in part, for the public hearing February 3rd. As a former senior USAF staff officer, I have used single page point papers for background and advocacy preparation prior to Pentagon and Congressional Committee hearings. I have copied your staff, clerk and deputy clerk, to assist if you seek anything further prior to the meeting. Thank you in advance for your consideration, Bob Kaess Tuscan Way, Porters Neck APARTMENTS ARE DETRIMENTAL AND UNFIT IN ALL ASPECTS TO PORTERS NECK There is nothing “typical” about Porters Neck/Figure 8 Island traffic access. In fact, we claim this area has the most restricted access per capita in New Hanover County. The entire area is constrained by one full intersection at Market Street and one controlled access to US-17. Our concerns for traffic impact were dismissed January 9th by Ernest Olds, Member of the Planning Board who lives in Marsh Oaks, when he reported better than forecasted impact to Market St access, following development of Amberleigh Shores Phase I Apartments. While Mr. Olds’ experience is a fact, it is not a relevant comparison to the Logan proposal for The Oaks at Murray Farm. This figure illustrates the reasons Marsh Oaks is blessed with much greater traffic access than Porters Neck and virtually no burden from approved Apartment Communities. In fact, there is no relevant comparison to the Logan proposal for Porters Neck. We identified and studied fourteen (14) Apartment Communities (Existing & Construction) between Mayfaire and Pender County. NOT ONE apartment community in New Hanover County is a valid comparison to the apartments proposed in Porters Neck. Benefits of apartments in The Oaks at Murray Farm are limited to D. Logan and the sellers. Every other impact of this development, requiring rezoning for density, is detrimental: Traffic, Public Safety, Schools, and Environmental are all threatened. ROI is the ONLY Justification for Apartments in Porters Neck. D. Logan agreed with the following statement: “At the end of the day, it [the proposal] will just not work without apartments.” This was based on ROI at the contracted price. * Furthermore, Logan Homes would only agree to remove one, not two 24-unit buildings, proposed by Planning Board Member Paul Boney for internal traffic safety. * This direct acknowledgement from D. Logan was recorded November 8th during meeting Logan Homes requested with HOA leaders. [Exchange with D. Logan and Jonathan McCarthy – MP3 available] Bottom line: There is absolutely nothing positive presented by Logan Homes for this apartment development and no confidence in this community. PLEASE PREVENT DENSE DEVELOPMENT! TRAFFIC IMPACT ANALYSIS IS INCOMPLETE Traffic infrastructure issues are driven by supply and demand. The supply of Porters Neck access and arteries are constrained and being overcome by developing demand. It will take years of Federal, State, and County resources and effort to change Porters Neck supply. The immediate opportunity for County Commissioners is to limit the rate of growing Porters Neck demand. The people in Porters Neck and Figure 8 Island are not opposed to development. Our concerns regard the rate of development and the threats to environment and quality of life. Principal among those threats are the impacts of traffic. Traffic Impact Analysis has become a key talking point within the community and with County decision makers. During the recent Planning Board Meeting there was a claim that NCDOT “approved” Logan’s Traffic Impact Analysis. From residents came the call “Fake Study”. The Ramey Kemp & Associates (RKA) TIA presented for Logan Homes was called a “Fake Study”. This TIA was prepared by licensed professionals. Why call it a fake study? NCDOT may “agree” with the TIA, but how could they “approve” it? What’s wrong? What’s missing? When you live in Porters Neck you are the traffic and you experience its impact during countless days, in and outside the boundaries of the communities. It does not take professional license or expertise to realize the RKA TIA was limited in scope of time and area studied. What’s wrong? What’s missing? • Scope of Traffic Counts: Traffic counts were conducted during a single day with AM and PM 2hour peak periods at several intersections. Real life Porters Neck traffic counts vary widely during different days, different hours, different locations at intersections beyond the RKA TIA scope. Porters Neck Road is not simply a traffic circle and Market Street intersection. Connection between these points in this most important artery also includes uncontrolled access streets for 6 communities and 35 driveways. It is literally an artery of life support for EMS to the Davis Community and beyond. • Public Safety for Futch Creek traffic: The hazards of traffic departing and returning were not included in the RKA TIA. There was no risk analysis. Indeed, there will be new avoidable risk introduced by Logan Homes planning a second exit lane onto US-17. This must not be approved without resolution of other US-17 issues. Because this risk is identified—it will not be unintended consequence. • Known increase in demand from over 300 homes approved for development. Here are the details not discussed in RKA’s analysis: o Edgewater Club Impact on Traffic Circle: Waterstone at time of TIA, only 10 homes were occupied. [Add 137 more in process/approved]. o Porters Neck Road Impact on Traffic Circle: Forest Creek approved to triple in size from 45 current lots. [Add 90 homes]. o Porters Neck Road Direct Access Impact: Porters Point (58 homes) approved to double in size [Add 50 homes] o Futch Creek Road: The Villages at Plantation Landing under construction. [Add 49 homes] • Growing outside demand for Market Street-Porters Neck intersection. No analysis of commercial retail and restaurant development northwest of the intersection including the new Holiday Inn. Bottom line: There are no quick fixes to supply greater access—there’s little NCDOT can do. There are opportunities to limit demand and detriments to public safety. PLEASE PREVENT DENSE DEVELOPMENT! DISAPPROVE NEW RISK - Logan Homes’ proposed 2nd Futch Creek Rd lane to US-17N This 2-lane right turn is NOT similar to the previous Military Cutoff merge to Northbound Market Street. There are two relevant differences to RISK of life and property: (1) Right Turn on RED traffic from 2 lanes risks highway speed traffic at (or above) 55MPH limit. (2) Right Turn on GREEN traffic from 2 lanes competes with high demand for short distance to U- Turn for Southbound US-17 and I-140. (1) Traffic causing hazards is indicated in RED. Vehicles in the left lane obstruct view of oncoming traffic for drivers in the right lane attempting right turn on RED. The developer tried to spin numbers to look favorable for high density development which glazes over the root of the problem. Here are some numbers I hope the county commissioners will consider. Porters Neck communities consist of 5.1 square miles of neighborhoods which are served by 2 access roads. One of these access roads is Futch Creek Road which being constrained in the direction for drivers is equivalent to a half access road since you can on travel north which adds an additional two miles of driving distance. By comparison, the Bayshore/Amberleigh Shores/Marsh Oaks neighborhoods consist of only 1.2 square miles served by 3 access roads. Middle Sound Loop communities consist of 4 square miles and have 5 access roads. In comparison Porters Neck traffic density is four to eight times higher than any of the neighboring communities. Past history created this bad situation with no feasible solutions for additional access roads. Oppose project Public Comment As a coastal community it is imperative that we protect what is left of the natural resources in our area in order to protect our homes and the quality of life in a steadily eroding environment. Traffic on Porters Neck Road, Futch Creek and Market Street are already beyond capacity and adding apartments will implode our roadways and create dangerous traffic conditions. In addition to the traffic, the uprooting of trees and vegetation will increase flooding under normal rain conditions; imagine what it will do in more dire storms. Water quality is already questionable and additional building will only make it worse. I understand that Wilmington is growing and affordable housing is required, however, there are other parcels of land West of Market that might be more advantageous and safer for the community. The future of our education may lie in a balance if we continue to overcrowd schools and create a void for the children to access a safe environment and proper size classrooms. It is already problematic to get students to Blair school, with the influx of more vehicles, this will only get worse. The studies that have been done appear distorted and tilted towards building, but the reality of what exists does not. I have listened to the DOT report that the traffic will not be impacted much, but I would like to know what time of day they actually did the study, since every time I try to get across Market from Futch Creek to make a U-turn, I have a long wait, except during the stay at home mandate. I also implore you to review the water federation’s findings on the impact to shellfish life and the waters in the marsh being affected. As is, we do a lot of damage to our environment, let us at least try to slow the damage and limit the builds in highly sensitive areas. As our county commissioners, you have been trusted to make sound decisions to grow our county responsibly. In addition, we expect that you will protect us and make sound decisions that are best for the citizens inhabiting the neighborhoods. I urge you to make a responsible decision to exclude any and all apartment builds in the Porters Neck area east of Market Street. The land cannot support such structures and influx of the number of people that would be living there. I also understand that “everyone” wants more growth, including more and more tax revenue. However, we’re no longer living in the world most of us were born into. We’ve seen the summers get hotter – water restrictions have become more frequent, storms (including hurricanes) have become far more damaging, and ghost forests – due to seawater creep – are expanding. With what we know about weather changes alone, we’re NOW LOOKING AT A FUTURE THAT WILL BE QUITE DIFFERENT FROM THAT OF THE PAST. And that, good stewardship would demand, means that we need to adjust our thinking and prepare for it. IN short – this is not 1990, or even 2000. We have experienced and understand more the climate issues that we now – and will continue to – face. As well as their consequences. We need to ensure that we do not permit conditions that will cause us to experience the same issues we’ve experienced in past storms – high water, flooded homes, closed roads, power loss, and such. And ensure that we don’t permit issues that affect community safety, livability, and finances. As one dictionary states: Carrying capacity: the number of people, other living organisms, or crops that a region can support without environmental degradation. The goal here is to develop wisely, but sustainably, to understand that future reality will mean multiple instances of major damage – and escalated loss and cost – for any area that lacks adequate resilience for responding to major tropical storms. That said, Porters Neck, an area of low elevation just off the ICW, incorporating or adjacent to several creeks and/or streams, has been increasingly at risk over the last several years as additional development has occurred. The retention ponds and drainage systems currently available – as everyone knows – didn’t serve well in Florence, so removing several additional acres of drainage and paving over a larger portion of that area will only make the situation worse. Homes on small lots have a far smaller percentage of permeable surface than homes on larger lots. And apartment buildings and their necessary parking lots remove significantly more of the needed permeable surface. Given the carrying capacity of this area, a residential development with homes on larger lots and a few large retention ponds would do considerably less damage to this area in future weather- and water-related events. As a retiree, I’ve found this a congenial place to live. However, given the now-certain future we know, if – today – I had to redo that decision, knowing what I now know I'm not certain I'd choose to live in New Hanover County. You – as representatives of this County’s residents and taxpayers – are in a position of responsibility. What you choose to do will help to make this county a more desirable place to call home, or a mismanaged financial disaster. It appears that some young students are going to have to be bussed 45 minutes each way to attend another elementary school. The issues of traffic also came up and those supporting the project indicated that there would only be an increase in a few seconds in the commute time. The reality is that there will be a huge increase in commute time. Further the intersection of Futch Creek and Rt.17 is extremely dangerous. Cars going into Wilmington will have to merge onto 17 and then do a quick U-turn to go back on 17 the correct way. Oppose project Public Comment The proposed project is still too dense for this property size and location. Many sections of the property are already very narrow, especially in the section that the builder is proposing to build the town homes and apartments. Why try to literally squeeze in 300 units into an area that should truly only have a third of that? If you look at the other developments surrounding the proposed area, consuming at least twice the size of this property, you probably wouldn't find 200 homes. Porters Neck is a great place to live and I'm sure the builder want to maximize the potential of this area, but there are quite a few other factors that need to be addressed prior to a project of this magnitude. Porters Neck Road has seen a substantial increase in traffic with the addition of Porters Neck Elementary School & the new Waterstone development. With those (2) additions alone, we need to look towards the plan for road improvements before additional residences are built. Porters Neck Road is only a two lane road. Can Porters Neck Road expand into a four lane road? Is it feasible? Has DOT completed a study? If so, how long would before that project could start? Why race to populate Porters Neck to such an increase population now when the infrastructure is not truly there? Another concern is water drainage. Porters Neck has seen an increase in water drainage issues in the last few years. Part of Porters Neck Road, not far from this property line, washed away during Florence. If this were to happen again, with the addition of Waterstone and The Oaks at Murray Farm, could the problem be worse? Would flooding wash out more of the road? Porters Neck has been a great place to live. Logan Homes has built a strong and respectable reputation as one of the best builders in the Southeast. They have built some amazing developments in other parts of our county. They have the ability to maximize profits building well built single family homes on this property without having to build so much extra fluff (as in apartments & town homes). Elements of grave concern to me are focused on the apartments and duplexes increasing density without sufficient critical services already stressed in this area. The Traffic Impact Analysis presented to the Planning Board was incomplete and the community’s response provided expert witnessed testimony describing in detail what is missing. The Proposed new Futch Creek Rd access to US-17 cannot safely alleviate congestion which will eventually lead to unnecessary loss of life. These and many other issues include already over crowed schools, storm water drainage, environmental impacts surge, waste management, emergency response all leading to a decreasing quality of life. Oppose project Public Comment As a 15+ year resident of the greater Porters Neck area, we have seen growth over the years and so far, while the growth is not always welcome, it has been reasonable and stayed within the current zoning of the area. The Logan Homes request/proposal to rezone the 51 acres off of Shiraz Way and build 300+ homes/apartments is too much. The density of the housing they are proposing will bring a myriad of problems to an already growing and soon to be overpopulated area. If this project is approved there will be significant negative consequences for our traffic infrastructure, public safety, storm water and water quality, and schools.
