Road(s) Description:
Lipscomb Drive, Colquitt Drive, Lambs Court, Colquitt Court
and Pennypacker Court in Lambs Bluff Subdivision
(Div. File No. 1030-N)
WHEREAS, a petition has been filed with the Board of County Commissioners of the County of New
Hanover requesting that the above described road(s), the location of which hàs been indicated on a map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above described road(s)
should be added to the Secondary Road System, if the road(s) meets minimum standards and criteria
established by the Division of Highways of the Department of Transportation for the addition of roads to the
System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New Hanover
that the Division of Highways is hereby requested to review the above described road(s), and to take over the
road(s) for maintenance if they meet established standards and criteria.

WHEREAS, after due advertisement, bids were received and publicly opened by the Finance
Department at 11 :00 a.m., on the 30th day of April, 2004, at the County Administration Building, 320 Chestnut
Street, Wilmington, North Carolina, and the following bids were received for the water treatment program for
the W ASTEC Facility ofthe Environmental Management Department, RFP # 04-0268:

AND WHEREAS, the programs submitted by ChemTreat, Inc. and GE Best do not meet the inert trace
requirement of the RFP specifications and are therefore non-responsive to the County's RFP requirements;
AND WHEREAS, the program submitted by Na1co Company met all requirements of the RFP and
provided the lowest price for the total possible contract period (initial period and renewal period);
AND WHEREAS, the Environmental Management Director, the Finance Director and the County
Manager recommend that the contract be awarded to Nalco Company, the only responsive bidder, with pricing
for contract to be in accordance with the pricing schedules submitted in the proposal;
AND WHEREAS, funds have been previously appropriated and are now in and will be in future years
budget Account No. 700-485-4194-4230 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County that the contract for a water treatment program for the W ASTEC Facility of the Environmental
Management Department, RFP # 04-0268 be awarded to Na1co Company, with pricing for contract to be in
accordance with the pricing schedules submitted in the proposal; and that the County Manager is hereby
authorized and directed to execute the contract, contract form to be approved by the County Attorney.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, New Hanover County has possession of a number of items of personal property
which are surplus to its needs and desires to dispose of same; and
WHEREAS, the items to be disposed of are listed and submitted as an attachment to this
resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover
County that the Finance Director's designated representative, pursuant to the provisions of
G.S. 160A-270, is hereby authorized to dispose of all of the personal property as listed for cash,
check, MasterCard or VISA at an auction, a buyer's premium of twelve percent (12%) of the bid
price will be added to the price of each item purchased, buyers paying in the form of cash or check
will receive a two percent (2%) cash discount, and that said representative be further authorized and
directed to execute necessary documents, transfer title, add items to or delete items from the auction
list, and perform all necessary functions associated with this auction, to be held Saturday,
June 19, 2004 at 9:00 a.m. at the Property Management Maintenance Facility, Division Drive,
Wilmington, North Carolina.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, the management letter prepared by the County's auditing firm contained a
recommendation for the County to have a written procedure for the waiving of Tipping Fees;
AND WHEREAS, as a result, the County staffhave prepared a written Waiver of Tipping Fees
Procedure and an application form and has submitted such procedure and form for review;
AND WHEREAS, the Finan~e Director and the County Manager desire to inform the Board
of Commissioners of actions being taken to act upon any recommendation made in the annual
management letter from the County's auditing firm;
NOW, THEREFORE, BE IT:RESOLVED by the Board of County Commissioners of New
Hanover CoUnty that the Board of Commissioners concur with the actions taken by staff to prepare a
written Waiver of Tipping Fees Procedure and adopt the procedure and application form effective
May 17, 2004.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, the purchase of a bull dozer for the Landfill was approved in the fiscal year 2003/2004
adopted budget as an installment debt purchase with funds for installment debt payments budgeted in account
700-480-4191-5940;
AND WHEREAS, on October 3,2003 the contract for the bull dozer purchase was approved with the
understanding that installment financing was to be done at a later date to reimburse the County for the cost of
the bull dozer; .
AND WHEREAS, a Request for Proposals was sent to local banks requesting rates for installment
financing;
AND WHEREAS, the RFP for the financing specifically required that a prepayment penalty was not
allowed in the financing agreement;
AND WHEREAS, the proposals submitted by Wachovia and BB&T contained a prepayment penalty
of 1 % and therefore their proposals were deemed non-responsive;
AND WHEREAS, the proposal submitted by Bank of America Leasing and Capital Group met all the
requirements and provided a fixed interest rate of2.58%, with no closing costs;
. AN D WHEREAS, staff is requesting approval of Contract # 04-0325, an installment contract with Bank
of America Leasing and Capital Group for the financing of the bull dozer as authorized by North Carolina
General Statute 160A-20;
AND WHEREAS, budget amendment # 04-0206 has been prepared and is recording for accounting
purposes to record and budget the financing proceeds and is submitted for approval as part of this request;
AND WHEREAS, the Finance Director and the County Manager recommend that contract # 04-0325
for installment financing with Bank of America Leasing and Capital Group be approved;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County that contract # 04-0325, an installment financing agreement for the purchase of the bull dozer for the
Landfill, with Bank of America Leasing and Capital Group is approved and the County Manager, the Finance
Director, the County Attorney and their designated staff are hereby authorized and directed to act on behalf of
the County of New Hanover in regard to the execution of Contract # 04-0325 and other actions not inconsistent
with this resolution; and associated Budget Amendment # 04-0206 is approved.

PROCLAAfATION
WHEREAS, daily we see ships sail down the Cape Fear River from the Port of Wilmington to the
countries of the world as they have for centuries, with men and material in the endeavor of this
country to "export rreedom to the world;" and
WHEREAS, the men of the American Merchant Marine have found that freedom is not free, having
given their lives in this endeavor; and I
WHEREAS, the U.S. Congress, in rycognition of the importance of the maritime industry did, by
joint resolution, approve and designate May 22, 1933 and each year thereafter as National Maritime
Day, and authorized and requested the President to issue annually a proclamation calling for its
appropriate observance; and
'WHEREAS, this date of May 22 v:.as chosen to commemorate the day in 1819 when the SS
SAVANNAH departed Savannah, Georgia on the first transatlantic steamship voyage;
NOTv, THEREFORE BE IT PROCLAIMED by the New Hanover County Board of Commissioners
that May 22, 2004 be designated National Maritime Day in New Hanover County, and that citizens
are urged to attend the services honoring those Merchant Mariners who have given all in the endeavor
of "exporting rreedom to the world" at the Maritime Day Festival at the North Carolina State Port
of Wilmington, on Sunday May 23,2004

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION
WHEREAS, portions of property purchased for Ogden Park, particularly the center
section, consist of low quality wetlands that seasonally become totally inundated with
water; and
WHEREAS, the Master Plan for Ogden Park shows no planned use of the center section
of the Park for either active use, such as soccer facilities, or for passive use, such as
nature trails, due to the unsuitable; nature of the wetlands; and
WHEREAS, the County is in need of suitable park lands that can be developed with
recreational facilities; and
WHEREAS, the division of the Ogden Park property will not diminish or alter the
functional use of the park facilities;
NOW, THEREFORE BE IT RESOLVED that the New Hanover County Board of
Commissioners designates the center section of Ogden park as unsuitable for active or
passive park use and available for other uses, including road construction, and dedicates
the use of any funds received from the sale or transfer of property in the center section
of Ogden Park, such as road construction, for the enhancement of suitable parklands or
facilities elsewhere in the County.

PROCLAMATION
WHEREAS, New Hanover County encompasses the beauty and bounty of the North Carolina Coast rivers
and waterways; and
WHEREAS, the rivers and waterways of coastal North Carolina provide one of the prime sources of rewarding
recreation to residents and visitors; and
WHEREAS, safe boating and safe boating education is of vital importance to the many citizens and visitors
of New Hanover County, due to the fact that the majority of boating accidents are caused by human error or
poor judgment and not by boat, equipment, or environmental factors; and
WHEREAS, public education of our citizens regarding safety around water and boating is a joint responsibility
oflocal and state governments, National Safe Boating Council, United States Coast Guard, United States Coast
Guard Auxiliary, United States Power Squadrons, Cape Fear Power Squadron and other groups; and,
WHEREAS, the safe boating educational services of these many groùps need eh.1ensive media coverage and
citizen awareness in order to be more effective; and
TVHEREAS, the Cape Fear Power Squadron, which has supplied 53 years of continuous service in conducting
safe boating classes and vessel safety examinations to recreational boaters, wishes to bring awareness to the
need for safe boating education by supporting Safe Boating Week,

NOW THEREFORE BEIT RESOL J7£,D, that the New Hanover County Board of Commissioners proclaims
the week of May 22-28,2004, CbS Safe Boating Week in New Hanover County, and encourages its citizens and
visitors to become educated regarding safe boating operations as recommended by the Cape Fear Power
Squadron.
