ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Monday, February
6, 1995, at 7:05 P.M. in the Assembly Room of the New Hanover
County Courthouse, 24 North Third Street, Wilmington, North
Carolina.
Members present were: District Commissioners William A.
Caster; Robert G. Greer; William E. Sisson, Jr.; Chairman E. L.
Mathews, Jr.; County Manager, Allen O'Neal; County Attorney, Wanda
M. Copley; and Clerk to the District Board, Lucie F. Harrell.
Vice-Chairman Sandra Barone was absent.
Chairman Mathews called the meeting to order.
NON-AGENDA ITEMS
Chairman Mathews inquired as to whether anyone from the
general public would like to present an item not listed on the
Regular Agenda. No items were presented.
APPROVAL OF MINUTES
Chairman Mathews requested a correction to the minutes of
January 17, 1995, on Page 4, Paragraph 2 with a change in the last
word of the sentence to "streams" instead of roads.
Motion: District Commissioner Sisson MOVED, SECONDED by District
Commissioner Caster to approve the minutes of the Regular Meeting
of January 3, 1995, and the minutes of the Regular Meeting of
January 17, 1995, with the correction as requested by Chairman
Mathews. Upon vote, the MOTION CARRIED AS FOLLOWS:

APPROVAL OF REQUEST FOR THREE NEW POSITIONS FOR THE WATER & SEWER
DISTRICT
County Engineer, Wyatt Blanchard, reported on expansion of the
Water & Sewer District and the need to properly operate and
maintain over 100 pump stations. The District Commissioners were
requested to approve the following positions:
Two Pump Station Operators
Pay Range 110 - $17,659 - $25,272
One General Services Worker
Pay Range 107 - $15,226 - $21,757

Discussion was held on the recommendation by the County
Manager to approve the positions contingent upon the proposed
annexation or consolidation of the governments eliminating the need
for the positions.
Motion: District Commissioner Sisson MOVED, SECONDED by District
Commissioner Greer to approve the three new positions contingent
upon the positions being eliminated if impacted by annexation or
consolidation of the local governments. Upon vote, the MOTION
CARRIED AS FOLLOWS:

AUTHORIZATION TO PROCEED WITH A SEWER SYSTEM INFLOW STUDY
County Engineer, Wyatt Blanchard, reported due to the sewerage
overflow that occurred at the Hewlett Creek pump station, City,
County, and State officials met and decided the best way to
identify problem areas and determine how to correct the problems
was through performance of an inflow study. Currently, the N. C.
Department of Environment, Health and Natural Resources will not
allow the County to issue building permits that discharge into
Hewlett's Creek without determining the problem areas and
correcting the problems.
A portion of the process is to contract with a company which
specializes with inflow in sewer systems. The members of the City
and County Staff have interviewed two companies and negotiated a
cost with one of the companies. The selected company is ADS
Environmental Services, Inc., a firm that has performed work for
the City in the past.
Since this is a combined effort between the City and the
District, the City will administer a contract with ADS and the
District will reimburse the City. The estimated cost of the work
in the District is $85,995. The District Board was requested to
authorize the City to proceed with the proposed contract in the
amount of $85,995; authorize the County Manager to execute the
agreement; and approve the associated Budget Amendment.
Discussion was held on the percentage of waste water that is
treated and cannot be billed to paying customers. County Engineer
Blanchard reported during heavy rains for long periods of time, a
large amount of ground water is treated that cannot be billed to
customers. The proposed study will identify major problem areas,
but the inflow of groundwater into the sewer lines will always
occur because of people stealing or accidentally knocking off
manhole covers.

Further discussion was held on manhole covers and the damage
that occurs with the development of new lots. Concrete and lumber
trucks run over the manholes during construction leaving them
uncovered. The District has imposed fines and tried to work with
these companies to avoid this type of abuse. District Commissioner
Sisson recommended increasing the $200 fine to better control this
type of abuse.
County Attorney Copley reported the County was granted special
legislation to allow a fine up to $500 for the violation of any
County Ordinance. The Legal Department can prepare an amendment to
the Water & Sewer Ordinance to change the current fine from $200 to
$500.
After further discussion, the County Attorney was requested to
prepare an amendment to the Water & Sewer Ordinance.
Motion: District Commissioner Sisson MOVED, SECONDED by District
Commissioner Caster to authorize the City to proceed with the
proposed contract in the amount of $85,995 on behalf of the
District; authorize the County Manager to execute the agreement
with the City; and approve the following Budget Amendment. Upon
vote, the MOTION CARRIED AS FOLLOWS:
