HomeMy WebLinkAbout1999-04-06 Water & Sewer NEW HANOVER COUNTY WATER AND SEWER DISTRICTBOOK 2 REGULAR MEETING, APRIL 6, 1999PAGE 493 ASSEMBLY The District Board of Commissioners of the New Hanover County Water and Sewer District met in Regular Session on Tuesday, April 6, 1999, at 9:21 p.m. in the New Hanover County Judicial Building, Courtroom 317, 316 Princess Street, Wilmington, North Carolina. Members present were: District Commissioner Buzz Birzenieks; District Commissioner Ted Davis, Jr.; District Commissioner William A. Caster; Vice-Chairman Charles R. Howell; Chairman Robert G. Greer; County Manager, Allen O’Neal; County Attorney, Wanda M. Copley; and Clerk to the District Board, Lucie F. Harrell. Chairman Greer called the meeting to order. NON-AGENDA ITEMS Chairman Greer announced that time had been reserved to allow the public to present an item that was not listed on the Regular Agenda. He requested all persons speaking to limit their remarks to three minutes. No public items were presented. APPROVAL OF MINUTES Motion: District Commissioner Caster MOVED, SECONDED by District Commissioner Birzenieks to approve the minutes of the Regular Meeting of March 8, 1999, as presented by the Clerk to the District. Upon vote, the MOTION CARRIED UNANIMOUSLY. APPROVAL OF REIMBURSEMENT CONTRACT #99-0215 WITH RAIFORD G. TRASK, JR. FOR CONSTRUCTING SEWER GRAVITY LINE County Engineer, Wyatt Blanchard, reported that Mr. Raiford G. Trask, Jr. constructed 5,600 feet of a 10-inch sewer gravity line that will serve approximately 426 acres along Military Cut-Off Road. In accordance with the reimbursement contract between the District and Mr. Trask, development utilizing the sewer line will reimburse Mr. Trask $645.54 per acre. This figure is based on a total construction cost of $275,000 with the sewer line serving 426 total acres. New Hanover County owns 5.37 acres of land; therefore, the District is responsible for reimbursing Mr. Trask $3,367. All other reimbursements to Mr. Trask, other than the County’s reimbursement, will be from future development utilizing the line. All reimbursements will be made through the New Hanover County Water and Sewer District. District Commissioner Davis stated as he understands the request, Mr. Trask paid the total construction cost of $275,000; therefore, any one using a portion of the 426 acres will have to reimburse Mr. Trask. Since the County is going to use 5.37 acres of the land, the District owes Mr. Trask $3,367. In the future, any person using a portion of the land will have to reimburse Mr. Trask. District Commissioner Davis asked County Engineer Blanchard if this statement was correct. District Commissioner Davis requested an explanation of why all future reimbursements would be collected through the Water and Sewer District. County Engineer Blanchard responded when property is developed, the developer must go through New Hanover County and the Water and Sewer District. The reimbursement contract requires the person utilizing the line to reimburse their proportionate share over a period of 15 years. After 15 years, if no additional property is developed, Mr. Trask will not receive any reimbursement for use of the line. Deputy County Manager Atkinson explained that under this arrangement, the developer can build a sewer line at no cost to the Water and Sewer District. Chairman Greer said that he did not have a problem with approving the reimbursement contract; however, in the future, the Water and Sewer District Board should be aware of this type of an arrangement before the line is actually constructed. He also expressed concern for allowing persons 15 years to reimburse the District. County Engineer Blanchard stated the Sewer Ordinance could be amended to allow a shorter time for reimbursement. Vice-Chairman Howell asked if the term of payment was reduced to 10 years, would it discourage developers from constructing sewer lines. County Engineer Blanchard said he did not feel that reducing the term of payment from 15 to 10 years would keep developers from constructing sewer lines. After further discussion of the payment term, the District Board agreed to address this item at a future date. Motion: District Commissioner Caster MOVED, SECONDED by Vice-Chairman Howell to approve Contract #99-0215 between the New Hanover County Water and Sewer District and Raiford G. Trask, Jr. to reimburse him $3,467 for the 5.37 acres of land owned by New Hanover County. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the contract is on file in the Legal Department. APPROVAL OF BUDGET AMENDMENT #99-37 County Engineer, Wyatt Blanchard, requested the Board to approve a budget amendment to adjust the budget to the final quantities for the National Guard Water Line and for Old Military Cut- Off Road. County Engineer Blanchard said the water line runs from the existing City Limit along Kerr Avenue across Smith Creek up to the entrance of the Airport off Kerr Avenue into the east side of the Airport. After numerous discussions with the City, the National Guard was allowed to construct the line. Chairman Greer asked if the District was supplying the water. County Engineer Blanchard responded the water would be supplied by the City. Motion: District Commissioner Birzenieks MOVED, SECONDED by District Commissioner Caster to approve the following Budget Amendment. Upon vote, the MOTION CARRIED UNANIMOUSLY. Budget Amendment #99-37 - Water/Sewer District-General Sewer Capital Projects DebitCredit Water/Sewer District Appropriated Fund Balance $27,005 Transfer to Sewer Capital Projects$27,005 General Sewer Capital Projects Transfer in from Fund 800 $27,005 Capital Project Expense $27,005 ADDITIONAL ITEM Award of Contract #99-0302 to Skipper Well Drilling for Construction of the Ogden Well County Engineer, Wyatt Blanchard, requested the District Board to award a contract to Skipper Well Drilling, the lowest bidder, in the amount of $84,970 to construct the well at the Ogden Water Tower. He reported that three quotes were received for furnishing the equipment and materials for the project: Skipper Well Drilling$84,970 F&F Construction Company$92,000 Meadows Well Drilling$95,000 In closing, County Engineer Blanchard noted that the proposed budget amendment was in the amount of $95,000 to establish a small contingency in case of unexpected problems. Upon vote, the MOTION CARRIED UNANIMOUSLY.
