Schult, Clerk to tþ.e Board 29.1.3 NEW HANOVER COUNTY BOARD OF COMMISSIONERS PROCLAMATION WHEREAS, Kiwanis Clubs exist in many countries around the world and are dedicated to community service in their particular area and in sharing ideas and expertise with Clubs in their country as well as those in other countries; and WHEREAS, the first Kiwanis Club was organized on January 21, 1915, and the Kiwanis Club of Azalea City was chartered on July 30, 1964, and has been dedicated to community service in New Hanover County and the surrounding area during the forty years since that time; and WHEREAS, the Kiwanis Club of Azalea City has supported various causes over the years, focused primarily on youth and the elderly, and has given support to the fonner Girls Club in Wilmington, to the Girls and Boys Club in Lake Waccamaw, to Special Olympics, and to Elderhaus; NOW, THEREFORE, BE IT PROCLAIMED, that the New Hanover County Board of Commissioners declares July 22, 2004 as Kiwanis Club of Azalea City Day on the celebration of its 40th anniversary, and thanks the Club for its years of dedicated service to their special projects in New Hanover County and the surrounding area. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: Revise Section 62: Accessory Building / Use ADD 62-2 Retention and detention facilities servinq nonresidential development shall be permitted on contiquous residential tracts abuttinq the development served provided: (1) There is no encroachment of the commercial activity onto the adlacent residential site, and (2) provided the adlacent residential property is in the same ownership as the commercial tract and (3) the residential site is not part of an existinq residential subdivision except in the case of shared stormwater facilities. (4) The stormwater facility shall be setback twice the correspondinq residential minimum side or rear yard measured from the top of slope to the adlacent property line. A minimum 20' bufferyard within the setback shall be provided. (5) The stormwater manaqement facility shall be constructed as an aesthetic amenity with maximum slopes of 5:1. (6) If fencinq of the facility is necessary then it shall not be chain link. Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of such conflict, is hereby repealed. Section 3. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as amended be and the same is hereby further amended as follows: Revise Section 59.6: Special Highway Overlay District ADD 59.6-3(7) Any parcel of land that falls within overlappinq Special Hiqhway Overlay Districts shall be sublect to all of the setback requirements of this section for one of the two desiqnated hiqhways. Setbacks from the riqht of way of the secondary hiqhway frontaqe as determined by the applicant may be reduced by 50%. Section 2. Penalties: (e) If a property owner becomes delinquent on their account for billing of the basic user charges, a late penalty will be assessed on the account equal to 4-:-á 10 percent of the outstanding balance due, with a maximum of Five ($5.00) Dollars. In order to maintain his account in a current status, each owner is given a ten-day grace period from the due date of the bill, for a total of 30 days from the date the bill is mailed, in Wlich to pay the total outstanding balance due.
