2004-06-07 RM Exhibits28.29.1 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, New Hanover County is a coastal community lying between the Atlantic Ocean, the Cape Fear River, and the Northeast Cape Fear River; AND WHEREAS, coastal communities are subject to be struck by natural disasters including, hurricanes, tornadoes, floods, and ice storms; AND WHEREAS, New ,Hanover County has a recent history of being struck by seven named hurricanes since 1996; AND WHEREAS, the BOard of Commissioners are responsible for the safety and welfare of the citizens of New Iianover County; AND WHEREAS, debris from natural disasters may jeopardize the safety and welfare of the citizens and negatively effect the economy of New Hanover County; AND WHEREAS, the ~ew Hanover County Department of Environmental Management has been delegated the responsibility of solid waste management to include the removal of debris caused by natural disasters; AND WHEREAS, to expedite the recovery from a natural disaster by removing debris in as timely a manner as is feasible, the Department of Environmental Management has requested that a pre-position contract be in place to secure contracted services for debris removal; AND WHEREAS, in accordance with normal purchasing procedures, a Request for Proposals was duly advertised and bids were received and read on Friday, May 21, 2004, for debris removal in the event of a natural disaster; AND WHEREAS, bids were received as follows: Bidder Construction/Demolition Debris Removal $ 8.79/cubic yard $1 0.20/cubic yard $22.95/cubic yard $ 9.65/cubic yard $11.49/cubic yard D&J, Enterprises, Inc. Crowder - Gulf DRC, Inc. Phillips & Jordan, Inc. Ceres Environmental Services Humphrey-Sopar, Inc $17.50/cubic yard Vegetative Debris Removal and Disposal $ 6.69/cubic yard $ 8.50/cubic yard $ 9.95/cubic yard $ 7.18/cubic yard $ 12.49/cubic yard $ 8.85/cubic yard AND WHEREAS, D&J Enterprises, Inc. of Auburn, Alabama is the apparent low bidder; AND WHEREAS, it is the desire of the Board of Commissioners and the Department of Environmental Management to have a pre-position contract in-place to activate in the event that a natural disaster should strike New Hanover County; AND WHEREAS, no funds will be expended for this contractual arrangement until such time as a Notice to Proceed is authorized by the Board of Commissioners in response to a natural disaster. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that pre-position contract Number 04-0324 for the removal of debris caused by a natural disaster be awarded to D&J Enterprises, Inc. of Auburn, Alabama, and that the County is hereby authorized and directed to execute said contract, contract form to be approved by the County Attorney. Greer, Chairman Board of County Commissioners ATTEST: ,-~I?~ ~ Clerk to the Board I' 28.29.2 NEW HANOVER COUNTY BOARD OF COMMISSIONERS PROCLAMATION WHEREAS, the rivers and waterways of coastal North Carolina provide one of the prime sources of rewarding recreation to residents and visitors; and WHEREAS, public education of our citizens and visitors regarding safety around water and boating is ajoint concern of the local governments of New Hanover County, the City of Wilmington and the beach communities of Wright svill e Beach, Carolina Beach and Kure Beach; and WHEREAS, the United States Power Squadron, now celebrating its 90th ariniversary, has earned the respect ofboating men and women throughout the nation for its many civic service contributions to boating safety; and WHEREAS, the volunteer members of Power Squadrons have taught their boating courses and Boat Smart Courses to more than 4 million people to date and are presently teaching more than 40,000 men, women and youngsters each year; and WHEREAS, the Cape Fear Power Squadron founded in 1951 has supplied 53 years of continuous service in conducting safe boating classes and vessel safety examinations to recreational boaters; NOJv, THEREFOREBEIT PROCLAIMED by the New Hanover County Board of Commissioners that June 19, 2004 be declared Cape Fear Power Squadron Day in New Hanover County in commemoration of its 90th Anniversary, and that citizens are invited to join the Gala celebration at Thalian Hall. Schult, Clerk to the Board 28.29.3 NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION OF SUPPORT FOR THE NORTH CAROLINA MUSEUM OF AVIATION WHEREAS the North Carolina Museum of Aviation is establishing a tourism and welcome center into Southeastern North Carolina for international and national aviation visitors; and WHEREAS the historic terminal building which opened in 1952 will be restored and preserved as a part of the state's rich aviation history; and WHEREAS the museum would enhance educational opportunities and tourism in New Hanover County; and WHEREAS the New Hanover County Board of Commissioners supports the development of the North Carolina Museum of Aviation at the Wilmington International Airport, . NOW, THEREFORE BE IT RESOLVED, that the New Hanover County Board of Commissioners does hereby support the request for funding to the North Carolina Department of Transportation for the development of the North Carolina Museum of' Aviation.
