2002-02-04 RM Exhibits27.15.1 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, after due advertisement, bids were received and publicly opened by the Finance Department at 3:00 p.m., on the 17th day of October, 2001, at the County Administration Building, 320 Chestnut Street, Wilmington, North Carolina, and the following bids were received for a Medical Records Project for the Health Department, Bid # 02-0089: Patterson Business Systems (Option I) Patterson Business Systems (Option 2) $106,371.00 $131,371.00 $120,824.05 JE Pope Company AND WHEREAS, the bid specified that quantities may be added or deleted and adding and deleting quantities of items to the Patterson Business Systems proposal, Option 1, resulted in a final contract price of one hundred seven thousand nine hundred twenty-one ($107,921.00) dollars; AND WHEREAS, the Health Director, the Finance Director, and the County Manager recommend that the contract be awarded to Patterson Business Systems, the lowest responsible bidder, in the amount of one hundred seven thousand, nine hundred twenty-one ($107,921.00) dollars; AND WHEREAS, funds have been previously appropriated and are now in Account Numbers 110-510-5151-2000-3700,4210, 6399, 6400 to cover this contract; . , . NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the contract for a Medical Records Project for the Health Department, Bid # 02- 0089 be awarded to Patterson Business Systems in the amount of one hundred seven thousand, nine hundred twenty-one ($107,921.00) dollars; and that the County Manager is hereby authorized and directed to execute the contract, contract form to be approved by the County Attorney. ' Chairman, Boa of County Commissioners ATTEST: . , / r;;{¿.. ¿~ if ~~ 'Ci~he Board \ } 27.15.2 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, the radio equipment to be used with the Motorola SmartNet 800 MHZ trunking radio system used by the County is unique to and can only be obtained from Motorola, Inc.; AND WHEREAS, General Statute 143-129(f) allows an exemption from formal bidding for purchase contracts when a needed product is available from only one source of supply; AND WHEREAS, the staff established a term contract with Motorola, Inc., contract # 97 -0205, as a convenience contract for the County to be available to the County as needed to purchase radios; AND WHEREAS, contract # 97 -0205 was renewed in April 1999 and April 200 1 upon the same terms and conditions except the pricing component was updated and now it is time for the contract to be renewed again; AND WHEREAS, the renewal of contract # 97-0205 does not require any purchases; it is a term contract for the County's use when and if radio purchases are needed; AND WHEREAS, many state and local entities are on similar term contracts with Motorola, Motorola requires all contracts to be on a calendar year; AND WHEREAS, contract provisions of contract # 97-0205 would remain the same except the pricing component would be updated with a current pricing proposal from Motorola and the term would extend through December 31, 2002; AND WHEREAS, the Emergency Management Director, the Finance Director, and the County Manager recommend that the contract be renewed with Motorola, Inc., the sole source for this equipment; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the contract # 97-0205 for radio equipment, be awarded to Motorola, Inc.; and that the County Manager is hereby authorized and directed to execute the contract, contract form to be approved by the County Attorney. Fixed Asset # 016448 Fixed Asset # 016447 Fixed Asset # 016449 Fixed Asset # 016446 Fixed Asset # 016445 AND WHEREAS, Carolina Coast Harley Davidson has proposed to exchange with the County six (6) new 2002 Harley Davidson FLHPI motorcycles for the County's existing 2000 model Harley Davidson FLHPI motorcycles with a three hundred ($300.00) dollar fee per motorcycle to change out existing equipment on each motorcycle; AND WHEREAS, budget amendments have been completed to provide for proper accounting of the transaction, increasing revenues and expenses by eighty-six thousand ten ($86,010.00) dollars to provide for the processing of the transaction; AND WHEREAS, pursuant to General Statute 160A -271, the County Board of Commissioners is authorized to approve such exchange; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New. Hanover County that the six (6) 2000 Harley Davidson FLHPI motorcycles be exchanged for the six (6) 2002 Harley Davidson FLHPI motorcycles with a three hundred ($300.00) dollar fee per motorcycle to change out existing equipment on each motorcycle and that the County staff is directed to process any required documents to consummate the transaction and approve related budget amendments. (SEAL) ~iQ,~oŒ¡ County Commissioners 27.15.4 RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, G.S. 143-129 allows local governments to buy off of another government's contract if the vendor is willing to provide the item at the same or better price; AND WHEREAS, Manatee County, Florida formally bid a lighting system and awarded the bid to Musco Lighting, Inc. and written notification of award by the County of Manatee toMusco Lighting, Inc. was made on May 15,2001; AND WHEREAS, funds have been previously approved to purchase a lighting system by the Parks Department for Hugh MacRae Park and Musco Lighting, Inc. has offered to extend to New Hanover County better unit pricing than the unit pricing provided to Manatee County to purchase the equipment needed, detailed as follows: Eight (8) 60' poles with three (3) fixtures Eight (8) 60' poles with seven (7) fixtures Control Link Standing Pole Price Sixteen (16) Poles $29,400.00 . $68,600.00 $4,728.00 $12,000.00 $114,728.00 Total (to be purchased based on existing contract with manatee County, Florida) AND WHEREAS, the Parks Director, the Finance Director and the County Manager recommend that contract # 02-0247 be awarded to Musco Lighting, Inc. based on the unit prices as contained in the Manatee County, Florida contract, in the amount of one hundred fourteen thousand, seven hundred twenty-eight dollars . ($114,728.00); AND WHEREAS, funds have been previously appropriated and are now in Account No. 110-612-6120-6300 to cover this contract; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the contract for a lighting system for Hugh MacRae Park for the Parks Department, contract # 02-0247 be awarded to Musco Lighting, Inc. in the amount of one hundred fourteen thousand, seven hundred twenty-eight dollars ($114,728.00); and that the County Manager is hereby authorized and directed to execute the contract, contract form to be approved by the County Attorney. Ted Davis, Jr., \~rman 27.15.8 AN ORDINANCE OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS The Board of Commissioners of New Hanover County, North Carolina, does hereby ordain that Chapter 5, Animals, Article I, of the New Hanover County Code be amended as follows: (1) Add a new section to be designated: Section 5-25. Dogs Prohibited on Mason Inlet Beach and Public Riparian Property at Certain Times, Places. No person shall allow a dog on the public beach of the Atlantic Ocean or other public riparian property within any portion of the unincorporated County situated on Wrightsville Beach Island north of the Town boundary lines, whether on a leash or not, at any time between the dates of April 1 and September 20 of each year. (2) Add a new section to be designated: Section 5-26. Dogs Running At-Large Prohibited at Mason Inlet Beach and Public Riparian Property. It shall be unlawful for the owner of a dog to allow the animal to be off the premises of his owner and not on a leash within any portion of the unincorporated County situated on Wrightsville Beach Island north of the Town boundary lines. Except as specified referenced herein, the existing provisions of Chapter 5 shall remain in full force and effect. This the 4th day of February, 2002.
