ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Monday, July 18,
1994, at 9:46 A.M. in the Assembly Room of the New Hanover County
Courthouse, 24 North Third Street, Wilmington, North Carolina.
Members present were: District Commissioners William A.
Caster; William E. Sisson, Jr.; Vice-Chairman Sandra Barone;
Chairman E. L. Mathews, Jr.; County Manager, Allen O'Neal; County
Attorney, Wanda M. Copley and Clerk to the Board, Lucie F. Harrell.
District Commissioner Robert G. Greer was absent due to his
mother being in surgery.
Chairman Mathews called the meeting to order.
NON-AGENDA ITEMS
Chairman Mathews inquired as to whether anyone from the
general public would like to present an item not listed on the
Regular Agenda. No items were received.
APPROVAL OF BUDGET AMENDMENT #95-0005 - WATER & SEWER DISTRICT
OPERATING FUND
Chairman Mathews reported the District Board is being
requested to approve a Budget Amendment in the amount of $8,195 to
cover the cost of filing fees and temporary services for filing
superior court cases for customers who have not connected to the
County Sewer System.
County Attorney Copley reported on the numerous efforts made
by the Legal Department to get people to connect to the County
Sewer System upon availability. The Budget Amendment is for funds
to cover the filing fees in Superior Court and for hiring a part-
time temporary paralegal to assist in the preparation of these
cases. Hopefully, people will call and voluntarily connect to the
system before going to court.
District Commissioner Sisson inquired as to the reasons being
given as to why people cannot connect to the system?
County Attorney Copley reported the major reasons are they
cannot afford the cost for paying the plumber to install the line,
or they do not want to dig up their yards.
Discussion was held on the District's plan to assist people
who are having financial difficulties. County Attorney Copley
reported there is a plan in place for persons financially unable to
pay the cost involved with connecting to the system.
District Commissioner Sisson inquired as to extreme cases
where the property would require installation of a pumping station
and asked if a waiver is granted in such instances?

Assistant County Attorney, Dave Weaver, reported in the past,
some waivers have been granted where someone had to construct a
pump station or run a sewer line three-fourths of a mile; however,
the District Board is responsible for making these types of
decisions.
Motion: District Commissioner Sisson MOVED, SECONDED by District
Commissioner Caster to approve the following Budget Amendment in
the amount of $8,195 to budget user fee revenues to cover the cost
of filing fees and temporary services for filing Superior Court
cases for Water & Sewer District customers who have not connected
to the Sewer System. Upon vote, the MOTION CARRIED AS FOLLOWS:

Motion: Vice-Chairman Barone MOVED, SECONDED by District
Commissioner Sisson to adjourn. Upon vote, the MOTION CARRIED AS
FOLLOWS:

Chairman Mathews adjourned the meeting at 10:14 A.M.
