HomeMy WebLinkAbout04/05/1995 BOH Minutes 87 I The Dedication of the new Animal Control Services Facility was held at 8:00 A.M. on Wednesday, April 5, 1995, at Animal Control Services, 220 Division Drive, Wilmington, North Carolina. Mr. John M. Coble, Past Chairman, New Hanover County Board of Heal th, was Master of Ceremonies. Reverend James IE. Taylor, Rector, Church of the Good Shepherd, gave the innovation and blessing. City and county officials, Past and Present Board of Health Chairmen and Board Members, Mrs. Donna Neal, Chairman Animal Control Advisory Committee and Committee Members, and guests were recognized. Mr. Robert G. Greer, Chairman, New Hanover County Commissioners, assisted by Canine "Borisu Almeida, performed the ribbon cutting for the new facility. A tour of the building and a reception concluded the ceremony. Following the Dedication of the new Animal Control Services Facility, Dr. Spiro Macris called the regular business meeting of the New Hanover County Board of Health (NHCBH) to order at 8:40 A.M. in the Conference Room. He extended his appreciation to those responsible for the planning and completion of the Animal Control Services Center. Members Present: I Spiro J. Macris, DDS, Chairman Dennis L. (Bob) Parker, Health Director Frances De Vane, Recording Secretary Dr. Macris called for corrections to the minutes of the meeting on March 1, 1995. The minutes were approved. Recognitions: Five Year Service Award Dr. Macris congratulated the following employee for the completion of five years of service at the health department: Ms. Wanda J. (Chloe) Rivenbark, Animal Control Officer I ~8 Good Samaritan Dr. Macris presented a plaque to Jamie Kilgore, Animal Control I Officer, Animal Control Services, for her Good Samaritan Act, an attempt to save a man's life, on December 16, 1994. Committee Reports: Budget Mr. Mark Veenstra, Chairman, Budget Committee, reported that the County Manager and staff have reviewed the Proposed NHCHD Budget for Fiscal Year (FY) 1995-96. He stated that State Grant Budget Revenues have increased approximately $20,000 to $25,000. On May 1, 1995, the County Manager is to present the NHCHD FY 1995-96 Budget to the County Commissioners. Health Promotions Dr. Paul, Chairman, Health Promotions Committee, reported that the Health Promotions Committee met at 6:00 P.M. on Tuesday, March 21, 1995, to discuss 1995 Committee Goals. The Committee decided to focus on the prevention of disease through an awareness campaign on good nutrition. Strategies for the campaign are to include a nutritional survey, public education, food demonstrations, a media campaign and the involvement of restaurants for support of better nutritional menus. Executive I New Hanover County Schools Project Dr. Macris, Chairman, Executive Committee, reported that the Executive Committee met at 6:15 P.M. on Thursday, March 23, 1995. Dr. Macris stated he had received an invitation to participate in a New Hanover County Schools Project. Mrs. Dean will serve as the Board of Health representative for this project. Evaluation of Robert S. (Bob) Parker, Health Director Dr. Macris summarized the performance appraisals on Mr. Parker, Health Director, submitted by Board members. He commended Mr. Parker for his exceptional performance and leadership in New Hanover County, the state and nation. Dr. Macris recommended and moved from Executive Committee for the Board to grant Mr. Parker an exceptional performance appraisal and a 7% merit raise. Upon vote, the MOTION CARRIED. Environmental Health Mr. Coble, Chairman, Environmental Health Committee, reported I that the Committee met at 6:00 P.M. on Monday, February 27, 1995, to discuss the items presented later on this agenda. Ö" ::J Unfinished Business: I Amendment to the New Hanover County smoking Control Regulation (SCR) Dr. Paul recommended from the Health Promotions Committee to exclude bingo establishments from the SCR. He stated the Board held two public forums and advertised regarding the proposed amendment to the SCR. Dr. Paul moved from the Health Promotions Committee to amend the New Hanover County Smoking Regulation to exclude Bingo establishments from the New Hanover County Board of Health Smoking Regulation, adopted October 6, 1993, effective January 1, 1995. The amendment is to be effective April 5, 1995. Upon vote, the MarION CARRIED. Repeal of Existing Regulations Governing Construction, Repair and Abandonment of Potable Water Wells and Repair of Pumps and Plumbing Equipment in New Hanover county, North Carolina, adopted July 6, 1983.. Mr. Coble recommended from the Environmental Health Committee for the Board to repeal the above regulation. This proposed repeal has been advertised. I After discussion, Mr. Coble moved from the Environmental Health Committee for the Board of Health to repeal the existing Regulations Governing Construction, Repair and Abandonment of Potable Water Wells and Repair of Pumps and Plumbing Equipment in New Hanover County, North Carolina, adopted July 6, 1983. Upon vote, the MOTION CARRIED. Adoption of Rules Governing Water Supply Wells in New Hanover County, North Carolina Mr. Coble recommended from the Environmental Health Committee for the Board of Health to approve the final draft of the above rules. Mr. Coble moved from the Environmental Health Committee for the Board of Health to adopt the New Hanover County Board of Health Rules Governing Water Supply Wells effective April 5, 1995. Upon vote, the MOTION CARRIED. New Business: New Hanover County Board of Health Regulations Governi.nq "~RSage and Tattoo Parlor Regulations I Mr. Coble recommended from Environmental Health Committee for the Board of Health to repeal the Regulations Governing Tattoo Parlors adopted September 10, 1980. 90 It was the consensus of the Board of Health to study, utilize and consider strengthening the State Rules for Tattooing and to I advertise for the proposed repeal of the above regulation on May 3, 1995. Ordinance to Control and Restrain the Spread of Infectious Diseases Discussion followed on the proposed repeal of the regulation captioned Ordinance to Control and Restrain the Spread of Infectious Diseases adopted December 6, 1972. It was the consensus of the Board of Health to advertise for the proposed repeal of the above regulation at the May 3 Board meeting. "Direct Control" of Animals Definition Mr. Coble presented a request from the Animal Control Advisory Committee and recommended by the Executive Committee for the Board of Health to consider the following definition for "direct control" for usage by Animal Control Staff: 1. The dog must be wi thin voice range and eyesight of the competent person in control. 2. 3 . The dog responds to voice commands on the first command. I The dog is not allowed on private property unless the owner of the property agrees. 4. Only one dog under control of one person. 5. Any violation of this ordinance constitutes a dog not under voice control. Dr. Clancy moved that the Board approve the definition of "direct control" as presented for internal usage by Animal Control staff and that the definition need not be advertised to the public. Upon vote, the MarION CARRIED. Animal Control Enforcement North of Wrightsville Beach Mr. Currie informed the Board that the unincorporated northern end of Wrightsville Beach is under the jurisdiction of New Hanover County Animal Control Services. Ms. Neal stated that dogs not leashed in this area present a problem. After discussion, Dr. Paul moved for the Board of Health to request that the New Hanover County Commissioners discuss with Wrightsville Beach Alderman the feasibility of Wrightsville Beach I Animal Control assuming the Animal Control enforcement for this area under their extraterrritorial jurisdiction control. Upon vote, the MarION CARRIED. 9L I Resolution in Support of Local Boards of Health Dr. Macris presented a resolution from the Executive Committee requesting that the Board of Health go on record opposing changing G.S. 153A-77. Proposed legislation will allow County Commissioners to terminate Boards of Health, Social Services and Mental Health Boards. Dr. Macris moved from the Executive Committee for the Board to adopt the New Hanover County Board of Health Resolution opposing State Legislation to modify the population limitation of G.S. 153A-77 and requesting that New Hanover County legislators go on record as opposing any legislation which weakens our Public Health system effective April 5, 1995. Upon vote, the MOTION CARRIED . Board of Health Members: smoking Amendment and Smokers Rights I Dr. Macris introduced Mrs. Sandra M. Spradley, Member, Smokers Rights Group to the Board. She requested that the Board of Health renegotiate the New Hanover County Board of Health Smoking Control Regulation (SCR) with representatives from her group. She stated that the Smokers Rights Group prefers to discuss the issue with the Board and would like to avoid court action. Dr. Macris stated he would discuss her request with Dr. Paul, Chairman, Health Promotions Committee. Request for Funds for Environmental Health Specialis.ts TrHininq Mr. Coble reported that the Restaurant Association plans to introduce legislation in the North Carolina General Assembly requesting $500,000 payable to Local Health Departments for additional training for Environmental Health Specialists. Health Director: Board of Health Sponsored Staff Luncheon, April 25, 1995, 12 NOON The Board of Health sponsored Staff Luncheon will be held on April 25, 1995. April is Public Health Month. Guard Care/Health Fair, APril 29 and 30, 1995 I Mr. Parker, Chairman, On Guard For Health (OGFH) Committee, reminded the Board of the "On Guard for Health" Health Fair on April 29 and 30, 1995. Health Fair Sites are the First Baptist Church Activity Center, Trask Middle School and the health department. The fair is sponsored by the North Carolina National Guard. !12 Continuing Education for Boards of Health: Teen Pregnancy The Continuing Education Session for Boards of Health: Teen Pregnancy is to be held on April 11, 1995, 6:30 P.M. - 9:00 P.M., at the Wilmington Hilton, Wilmington, N.C. (Bob) Parker, Health Director New Hanover County Health Department , A REGULATION OF THE NEW HANOVER COUNTY BOARD OF HEALTH The Board of Health of New Hanover County hereby enacts the following amendment to the New Hanover County Smoking Control Regulation initially adopted October 6, 1993: I. Add to Section III, Definitions: Bingo entertainment means a business whose predominant activity is the conducting of bingo games. 2. Add to Section X, Exclusions, a new subsection 5: 5. Bingo entertainment. . 3. Except as herein amended, the Regulations initially adopted October 6, 1993 shall remain in full force and effect. Adopted this fifth day of April, 1995. New Hanover County Board of Health (SEAL) ATTEST: KQ~l()~ It Clerk to the Board I NEW HANOVER COUNTY BOARD OF HEALTH RESOLUTION WHEREAS, the New Hanover County Board of Health is the oldest Board of Health in North Carolina dating back to June 14, 1879; and WHEREAS, the New Hanover County Board of Health has a long and successful tradition of being a leader in Public Health for the past century; and WHEREAS, we would not want any action taken which might jeopardize the future existence of the New Hanover County Board of Health; and WHEREAS, the membership of Boards of Health is required by State Law to include Health Professionals and Representatives of the Public; and WHEREAS, the expertise of the various professions represented on Boards of Health is necessary for making informed public health decisions; and WHEREAS, Boards of County Commissioners do not normally exercise ordinance-making authority applicable to municipalities; and WHEREAS, the public health system in North Carolina has evolved into one of the best programs in the nation because of the strength of local Boards of Health; and WHEREAS, public health decisions are being made which are free from the political pressures of special interest groups; and WHEREAS, complex issues of public health need to be addressed by Boards which deal only with public health; and WHEREAS, the advantages of integrated approaches to Mental Health, Social Services, and Public Health can be, and have been accomplished by collaboration among the respective staffs of these agencies and their boards; and WHEREAS, making it possible, on a statewide basis, for Boards of County Commissioners to summarily and arbitrarily eliminate appointed Boards of Health will do irreparable harm to the entire public health system in North Carolina; NOW THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Health OPPOSES any State Legislation to modify the population limitation of G.S. 153A-77 or any legislation which diminishes the ability of local Boards of Health to protect the health ofthe people of North Carolina; and REQUESTS the Legislative Delegation representing New Hanover County go on record as opposing any legislation which weakens our public health system, especially the reduction or elimination of the population limitation in G.S. 153A-77. , 1995 4/5 /~ { Da~
