RESOLUTION
OF
THE NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, Senate Bill I 005 Discretionary Funds are available for use in our County by
the North Carolina Department of Transportation for certain highway improvement
projects; and
WHEREAS, River Road (SRI I 00) south of Shipyard Boulevard would benefit from
widening and strengthening;
THEREFORE, the New Hanover County Board of Commissioners supports the widening
and strengthening of River Road south of Shipyard Boulevard and encourages the North
Carolina Department of Transportation to undertake this project.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, the New Hanover County IT Department replaced the Library's computer
system server through a state contract purchase;
AND WHEREAS, the vendor, Eastern Technologies, is offering a trade-in allowance on the
old server in the amount of two thousand, two hundred dollars ($2,200.00);
AND WHEREAS, the replaced server is an IBM Server RS/6000, Model # 7025-F40,
Serial # 26-05760 and is insufficient for the Library's operation and is considered surplus equipment;
AND WHEREAS, the IT Director, the Finance Director and the County Manager
recommend disposing of the IBM Server RS/6000, Model # 7025-F40, Serial # 26-05760 as a trade-
in on the purchase of the new server purchased through state contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the IBM Server RS/6000, Model # 7025-F40, Serial # 26-05760 be sold by the
Finance Office as a trade-in on the purchase of the new server from Eastern Technologies and that
the County Manager be authorized to sign all related documents associated with this transaction..

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
PROCLAMATION
WHEREAS, sea power is critical to a strong United States of America and global peace; and
WHEREAS, the Navy League ofthe United States was founded in 1902 with the encouragement of
President Theodore Roosevelt as a civilian organization whose mission was to champion the sea
services of the U.S. Navy, Marine Corps, Coast Guard and the u.s. Flag Merchant Marine; and
WHEREAS, the Navy League of the United States, through its 330 councils and 74,000 active
members, is proud to serve, support and provide assistance to active duty service personnel and their
families through adoption of ships, installations and units, as well as commissioning ceremonies,
award programs and other recognition programs; and
WHEREAS, the Navy League supports America's young people through its youth programs such as
the U.S. Naval Sea Cadet Corps, the Navy League Scholarship Program, the Samuel Eliot Morison
Essay Contest, and council-supported local youth programs such as NJROTC, MCJROTC, and ROTC;
and
WHEREAS, the Navy League is dedicated to the education of our citizens; including our elected
officials, the media, community and industrial leaders, and other public authorities about the value of
strong sea services;
NOW, THEREFORE BE IT PROCLAIMED that the New Hanover County Board of
Commissioners declares the year 2002 to be "Navy League ofthe United States Centennial Year"
and urge all citizens to recognize it as such.

RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, the North Carolina General Statutes authorize use of special assessments for
the construction of public utilities; and
WHEREAS, the Board of County Commissioners on the 16th day of August, 1999, adopted
an assessment resolution providing for construction of a public water and sewer project to service
parcels in the Wilmington Beach and Hanby Beach areas of New Hanover County; and
WHEREAS, the project funded by special assessments was publicly bid and construction.
undertaken; and
WHEREAS, the project is now complete to such an extent that final project cost can be
determined; and
NOW, THEREFORE, BE IT RESOLVED, by the New Hanover County Board of
Commissioners, pursuant to General Statute 153A-193, that total project costs are Five Million Two
Hundred Fifty~Six Thousand One Hundred Sixty-Nine ($5,256,169.00) Dollars. Staff is directed
pursuant to General Statute 153A-194, to prepare the Prelìminary Assessment Roll for review and
confirmation at a public hearing to be scheduled for June 3, 2002 during the regular Board of County
Commissioners meeting.

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that Chapter 47, Streets, Sidewalks and Other Public Places, Article IV, House
Numbers, Procedures and Display of Official Numbers, of the New Hanover County Code
be'amended as follows:
Add a new section to be designated:
Section 47-1 09. Enforcement.
(1) Civil Penalty.
Any person who is found in violation of this Article shall be subject to a civil penalty
in the amount of One Hundred Fifty ($150.00) Dollars for each offense, to be issued
by either the Fire Services Department, Sheriff's Department, Code Enforcement
. Officer or Planning Department. Each violation shall be treated as a separate offense.
(2) Other Remedies.
In addition to any other available legal remedies, equitable remedies may enforce this
Article and any unlawful condition existing in violation of this Article may be subject
to an injunction or order of abatement.
Except as specified referenced herein, the existing provisions of Chapter 47 shall remain in
full force and effect. .

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that Chapter 56, Utilities, Article III, Sewer System, Division 9, Fee Schedule and
Appendix B, Division 9, Fee Schedule are amended as follows (the changes amend both
the Chapter 56, Fee Schedule, as well as the corresponding Appendix B, Fee Schedule):
I. Chapter 56, Division 9. Fee Schedule.
Section 56-315(a). Specific Fees.
(a) Sewer service connection fees (tap fees).
(1) Whenever the district constructs sewer collection lines into a new
service area, all development is required to connect to the sewer
within six months of the initial availability of the sewer system.
(2) All development shall pay tap fees as contained in appendix B.
Except as specified referenced herein, the existing provisions of the Chapter 56,
Division 9, Fee Schedule shall remain unaltered, in full force and effect.
II. Appendix B, Division 9. Fee Schedule.
Section 56-315(a) Residential and nonresidential tap fees:
§ 56-315(a). Tap fees for a lot on which is situated a structure requiring waste
disposal wherein New Hanover County installs the tap:

A user may install a tap with New Hanover County Engineering approval upon first

Section 1. That the Subdivision Regulations of the County of New Hanover, North Carolina
adopted October 18, 1965, as amended be and the same is hereby further amended as follows:

of such conflict, is hereby repealed.

Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as
amended be and the same is hereby further amended as follows:

APPROVAL TO AMEND THE REVOLVING LOAN PROGRAM FOR WATER AND SEWER
CONNECTIONS AND PLUMBING IMPROVEMENTS
Community Development Planner Wanda Coston reported that currently the County has two different
programs that provide financial assistance to eligible very low, low, and moderate income persons to assist with the
costs associated with sewer connections and/or related sewer plumbing improvements. Neither of these programs
j presently allow for funds to be used when connecting to an available water system and staff is requesting that this
deficiency be corrected.
Community Development Block Grant funds are currently being used to construct a sewer system in a
portion of the Castle Hayne area and also being used to provide no interest loans, to low and moderate income
persons, to assist them with the costs associated with connecting their homes to the sewer system with tape fees
being waived. The City of Wilmington is also in the process of constructing a water system in the area which can
provide water service to the affected households on Holly Shelter Road. The construction will require relocation of
existing wells. Since many of these households will likely be eligible for sewer loans, staff is proposing that
financial assistance be made available to connect eligible homes to the City's water system as opposed to relocating
the wells. The same criteria being used to determine eligibility for financial assistance in the current program would
be used to determine eligibility for assistance with water connections. I

Motion: Commissioner Pritchett MOVED, SECONDED by Commissioner Boseman, to amend the County sewer
revolving loan program and the Castle Hayne sewer revolving loan program to allow financial assistance to be made
available for connecting to either the City of Wilmington or County water systems using Community Development
Block Grant funds or other applicable funds as presented with General fund monies allocated in an amount not to
exceed $20,000. Upon vote, the MOTION CARRIED UNANIMOUSLY.
