2004-04-19 RM Exhibits28.26.6 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, on July 24, 1997 the New Hanover County Sheriff's Office purchased a 1997 MaIm 23 Foot Boat, ill # MRKAT137E797 with 200hp Yamaha motor, serial # 61A-UL-100147, and an EZ Load Float-On Trailer, serial # 1ZEDABRG2VP024919, respective fixed asset numbers 014014, 014015, 014016, to be used as a patrol craft in County waterways; AND WHEREAS, due to acquisition of additional equipment, the boat is no longer needed as a patrol craft for the Sheriff's Office, and is considered surplus, to be removed from service; AND WHEREAS, Wilmington Police Department provides law enforcement and patrol in City waterways and is in need of boat for their duties; , AND WHEREAS, the Sheriff's Office is requesting approval to transfer ownership of the boat, motor, and trailer to the City of Wilmington Police Department pursuant to General Statute 160A-274 with the understanding that the boat, motor, and trailer shall be used exclusively' for law enforcement and patrol in City waterways and that the City of Wilmington Police Department WIll keep, use, and maintain the items for a minimum of two (2) years after receipt of the items; AND WHEREAS, the Sheriff's Office researched the market value for the 1997 Mako 23 Foot Boat, ill # MRKAT137E797 with 200hp Yamaha motor, serial # 61A-UL-100147, and an EZ Load Float-On Trailer, serial # 1ZEDABRG2VP024919, respective fixed asset numbers 014014, 014015, 014016, and the average market value was determined to be thirteen thousand, three hundred sixty dollars ($13,360,00); AND WHEREAS, in lieu of monetary consideration the Sheriff proposes to accept as the full and fair consideration for the value of the boat, motor, and trailer the assurance by the City of Wilmington Police Department that the boat, motor, and trailer shall be used exclusively for law enforcement and patrol in City waterways and that the City ofWilmin~on Police Department will keep, use, and maintain the items for a minimum of two (2) years after receIpt of the items; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that ownership of the 1997 Mako 23 Foot Boat, ill # MRKAT137E797 with 200hp Yamaha motor, serial # 61A-UL-100147, and an EZ Load Float-On Trailer, serial # 1ZEDABRG2VP024919, respective fixed asset numbers 014014, 014015, 014016, be transferred to the City of Wilmington Police Department and in lieu of monetary compensation the County accepts as the full and fair consideration for the value of the boat, motor, and trailer the assurance by the City of Wilmington Police Department that the boat, motor, and trailer shall be used exclusively for law enforcement and patrol in City waterways and that the City of Wilmington Police Department will keep, use, and maintain the items for a minimum of two (2) years after receipt of the items; AND BE IT FURTHER RESOLVED that the County staff is directed to process any required documents to consummate the transaction, ~~4mM "t~\.. \. ~) ~\- Sheila Schult, èlerk to ~ Board 28.26.7 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, after due advertisement, proposals were received for banking services for New Hanover County from the following institutions: Bank of America Wachovia First Citizèns BB&T AND WHEREAS, Bank of America provided the lowest cost for the service; AND WHEREAS, taking into consideration anticipated interest income to offset the bank costs, Bank of America remains the lowest cost for providing services for the contract; AND WHEREAS, staff has evaluated the proposals and has determined that the proposal submitted by Bank of America provides all services required and is the lowest responsive bidder; AND WHEREAS, the Finance Director and the County Manager recommend that the contract for banking services be awarded to Bank of America of Wilmington, North Carolina; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the five year contract for banking services for the County, RFP # 04-0234 be awarded to Bank of America; with an effective date of June 1, 2004; and that the County Manager is hereby authorized and directed to execute the contract, contract form to be approved by the County Attorney.
