WHEREAS, a petition has beenjìledwith the Board of County Commissioners of the County of New
Hanover requesting that the above described road(s), the location of which has been indicated on a map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above described road(s)
should be added to the Secondary Road System, if the road(s) meets minimum standards and criteria
established by the Division of Highways of the Department ofTransportationfor the addition of roads to the
System.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of New 'Hanover
that the Division of Highways is hereby requested to review the above described road(s), and to take over the
road(s) for maintenance if they meet established standards and criteria.

NEW HANOVER COUNTY
WHEREAS, G .S. 143-129(g) allows lóéâÍ governments to buy off of another government's contract if the
vendor is willing to provide the item at the same or better price;
AND WHEREAS, the City of Carson, Nevada awarded a purchase contract to Pierce Manufacturing, Inc.
for the purchase of a fire truck on February 19,2004 in the amount of one hundred ninety-nine thousand five
hundred ($199,500.00) dollars to secure the fire truck;
AND WHEREAS, Pierce Manufacturing, Inc. has agreed to extend the same pricing to New Hanover
County and to delete unit options that are not needed, bringing New Hanover County's total purchase price to one
hundred sixty thousand ($160,000.00) dollars;
AND WHEREAS, the unit wiII take nine months for construction and delivery and the intention is to
purchase this unit through installment financing with financing being secured closer to the time of the receipt of
the unit;
AND WHEREAS, the financing agreement for the installment purchase and associated budget
amendments will be presented to the Board for approval at a later date in conjunction with the finalization of
pricing for all County debt service items scheduled for installment debt purchase for this current fiscal year;
AND WHEREAS; pursuant to the requirements of the United States Treasury Regulations Section 1.1.03-
8, the County hereby declares its official intent to reimburse itself with the proceeds ofthe financing for any of the
expenditures incurred by it prior to the issuance of the financing;
AND WHEREAS, if sufficient funds are available at the time of delivery, the Fire Services may choose
to purch~se the fire truck through available County funds and not finance the purchase;
AND WHEREAS, Fire Services has received $80,000.00 in grant funds to purchase a mobile air system
to be mounted to one of the fire trucks and the Fire Chief has recommended that two trucks at the 421 Station be
replaced with one new truck with the mobile air system to be purchased and mounted to the new fire truck when
delivered;
AND WHEREAS, the New Hanover County Fire Commission, on September 20,2004, approved the Fire
Chief s recommendation and now recommends to the Board of Commissioners that two trucks at the 421 Station
be replaced with the purchase of a new fire truck from Pierce Manufacturing in an amount not to exceed
$160,000.00 after the grant contribution; this includes the liquidation of Rescue R51 and Cargo Truck with the
proceeds being returned to the apparatus replacement fund within the Fire District;
AND WHEREAS, the Fire Chief, the Finance Director and the County Manager recommend that contract
# 05-0113 be awarded to Pierce Manufacturing, Inc. in the amount of one hundred sixty thousand ($160,000.00)
dollars;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County that the contract # 05-0113 for the purchase of a fire truck for the 421 Fire Station be awarded to Pierce
Manufacturing, Inc. in the amount of one hundred sixty thousand ($160,000.00) dollars; and that the County
Manager is hereby authorized and directed to execute contract # 05-0113, contract form to be approved by the
County Attorney.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, G.S. 143-129(g) allows local governments to buy off of another government's
contract if the vendor is willing to provide the item at the same or better price;
AND WHEREAS, the Town of Norwood, Massachusetts awarded a purchase contract to the
regional E-One, Inc. authorized dealer for the purchase of a fire truck with purchase order being issued
on April 8, 2004 in the amount of three hundred eighty-seven thousand five hundred forty-eight
($387,548.00) dollars to secure the fire truck;
AND WHEREAS, E-One, Inc. has agreed to extend the same pricing to New Hanover County
through the regional E-One, Inc. authorized dealer, C. W. Williams & Co., Inc.;
AND WHEREAS, sufficient funds are available in the Fire Services Administrative Reserve to
pay for the Fire Truck;
AND WHEREAS, the New Hanover County Fire Commission, on September 20,2004, approved
a recommendation to the Board of Commissioners to replace Engine 399 at Myrtle Grove Fire Station
with the E-One Engine in an amount not to exceed $400,000.00 and, additionally recommends that
Engine 399 be sold with the proceeds going to supply equipment for the new E-One fire truck or being
returned to the apparatus replacement fund within the Fire District;
AND WHEREAS, by adoption of this resolution, Budget Amendment # 05-0055 attached and
considered part of this resolution, funds will be appropriated into account # 130-436-4340-3000-6450
for the purchase of the E-One fire truck in the amount of three hundred eighty-seven thousand five
hundred forty-eight ($387,548.00) dollars;
AND WHEREAS, the Fire Chief, the Finance Director and the County Manager recommend that
contract # 05-0114 be awarded to C. W. Williams & Co., Inc., E-One, Inco's designated area
representative, in the amount of three hundred eighty-seven thousand five hundred forty-eight
($387,548.00) dollars;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the contract # 05-0114 for the purchase of a fire truck for the Myrtle Grove Fire
Station be awarded to C. W. Williams & Co., Inc., E-One, Inco's designated area representative, in the
amount of three hundred eighty-seven thousand five hundred forty-eight ($387,548.00) dollars; and that
Budget Amendment # 05-0055 is approved; and that the County Manager is hereby authorized and
directed to execute contract # 05-0114, contract form to be approved by the County Attorney.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
PROCLAMA TION
DOMESTIC VIOLENCE PREVENTION
WHEREAS, domestic violence transcends all ethnic, racial and socioeconomic boundaries, weakening
the very core of our community; and
WHEREAS, the effects of domestic violence are far-reaching, forcing battered women and their children
to seek safe shelter, law enforcement prosecutors to expend valuable resources and families and friends to
grieve at the loss of life; and
WHEREAS, 1,116 adults and children sought safe shelter or counseling at the Wilmington Domestic
Violence Shelter and Services in the year 2003; and
WHEREAS, the Wilmington Domestic Violence Shelter and Services, Inc, works toward the elimination
of violence and oppression against women and their children and provides emergency support and
services for victims and survivors of domestic abuse; and
WHEREAS, on Wednesday, September 4,2002, Gladys Bryant, an employee of New Hanover County
for more than two decades was killed in an act of domestic violence exhibiting to all her coworkers and
friends, the prevalence of domestic violence and its consequences; and
WHEREAS, many other women throughout New Hanover County and the United States find themselves
in abusive relationships and need to find security and an end to their physical and mental attacks;
NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners
refuses to tolerate domestic violence in any form and wishes to create a society that promotes strong
values, fosters a safe and loving home environment for every family, and encourages our citizens to
redouble their efforts to obliterate the problem of domestic violence from our families, our neighborhoods
and our community.
BE IT FURTHER RESOLVED, that the New Hanover County Board of Commissioners proclaims
October 2004, Domestic Violence Awareness Month in New Hanover County,
Adopted this, the 4th day of October 2004.

Whereas, New Hanover County Fire Departments respond to more than 5,099 calls a year; and
Wltereas, home fires claimed more than 2,600 lives in the U.S. in 2002, and 79 percent offire deaths
nationwide happen in the home; and
Whereas, New Hanover County recognizes the significant personal and economic toll fire takes on
its citizens and understands that safety measu,res can significantly cut the risk of fire; and
WItereas, a fire can spread rapidly and a quick escape from the home increases the chances of
survival; and
WItereas, smoke alarms have been proven an effective lifesaver, having helped to cut the home fire
death rate by one half since their introduction to the general public, and working smoke alarms are
essential in every household and should be installed on every level of a home including the basement
and outside of each separate sleeping area; and
WItereas, New Hanover County is joining the National Fire Protection Association (NFPA) in
reaching out to its citizens with a message of fire safety during Fire Prevention Week 2004; and
Whereas, the Fire Prevention Week 2004 theme, "It's Fire Prevention Week: Test Your Smoke
Alarms" is an important message for all citizens of New Hanover County;
Now, Therefore, Be It Resolved, that the New Hanover County Board of Commissioners does
hereby proclaim the week of October 3-9,2004, as Fire Prevention Week, calls upon the people of
New Hanover County to remember the Fire Prevention Week 2004 reminder, "It's Fire Prevention
Week: Test Your Smoke Alanns" and urges all citizens to heed the advice to install and maintain
smoke alarms,

RESOLUTION TO ADOPT THE NEW HANOVER COUNTY
MULTI-JURISDICTIONAL HAZARD MITIGATION PLAN
WHEREAS, New Hanover County is vulnerable to an array of natural hazards that can cause loss
of life and damages to public and private property; and
WHEREAS, the County desires to seek ways to mitigate situations that may aggravate such
circumstances; and
,
WHEREAS, the development and implementation of a hazard mitigation plan can result III
actions that reduce the long-term risk to life and property from natural hazards; and
WHEREAS, it is the intent of the Board of Commissioners to protect its citizens and property
from the effects of natural hazards by preparing and maintaining a local hazard mitigation plan;
and
WHEREAS, it is also the intent of the Board of Commissioners to fulfill its obligation under
North Carolina General Statutes, Chapter 166A: North Carolina Emergency Management Act and
Section 322: Mitigation Planning, of the Robert T, Stafford Disaster Relief and Emergency
Assistance Act to remain eligible to receive state and federal assistance in the event of a declared
disaster affecting the County; and
WHEREAS, New Hanover County has prepared a multi-jurisdictional hazard mitigation plan
with input from the appropriate local and state officials;
WHEREAS, the North Carolina Division of Emergency Management has reviewed the hazard
mitigation plan prepared for New Hanover County for legislative compliance and has approved
the plan pending the completion of local adoption procedures;
NOW, THEREFORE, BE IT RESOLVED that the Board of Commissioners of New Hanover
County hereby:
1. Adopts the New Hanover County Multi-jurisdictional Hazard Mitigation Plan; and
2. Agrees to take such other official action as may be reasonably necessary to carry out
the proposed actions of the Plan.

Resolution of Intent to
Close a Portion of Pine Avenue
Porters Neck Community
Whereas, a petition has been filed pursuant to NCGS 153-A-241, requesting the
Board of Commissioners of New Hanover County to close the following described
portion of Pine Avenue:
Beginning at a point in the western line of Pine Avenue (20.0' right of way) as shown on
a map of Santa Maria, recorded in Map Book 4 at Page 28 of the New Hanover County
Registry, Said point of beginning being located South 36 degrees 51 minutes 59 seconds
East - 214,86', as measured along said right of way line, fÌom the point of intersection of
said right of way extended to the north with the center line of Santa Maria Avenue (30.0'
right of way) which is located South 53 degrees 13 minutes 44 seconds East -1522,66',
as measured along said center line, from the point of intersection of said center line with
the center line of Oak· Avenue as shown on the afore mentioned map, Running thence
from said point of beginning with the southern right of way line of an existing 30.0' wide
easement, as shown on a map recorded in Map Book 34 at Page 103 of New Hanover
County Registry, South 53 degrees 17 minutes 35 seconds East - 20.00' to a point in the
eastern right of way line of Pine Avenue; thence with the eastern right of way line of Pine
Avenue South 36 degrees 51 minutes 59 seconds West - 250,51' to a point in the Mean
High WaterLine of Pages' Creek' thence with the Mean High Water Line of Pages Creek
North 60 degrees 52 minutes 21 seconds West - 11.19' to a point; thence continuing with
the Mean High Water Line North 86 degrees 15 minutes 05 seconds West - 10,64' to a
point; thence with the western right of way line of Pine Avenue, North 36 degrees 51
minutes 59 seconds East - 257,77' to the point of beginning, containing .116 acres more
or less and being the southern portion of Pine Avenue, '
Now Therefore, be it resolved that this Board is considering closing a portion of
Pine Avenue to public use and that a public hearing on this question will be held on the
8th day of November, 2004 at 5:30 p,m. in the Assembly Room of the Old County
Courthouse at 24 North Third Street in Wilmington at which time the Board will hear all
interested citizens and make a final determination as to whether the road shall be closed.
