RESOLVED, that pursuant to the requirements of Chapter 109 of the North
Carolina General Statutes, the Board of Commissioners of New Hanover County, at its
regular meeting on December 3, 2001, approved the bonds of the Clerk of Superior
Court of New Hanover County, New Hanover County Finance Officer, New Hanover
County Sheriff, Register of Deeds of New Hanover County, and New Hanover County
Tax Collector and FURTHER RESOLVED, the Chairman of the Board of
Commissioners is hereby authorized, empowered and directed to certify said approval
of such Bonds, with the exception of the Bond of the Clerk of Superior Court, which is
not physically present in New Hanover County.

of North Carolina have designated the North Carolina Department of Transportation (NCDOT) as
the agency responsible for administering federal and state public transportation funds; and'
WHEREAS, the North Carolina Department of Transportation will apply for a grant from the US
Department of Transportation, Federal Transit Administration and receives funds from the North
Carolina General Assembly to provide assistance for rural public transportation projects; and
WHEREAS, the purpose of these transportation funds is to provide grant monies to local agencies
for the provision of rural public transportation services consistent with the policy requirements for
planning, community and agency involvement, service design, service alternatives, training and

WHEREAS, after due advertisement for Request for Qualifications, the following companies
submitted qualification proposals for the Orthophoto Mapping Project for the County,
RFQ # 02-0138:
Aero-Dynamics, Corp., Charlotte, NC
Kucera International, Inc., Willoughby, OH
L. Robert Kimball & Associates, Ebensburg, P A
AND WHEREAS, pursuant to Section 143-64.31 of the General Statutes of North Carolina,
the County announced our requirements for an orthophoto project and received proposals from firms
qualÍfied to provide such services;
AND WHEREAS, a review committee consisting of the Information Technology Director,
Planning Director, the GIS Manager, and the GIS Assistant conducted an evaluation process and
determined Aero-Dynamics, Corp. of Charlotte, North Carolina as the best qualified firm for the
orthophoto mapping project;
AND WHEREAS, pursuant to Section 143"'64.31 of the General Statutes of North Carolina,
the review committee has negotiated a contract fee with Aero- Dynamics, Corp. of Charlotte, North
Carolina, in an amount not to exceed two hundred eighty-one thousand three hundred ninety dollars
($281,390.00);
AND WHEREAS, the Administrator of the North Carolina Wireless 911 Board has reviewed
RFQ # 02-0138 for the orthophoto mapping project and determined that wireless 911 funds can be
used to fund the project because the mapping is necessary in order to comply with FCC Report &
Order 94-102 PSAP Requirements of being capable to receive and utilize location data;
AND WHEREAS, a project ordinance has been prepared for the orthophoto project and is
being submitted for approval as part of this agenda item;
AND WHEREAS, budget amendment # 2002-21 has been prepared utilizing funds from the
wireless 911 fund to establish a budget and appropriate funds in account 343-431-3430-7300-6000
for orthophoto project in accordance with the capital project ordinance;
AND WHEREAS, the Planning Director, the Information Technology Director, the Finance
Director and the County Manager recommend that the contract be awarded to Aero- Dynamics, Corp.

óf Charlotte, North Carolina, the firm determined by the evaluation committee to be the best
qualified firm for the project, in a fair and reasonable fee not to exceed two hundred eighty-one
thousand three hundred ninety dollars ($281,390.00);
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
HanOver County that the project ordinance for the orthophoto mapping project is adopted and
approved, budget amendment # 2002-21 is approved, and contract # 02-0138 for the orthophoto
mapping project for County is awarded to Aero-Dynamics, Corp. of Charlotte, North Carolina in
an amount not to exceed two hundred eighty-one thousand three hundred ninety dollars
($281,390.00); and that the County Manager is hereby authorized and directed to execute the

BE IT ORDAINED, by the Board of Commissioners of New Hanover

1. New Hanover County (County) is engaged in the Orthophoto
Project, which capital project involves the construction and/or
acquisition of capital assets.
2. County desires to authorize and budget for said project
in a project ordinance adopted pursuant to North Carolina General
Statute $159-13.2, such ordinance to authorize all appropriations
necessary for the completion of said project.
NOW, THEREFORE, WITNESSETH THAT:
1. This project ordinance is adopted pursuant to North
Carolina General Statute $159-13.2.

BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that Chapter 26, Fire Protection and Prevention of the New Hanover County Code
be amended as follows:
A. Section 26-33. Duties of the Fire Marshal.
Add a new subsection:
(4) Formulate a fee schedule for approval by the County Manager
B. Section 26-35. Enforcement and Penalties.
Add a new subsection:
(4) The Fire Marshal may issue a citation which subjects the offender to a civil
penalty of $35.00 for parking in a designated fire lane.
Except as specified referenced herein, the existing provisions of Chapter26 shall
remain in full force and effect.

A RESOLUTION
OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
AUTHORIZING AN AMENDMENT TO LEASE AGREEMENT
RELATING TO THE COASTLINE CONVENTION CENTER
The Board of Commissioners of New Hanover County, does hereby resolve as
follows:
WHEREAS, since 1988 New Hanover County and' the City of Wilmington have
jointly leased the Coastline Convention Center as a public convention facility operated by
Coastline Convention Management, Inc., a not-for-profit corporation; and
WHEREAS, the current lease with Big Dawg, LLC expires on April 30, 2002; and
WHEREAS, the facility attracts many out-of-town groups and guests as well as
provides a low-cost alternative for local organizations and individuals to hold a variety of ,
functions; and
WHEREAS, in order that a public convention facility may be offered to these various
users until a larger facility is available, it is in the County's interest to extend the current
lease.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of New Hanover County that the amendment to the lease agreement for the Coastline'
Convention Center is approved, extending the current lease and terms for an additional
three years from the current expiration date of April 30, 2002, funded as follows: $47,500
for year ending April 30, 2003; $45,125 for year ending April 30, 2004; $42,870 for year
ending April 30, 2005, all subject to annual appropriation by the Board.

Section 1. That the Zoning Ordinance of the County of New Hanover adopted October 6,1969, as
amended be and the same is hereby further amended as follows:

Section 72 Additional Restrictions Imposed on Certain Special Uses
72-38 Residential Uses within Commercial Districts - A dwelling unit or units may be permitted
in the B-1 or B-2 commercial Districts provided:
(1) The dwelling units are part of a mixed use development established to provide innovative
opportunities for an integration of diverse but compatible uses into a single development that is
unified by distinguishable design features with amenities and walkways to increase pedestrian
activity. Such a development shall be in single ownership or i.mified control of a property
owners association.
(2) Uses within the development are restricted to residential and B-1 neighborhood business uses.
(3) A conceptual elevation indicating proposed architecture style shall be provided.
(4) Sidewalks must be provided throughout the project.
(5) Parking location and quantity should be shared.
(6) Community facilities and/or Common area shall be provided.'
(7) A conceptual lighting plan must be provided.
(8) Residential uses are permitted and encouraged in the same building as commercial uses.
(9) Density can exceed 2.5 units per acre in Resource Protection Areas if the development is located
inside the urban services boundary, provides a minimum of 25% perviolls area, and is
exceptionally designed. Exceptionally designed projects shall reduce runoff from impervious
surfaces through porous paving and/or infiltration devices as well as managing runoff with at
least çme or more of the following water quality Best Management Practices (ref: NCDENR
Best Management Practices Manual for design criteria): bioretention area, filter strip, sand filter,
,or grassed swales.
Section 2. Any ordinance or any part of any ordinance in conflict with this ordinance, to the extent of
such conflict, is hereby repealed.

It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the renaming of Oakland Drive to Old Oakland Drive
located in the 4600 block of North College Road, east side of North College Road,
recorded in Book 1151, Page 1886, Harry Williams Tract, New Hanover County Registry
and it further appearing that a public hearing was held on Monday, December 3,2001, at
which time all persons were heard on the question of whether or not the renaming would
be in the public interest; and it further appearing that notice of said hearing was
transmitted to all resident owners and prominently posted in at least two (2) locations
along said road, and published on the Star News local newspaper, and the Board of
County Commissioners is of the opinion that said road in New Hanover County should be
renamed and the renaming of same is in the public interest, the description of which is
delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described private road is hereby renamed Old Oakland Drive.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the
office of the Register of Deeds of New Hanover County, North Carolina, and that notice
of the action taken by the Board of County Commissioners be transmitted to the
postmaster having jurisdiction over the road, the North Carolina Board of Transportation
and to any city within five (5) miles of said road in accordance with N.C. General Statues
153A-240.

a public hearing was held on Monday, December 3, 2001, at which time all persons were
heard on the question of whether or not the naming would be in the public interest; and it
further appearing that notice of said hearing WqS transmitted to all resident owners and
prominently posted in at least two (2) locations along said road, and published on the Star
News local newspaper, and the Board of County Commissioners is of the opinion that
said road in New Hanover County should be named and the naming of same is in the
public interest, the description of which is delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby named Schlegel Drive.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the
office of the Register of Deeds of New Hanover County, North Carolina, and that notice

It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the naming of Glod Drive located approximately 1,104
feet west of Eggert Avenue and Schlegel Drive and recorded in Deed Book 1762 at Page
791, Castle Haynes Colony of the New Hanover County Registry and it further appearing
that a public hearing was held on Monday, December 3, 2001, at which time all persons
were heard on the question of whether or not the naming would be in the public interest;
and it further appearing that notice of said hearing was transmitted to all resident owners
and prominently posted in at least two (2) locations along said road, and published on the
Star News local newspaper, and the Board of County Commissioners is of the opinion
that said road in New Hanover County should be renamed and the renaming of same is in
the public interest, the description of which is delineated on the attached exhibit.
NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above
described road is hereby named Glod Drive.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the

Resolution of Intent to
Close a Portion of Unnamed Roadway Easement
Porters Neck Community
Whereas, a petition has been filed pursuant to NCGS 153-A-241, requesting the
Board of Commissioners of New Hanover County to close the following described
portion of a road;
Beginning at the southern most comer of Lot 2 of the C.E. Rivenbark Division of Land as
recorded in Map Book 21, Page 81 of the New Hanover County Registry, said also being
located in the east line of a 30' Roadway Easement as shown on said map; thence,
running along said east line
1. S38° 57'00" E 492.89' to point; thence, leaving said east line along a new
line
2. S51 ° 03 '00" W 30.00' to a point in the west line of said easement; thence,
along said west line,
3. N38°57'00"W 492,89' to a point; thence, leaving said west line along a new
Line.
4, N51 °03 '00' 'E 30,00' to the point for beginning,
Containing 0.34 AC± and being a portion of said Roadway Easement.
Now, Therefore, be it resolved that this Board is considering closing a portion of
the Roadway Easement to public use and that a public hearing on this question will be
held on the ih day of January 7, 2002, at 6:30 p.m, in the Assembly Room of the Old
County Courthouse at 24 North Third Street in Wilmington at which time the Board will
hear all interested citizens and make a final determination as to whether the road shall be

OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
Urging Priority Support For The United States Senate Bill 1715
"Bioterrorism Preparedness Act of 2001 II
WHEREAS, terrorists may threaten to use, or attempt to use, biological or chemical weapon against
the United States; and
WHEREAS, the terrorism threat extends well beyond traditional methods of attack, including
agricultural products such as food, fertilizers, pesticides; and certain animals can be transformed into
devastating weapons that threaten economic well-being as well as public health; and
WHEREAS, the ability of the United States to diagnose, contain, and treat plant· and animal
diseases is hampered by lack of coordination, training, and testing facilities; and
WHEREAS, funding for private and public hospitals, laboratories, clinics, information networks,
and other necessary elements to ensure immediate and appropriate response, in the event of
bioterrorist attacks, continues to be inadequate; and
WHEREAS, governmental personnel charged with preventing and responding to such threats may
lack the training and equipment needed to effectively counter the bioterrorism activities; and
WHEREAS, Congressional findings on bioterrorism preparedness demonstrate that the United
States needs to strengthen its preparedness for bioterrorism; and
WHEREAS, Congress recommends the development of strategies with measures which: 1) enable
the Federal Government to provide health care assistance to States and localities in the event of a
biological threat or attack; 2) improve public health, hospital, laboratory, communication, and
emergency response personnel preparedness and responsiveness at the State and local levels; 3)
rapidly develop and manufacture needed therapies, vaccines, and medicalsupplies; and 4) enhance
protection of the nation's food supply and agriculture against biological threats or attacks; and
WHEREAS, Senate Bill 1715 has been introduced in the Senate, to improve the ability of the
United States to prepare for and respond to a biological threat or attack, by developing a coordinated
strategy to be implemented at every level of government, and provide State bioterrorism
preparedness and response block grants;
NOW, THEREFORE BE IT RESOLVED that the New Hanover County Board of Commissioners
urges priority support for Senate Bill 1715, known as the "Bioterrorism Preparedness Act of200 1".
