1995-05-01 Water & Sewer District NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MAY 1, 1995PAGE 231 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, May 1, 1995, at 8:47 P.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Commissioners William A. Caster; Robert G. Greer; William E. Sisson, Jr.; Vice-Chairman Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District Board, Lucie F. Harrell. Chairman Mathews called the meeting to order. NON-AGENDA ITEMS Chairman Mathews inquired as to whether anyone from the general public would like to present an item not listed on the Regular Agenda. No items were presented. APPROVAL OF MINUTES Motion: District Commissioner Sisson MOVED, SECONDED by District Commissioner Caster to approve the minutes of the Regular Meeting of April 18, 1995, as presented by the Deputy Clerk to the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. APPROVAL OF REQUEST BY MR. JESSE JONES FOR EXTENSION OF THE DISTRICT SEWER LINE TO THE END OF CARL STREET IN THE JAMES DIXON SUBDIVISION County Engineer Blanchard reported Mr. and Mrs. Jesse Jones, who are building a house at 444 Carl Street in the James Dixon Subdivision, have requested the County to extend the existing sewer line to their lot at the end of Carl Street. When the sewer system was constructed in this subdivision several years ago, the Sewer Ordinance prohibited extending the line beyond developed lots. When Mr. Jones contacted the office about sewer availability, he was informed by an employee that sewer was available, when in fact it was not. Since Mr. Jones proceeded with the construction of his home, he would like for the County to extend 100 feet of sewer line to his home with payment of the materials by Mr. Jones. County Engineer Blanchard reported the cost of materials would be between $800 to $1,000 and the cost for extending the line would be $3,000. He reported a similar request was made by an adjacent property owner several years ago and the line was extended by the District Board. Motion: Vice-Chairman Barone MOVED, SECONDED by District Commissioner Sisson to authorize the District to extend the sewer line to 444 Carl Street in the James Dixon Subdivision contingent upon the owner paying for the cost of materials. The floor was opened for discussion. NEW HANOVER COUNTY WATER AND SEWER DISTRICT BOOK 2 REGULAR MEETING, MAY 1, 1995PAGE 232 District Commissioner Sisson expressed concern for the wrong information being given to Mr. Jones, which will cost the County $3,000, and reported this type of situation should not occur in the future. Mr. Jesse Jones reported he was informed by an employee in the Environmental Division of the Health Department that sewer was available to his lot. Commissioner Barone inquired as to whether Mr. Jones could use a septic system? County Engineer Blanchard reported once sewer is in an area, the Sewer Ordinance prohibits use of a septic system in the subdivision. After further discussion of poor communication, Commissioner Sisson recommended improving communication between the Engineering Department and Health Department as well as providing some provision for more flexibility in the Sewer Ordinance to accommodate situations of this type. After further discussion, the County Engineer was requested to investigate how this situation occurred and forward a report to the District Board. Chairman Mathews called for a vote on the MOTION to approve the sewer extension.
