1996-03-18 Water & Sewer NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MARCH 18, 1996 PAGE 284 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, March 18, 1996, at 10:57 A.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Commissioners William A. Caster; Robert G. Greer; Vice-Chairman Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen O'Neal; County Attorney, Wanda M. Copley; and Clerk to the Board, Lucie F. Harrell. Chairman Mathews called the meeting to order and reported District Commissioner Sisson was absent due a severe cold infection. NON-AGENDA ITEMS Chairman Mathews inquired as to whether anyone from the public would like to present an item not listed on the Regular Agenda. No items were presented. ACCEPTANCE OF DRAINAGE EASEMENT IN WEATHERWOOD AT SUMMERFIELD SUBDIVISION FOR CONSTRUCTION AND MAINTENANCE OF SEWER SERVICE County Engineer, Wyatt Blanchard, advised that Mr. Bill Wood, owner of Wood and Son Heating and Air Conditioning Company located at 6602 Gordon Road, has requested connection of his business to the County Sewer System because of septic tank failure. After a review by Staff, the only feasible way to provide sewer service is through an easement from Wood Sorrell Road in Weatherwood Subdivision. The easement has been recorded and offered for dedication to the District. If the District Board accepts the easement, it must be accepted for sewer purposes only. Motion: District Commissioner Greer MOVED, SECONDED by District Commissioner Caster to adopt the resolution accepting the easement for sewer purposes only. Upon vote, the MOTION CARRIED AS FOLLOWS: Voting Aye: District Commissioner Caster District Commissioner Greer Vice-Chairman Barone Chairman Mathews Absent: District Commissioner Sisson A copy of the resolution is hereby incorporated as a part of the minutes and is contained in W&S Exhibit Book II, Page 17. CONSIDERATION OF REQUEST FROM SIDNEY L. MORGAN, JR. FOR SEWER ALLOCATION OF 300 GALLONS PER DAY County Engineer, Wyatt Blanchard, advised that due to septic tank problems, Mr. Sidney L. Morgan has requested a sewer allocation of 300 gallons per day for his residence located at 1821 NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MARCH 18, 1996 PAGE 285 North Kerr Avenue, Wilmington, N. C. He informed the District Board that if this request and the other sewer allocation requests are approved as presented on the agenda today, the available sewer capacity will be used. If the District Board decides to approve the request, Staff recommends approval with the condition that the sewer allocation must be used within twelve months. Discussion was held on the available sewer capacity. County Engineer Blanchard advised that approval of the sewer allocations will fully utilize the uncommitted sewer capacity. After a review of the committed sewer capacity that has not been used, Staff found 30,000 gallons with no stipulated time limit. Approximately two years ago, time limits were placed on all sewer allocations, and after a review of these allocations, Staff found 18,000 gallons of unused capacity that should be free after the fall. Therefore, the District has approximately 48,000 gallons of unused capacity. Vice-Chairman Barone commented on the sewer allocations granted without any stipulated time limits and suggested contacting these persons and requesting use of the capacity within the next twelve months. Motion: After discussion, Vice-Chairman Barone MOVED, SECONDED by District Commissioner Caster to direct Staff to contact the entities to whom the 30,000 gallons per day of unused committed sewer capacity has been allocated without a time limit and inform these persons that the capacity must be used within twelve months. Morgan, Jr. for his residence located at 1821 North Kerr Avenue, contingent upon the capacity being used within twelve months. Upon vote, the MOTION CARRIED AS FOLLOWS: Voting Aye: District Commissioner Caster District Commissioner Greer Vice-Chairman Barone Chairman Mathews Absent: Commissioner Sisson ACTION DEFERRED ON POLICY FOR CONNECTION OF A PRIVATE WASTEWATER TREATMENT PLANT TO THE NORTHCASE WASTEWATER DISCHARGE LINE County Engineer, Wyatt Blanchard, reported that Staff was NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MARCH 18, 1996 PAGE 286 requested to prepare a policy establishing guidelines for connection of a private wastewater treatment plant to the New Hanover County NorthChase wastewater discharge line. District Commissioner Greer commented on reading the proposed policy and stated he thought Staff had been directed to prepare a policy whereby the individual would build the system and then turn the system over to the District with payment of a monthly fee for supervision of the system by the District. Assistant County Manager, Dave Weaver, expressed concern for allowing a private wastewater treatment plant to connect to the NorthChase wastewater discharge line because this action could set a precedent, which would prompt similar requests. He explained that the primary objective of the County Sewer System was to dispose of small wastewater treatment plants. If the District becomes involved with monitoring and operating small package treatment plants, additional employees will have to be hired to adequately perform the required inspections. County Manager O'Neal agreed with Assistant County Manager Weaver and cautioned the District Board about setting a precedent. Consensus: After further discussion, it was the consensus of the District Board to DEFER ACTION on this request. Staff was directed to prepare another recommendation to be presented to the District Board. REQUEST FOR SEWER ALLOCATION BY RAIFORD AND WEB TRASK FOR LIGHT INDUSTRIAL SUBDIVISION LOCATED IN THE AREA NORTH OF KERR AVENUE AND EAST OF BLUE CLAY ROAD County Engineer, Wyatt Blanchard, reported Mr. Phil Tripp, representing Raiford and Web Trask, has requested a sewer allocation of 5,000 gallons per day for the initial phase of a proposed light industrial subdivision. The subdivision will eventually cover 1,000 acres and is located just north of Kerr Avenue and east of Blue Clay Road. The developer will be required to construct a sewer line extension approximately 2,200 linear feet to serve the subdivision. Due to the lack of capacity, Staff recommends granting a sewer allocation of 4,000 gallons per day contingent upon the capacity being used within eighteen months. District Commissioner Greer inquired as to whether an allocation of 4,000 gallons per day was satisfactory with Raiford and Web Trask? County Engineer Blanchard replied that Mr. Tripp has been contacted and has agreed to accept 4,000 gallons per day. Vice-Chairman Barone commented on the tremendous amount of residential growth in the County and stated she was delighted to see some industrial development. NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MARCH 18, 1996 PAGE 287 Motion: District Commissioner Caster MOVED, SECONDED by District Commissioner Greer to grant a sewer allocation of 4,000 gallons per day to Raiford and Web Trask for the light industrial subdivision contingent upon the capacity being used within twelve months. Vice-Chairman Barone cautioned placing a twelve-month time frame on industrial development because this type of construction does not move as quickly as residential development. She recommended a time limit of eighteen months. Amended Motion: District Commissioner Caster AMENDED THE MOTION to grant a sewer allocation of 4,000 gallons per day to Raiford and Web Trask contingent upon the sewer capacity being used within eighteen months. District Commissioner Greer SECONDED THE AMENDED MOTION. Upon vote, the AMENDED MOTION CARRIED AS FOLLOWS: Voting Aye: District Commissioner Caster District Commissioner Greer Vice-Chairman Barone Chairman Mathews Absent: District Commissioner Sisson District Commissioner Greer emphasized the importance of the City and County moving forward with joint construction of the Northside Wastewater Treatment Plant. County Manager O'Neal reported Staff was working closely with the City Staff in developing an agreement for joint construction of the Northside Wastewater Treatment Plant. If negotiations continue to move forward, a draft agreement should be completed within a short period of time. ADJOURNMENT Motion: District Commissioner Greer MOVED, SECONDED by District Commissioner Caster to adjourn. Upon vote, the MOTION CARRIED UNANIMOUSLY.
