AN ORDINANCE OF THE COUNTY OF NEW HANOVER
AMENDING THE ZONING MAP OF ZONING AREA #2
OF NEW HANOVER COUNTY, NORTH CAROLINA,
a~-°-- ADOPTED DECEMBER 15, 1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN:
Section 1. The Zoning Map of Zoning Area #2 is hereby amended by re-
moving the hereinafter described tract of land from the present R-15
Residential District classification and putting it in the B-1 Business
District classification, said land being described as follows:
BEGINNING at an iron pipe in the northwestern bank of Motts Creek, said
iron pipe being in the intersection of the northwestern bank of Motts Creek
with the southwestern right-of-way line of Eastwood Road (U.S. Highway 74),
75 feet from the centerline thereof. Thence from said beginning point,
along and with the northwestern bank of Motts Creek, South 55 degrees West
188 feet to a point; thence along and with the northwestern bank of Motts
Creek, South 50 degrees 40 minutes West approximately 30 feet to a point;
` thence North 52 degrees 5 minutes West, 200 feet southeast of and parallel
to the southwestern right-of-way line of Eastwood Road (U.S. Highway 74)
approximately 490 feet to a point, said point being in the southeastern
right-of-way line of a 25 foot street called Southerland Avenue as shown
on a survey for C. H. Powell by J. L. Becton dated May 8, 1933; thence along
and with the southeastern right-of-way line of said Southerland Avenue North
26 degrees 50 minutes East approximately 205 feet to an old axle in the
southwestern right-of-way line of Eastwood Road (U.S. Highway 74); thence
along and with the southwestern right-of-way line of Eastwood Road South
52 degrees 5 minutes East 600 f eet to the point of beginning.
Section 2. The County Clerk is hereby authorized and directed under
the supervision of the County Commissioners to change the Zoning Map of
Zoning Area #2 on file in the office of the County Commissioners, so as
to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with
~ this ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and
after its adoption.

Section 1. The Zoning Map of Zoning Area #2 and Zoning Area #6 is hereby
amended by removing the hereinafter described tract of land from the R-15
Residential District classification and putting it in the B-2 Business District
classification, said land being described as follows:
BEGINNING at the intersection of the southern right-of-way line of Oleander
Drive (Highway 76) with the western right-of-way line of Greenville Loop Road;
running thence westwardly along the southern right-of-way line of Oleander Drive
to the western right-of-way line of South Bagley Avenue (the eastern boundary
of B-2 zoned area); thence southwardly along the western right-of-way line of
South Bagley Avenue to a point that is 200' from Oleander Drive when measured
at a perpendicular angle from Oleander Drive; thence eastwardly along a line
that is 200' southwardly from and parallel to the southern right-of-way line of
Oleander Drive to the western right-of-way line of Greenville Loop Road; thence
northwardly along said western right-of-way line of Greenville Loop Road to the
southern right-of-way line of Oleander Drive, the point of BEGINNING.
Section 2. The County Clerk is hereby authorized and directed under the
supervision of the County Commissioners to change the zoning map of Zoning Area
No. 2 and Zoning Area No. 6 on file in the office of the County Commissioners,
so as to make it comply with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with
this ordinance, to the extent of such conflict, is hereby repealed.
Section 4. This ordinance is adopted in the interest of public health,
safety, morals and general welfare of the inhabitants of the County of New
Hanover, North Carolina, and shall be in full force and effect from and after
its adoption.

and placing it in the R-15 Residential Zoning District Classification, said land
being described as follows:
BEGININNG at a point locatec3 in the southern right-of-way of
Eastwood Road (US 74), said point being located approximately
75 feet northwest of the western right-of-way of Dick Avenue
(SR 1414); running thence in a southwestward direction approximately
200 feet to a point located approximately 80 feet northwest of the
western right-of-way of Dick Avenue (SR 1414); running thence in a
southeastward direction parallel to and 200 feet southwest of the
southwestern right-of-way of US 74 a distance of approximately 860
-feet to a point located in the northern right-of-way of Wrightsville
Avenue (US 76); running thence east along said northern right-of-way
a distance of approximately 100 feet to the southern right-of-way of
MacRae Avenue; running thence along said southern right-of-way in a.
northwest direction approximately 800 feet to a point located in
the eastern right-of-way of Dick Avenue; running thence along said
eastern right-of-way approximately 110 feet to a point located in the
southern right-of-way of Eastwood Road (US 74); running northwest
along said southern right-of-way approximately 125 feet to the point of
BEGINNING, containing 1.74 acres, more or less. fihis being the same
land as shown on New Hanover County, Harnett Township, Tax Maps 57-13,
Blocks 03, Parcel 6, Block 06, Parcels 1, 2& 7, BLock 07, Parcel Ol, and

Section 2. The County Clerk is hereby authorized and directed under the

2 on file in the office of the County Commissioners, so as to make it comply
with this ordinance.
Section 3. Any ordinance or any part of any ordinance in conflict with
this ordinance, to the extent of such conflict, is hereby repealed.

520 5' east 200 feet southeast of and parallel to the southwestern right-of-way
line of Eastwood ltoad approximately 185 feet to a point in the centerline of
Motts Creek; running thence along and with the run of said Motts Creek in a gen-
erally southwestwardly direction approximately 340 feet to a point; thence 300
feet northeast of and parallel to U.S. Highway 76 approximately 200 feet to a
point; running thence north 510 13' east approximately 50 feet to a point; running

BEGINNING at a pipe, said pipe being at the intersection of the southeastern

U.S. Highway 74 (Eastwood Road); running thence South 520-02' East along and with
the southwestern right-of-way line of U.S. Highway 74, 103.8 feet to a point;
thence South 540-16' East along a chord for a distance of 381.5 f eet to a point,
said point being 5 feet west of the centerline of Motts Creek; thence running up
and with the run of said ditch or branch (Motts Creek) the following courses and
distances: South 780-24' West 85.6 feet; South 400-04' West 110.0 feet; South
40-43' West 104.0 feet; South 20-21' East 94 feet; and South 30-13' West approxi-
mately 8 feet to a point, said point being approximately 300 feet from the

Classification and putting it in the B-1 Business District Classification, said
land being described as follows:
BEGINNING at an iron pipe in the southeastern right-of-way line of Airlie
Road, said pipe being south 43 degrees 30 minutes east 41.5 feet from a stone,
R. A. Ashworth, Jr.'s southeast corner on the northwestern side of the highway;
thence from said beginning point running in a northeasterly direction along and
with the southeastern right-of-way line of Airlie Road 142.3 feet to a point,
said point being approximately 1,000 feet southwest of the southwestern right-
of-way line of U.S. Highways 74 & 76; thence in a southeasterly direction approx-
imately 350 feet to the centerline of the Intercoastal Waterway; thence following
~ the centerline of said waterway in a southwesterly direction approximately 310

the hereinafter described tract ofla.nd from the present B-1 Business District
Classification and putting it in the R-15 Residential District Classification,
said land being described as follows:
BEGINNING at a stake in the northeastern line of a 15 foot alley, said stake
being the southwestern corner of Lot 4 and the southeastern of Lot 5 of the Atlantic
View property; running thence northeastwardly along the dividing line between said
Lots 4 and 5, 401.35 feet, more or less, to a stake in the new right-of-way line of
U.S. Highway 74-76, said point being the northwestern corner of said Lot 4 and the
northeastern corner of said Lot 5; running thence northwestwardly along the right-
of-way line of said U.S. Highway 74-76, 50 feet, more or less, to a stake, the

Registry. Excepting from said description, any portion thereof which may lie in

Section 1. The Zoning Map of Zoning Area #2 is hereby amended by removing
the hereinafter described tract of land from the present R-15 Residential District
Classification and putting it inthe B-2 Business District Classification, said
land being described as follows:
BEGINNING at an old Granite Stone marked "B", by which stands a concrete
fence post, same being a corner of the Giles (once Bradley) estate land and the
Pembroke Jones Estate land, said beginning corner being the southwest corner of
Lot 14 as shown on the map of the Giles land recorded in Lands and Dowers Book "B"
at Page 28 and also in Map Book 8 at Page 10 of the New Hanover County, North
Carolina, Registry; said beginning stone being north 9 degrees 30 minutes east,
about 1190 feet from the intersection of the Jones Estate line and the tracts of
the Tide Water Power Company's trolley railroad, (said line extended south of the
Jones Estate land being the eastern boundary of the new St. Andrew Episcopal Church
near Wrightsville Sound); thence running along the western edge of S.R. 1409 630
feet, more or less, to the northwestern corner of Lot 12 of the Giles land sub-
division as shown on the aforesaid map; thence south 55 degrees 15 minutes west
with the back line of Lots 9, 10, 11, and 12 of the Giles land subdivision, about
460 feet, more or less, to the Giles-Westbrook line; then north 22 degrees 15
minutes east 1165 feet, more or less, to the southern edge of S.R. 1413; thence
along the southern edge of S.R. 1413 80 feet, more or less, to a point; thence
south 44 degrees along the southern line of the M. W. Divine land 172 feet, more
or less, to the point of BEGINNING.

being described as follows:
BEGINNING at a point in the western right-of-way of Oleander Drive, said point
being the southwest corner of Lot 17 of the J.E. Hines property as recorded in Map
Book 3 at Page 12 of the New Hanover County Registry; running thence north 59 degrees
50 minutes west 164 feet to a point; thence in a northeastwardly direction and parallel
to said Oleander Drive 355 feet, more or less, to the southern low water mark of
Bradley Creek; thence eastwardly along the said low water mark of Bradley Creek 214
feet, more or less, to the eastern right-of-way of Oleander Drive; thence southwesterly
along the said eastern right-of-way of Oleander Drive 355 feet, more or less, to a
point, said point being south 59 degrees 50 minutes east 100 feet from the beginning
point; running thence north 59 degrees 50 minutes west 100 feet to the point of
BEGINNING. The above described tract being all of Lot 17 of the J.E. Hines property
as recorded in Map Book 3 at Page 12 including the 100 foot right-of-way of Oleander

Section 1. The Zoning Map of Zoning Area 2 is hereby amended by removing

District Classification and placing it in the 0& I Office and Institutional
Zoning District Classification, said land being described as follows:
BEGINNING at a stake in the center of Motts Creek near the western
line of dam across marsh waters and near the bridge across the said
creek and on the upper end of land side of said dam near wher~> the
said creek intersects with the waters of Wrightsville Sound and runs
thence South 61 degrees 28 minutes laest 147 feet to a point, said
point being at the northwest corner of the right-of-way of Summer

Section 1. The Zoning Map of Zoning Area No. 2 is hereby amended by removing the
hereinafter described tract from the O-I Office and Institution Zoning District Classification and
placing it in the B-1 Business Zoning District Classification, said land being described as follows:
Beginning at a point, said point being in the western right-of-way line of Old MacCumber
Station Road; said point also being at the northeasternmost corner of lot 2R as shown on the
revision map for Raiford Trask, Jr. running thence along said right-of-way 590+ feet North
34 degrees, 26 minutes East to a point in said right-of-way; thence North 84 degrees 37
minutes West 550 feet to a point; thence South OS degrees 23 minutes West 500 feet to a
