1993-02-15 Water & Sewer NEW HANOVER COUNTY WATER AND DISTRICT BOARDBOOK 2 REGULAR MEETING, FEBRUARY 15, 1993PAGE 90 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, February 15, 1993, at 12:06 P.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Commissioners William A. Caster; Robert G. Greer; William E. Sisson, Jr.; Vice-Chairman Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District Board, Lucie F. Harrell. Chairman Mathews called the meeting to order. APPROVAL OF MINUTES Motion: District Commissioner Sisson MOVED, SECONDED by Vice- Chairman Barone to approve the minutes of the Regular Meeting of February 1, 1993. Upon vote, the MOTION CARRIED UNANIMOUSLY. NON-AGENDA ITEMS Chairman Mathews inquired as to whether anyone from the general public would like to present an item not listed on the Regular Agenda. No items were presented. APPROVAL FOR LANDMARK TO CONSTRUCT A THIRTY INCH INTERCEPTOR TO TRANSPORT WASTEWATER TO SERVE THE MEADOWBROOK AND INDIAN WELLS SUBDIVISIONS County Engineer, Wyatt Blanchard, reported on Meadowbrook and Indian Wells Subdivisions being constructed off of Gordon Road and stated the following options are available to the developer for transporting the wastewater to the District's existing sewer system: Option 1: Allow the developer (Landmark) to construct a pump station and force main at a cost of approximately $100,000. Staff feels this option is not desirable since the District would be required to operate and maintain an additional pump station which will be abandoned in the future when the main interceptor is constructed. Option 2: Allow the developer (Landmark) to construct an 1,800 foot section of the planned thirty inch interceptor down to an existing pump station in Weatherwood. The cost received by the developer for construction of this section of the interceptor is $170,000. Landmark has agreed to construct the section of the interceptor if the District will reimburse the total cost in July of this year. In return, Landmark or other new development will pay the District a transportation fee of $450 per lot or $1.50 per daily gallon for commercial NEW HANOVER COUNTY WATER AND DISTRICT BOARDBOOK 2 REGULAR MEETING, FEBRUARY 15, 1993PAGE 91 development. The revenue from the presently planned lots will exceed the cost of this section of the interceptor. County Engineer Blanchard recommended proceeding with Option 2. District Commissioner Sisson inquired as to whether a Northside Treatment Plant was required in the original Facilities 201 Plan, and if the District could negotiate with the City for expansion of its Northside Treatment Plant? County Engineer Blanchard stated the District has two options: (1) negotiate with the City for expansion of the City's Northside Treatment Plant or (2) construction a treatment plant. The District Board will have to determine if renovation of the City's existing plant will be cost effective due to the type of facility now being operated which will require major modifications to meet required treatment standards. It may be more cost effective for the District to construct a Northside Treatment Plant. District Commissioner Sisson inquired as to whether the County owns land that would be suitable for construction of a Northside Treatment Plant? County Engineer Blanchard stated a NPDES permit has already been filed for a County owned site behind the Animal Control Center. Motion: After discussion of the District being reimbursed within 2-3 years, Vice-Chairman Barone MOVED, SECONDED by District Commissioner Greer to authorize staff to proceed with Option 2 including the $1.50 per daily gallon transportation fee. Upon vote, the MOTION CARRIED UNANIMOUSLY. Consensus: Discussion was held on County owned properties. It was the consensus of the Board to request the County Manager to provide a list of county-owned properties to each member of the Board with a map showing the location. ITEM #5 WITHDRAWN - REQUEST FOR MODIFICATION OF FLAT RATE BILLING FOR TWO BEDROOM RESIDENTIAL UNITS OWNED BY PAUL G. PARKER County Engineer, Wyatt Blanchard, reported the petitioner, Paul G. Parker, had withdrawn the request. AWARD OF CONTRACT #93-0215 TO HANOVER DESIGN FOR SURVEYING SERVICES FOR MONKEY JUNCTION SEWER INTERCEPTOR AND APPROVAL OF BUDGET AMENDMENT #93-041 AND CAPITAL PROJECT County Engineer, Wyatt Blanchard, presented the following proposals received for design of the sewer interceptor for a portion of the Monkey Junction area and recommended award of the contract to Hanover Design in the amount of $5,890. The low bid was disqualified due to inadequate insurance. County Engineer Blanchard stated this is true; however, additional work should not be required since the job is very small. District Commissioner Sisson expressed concern for an open ended contract as stated on Page 2 under the "Extra Work Provision" and recommended a cap be placed on the contract. A lengthy discussion was held on open ended contracts. County Attorney Copley inquired as to whether the District Board would like to use a "not to exceed clause" in future contracts containing the Extra Work Provision. Consensus: After further discussion, it was the consensus of the Board to request the County Attorney to place a "not to exceed" clause in future contracts with the Extra Work Provision using a dollar figure to be determined by the department head involved with the project. Motion: After discussion, District Commissioner Greer MOVED, SECONDED by Vice-Chairman Barone to: (1) award the contract to Hanover Design in the amount of $5,890 with a "not to exceed clause" in the amount of $2,000 under the Extra Work Provision of the contract; (2) approve the Project Ordinance; and (3) approve the following Budget Amendment. The Chairman was authorized to execute the contract documents. Upon vote, the MOTION CARRIED UNANIMOUSLY. BUDGET AMENDMENT 93-041 Monkey Junction Sewer Interceptor Capital Project Debit Credit Monkey Junction Sewer Interceptor Capital Project Transfer In (from Fund 815/Phase II Sewer) $612,000 Capital Project Expense $612,000 NEW HANOVER COUNTY WATER AND DISTRICT BOARDBOOK 2 REGULAR MEETING, FEBRUARY 15, 1993PAGE 93 Budget Amendment (continued) Debit Credit Phase II Sewer Capital Project Construction $612,000 Transfer Out (to Fund 817/Monkey $612,000 Junction Interceptor) Purpose: To set up budget for Monkey Junction Sewer Interceptor Capital Project. A copy of the Project Ordinance is hereby incorporated as a part of the minutes and is contained in W&S Exhibit Book II, Page 6. AWARD OF CONTRACT #93-0229 TO RIVENBARK CONSTRUCTION COMPANY FOR CONSTRUCTION OF WOOD COVE WASTEWATER COLLECTION LINE County Engineer, Wyatt Blanchard, reported on the following proposals being received for construction of the collection line and recommended award of the contract to the low bidder: Rivenbark Construction Company $17,650.00 Pipeline Utilities $17,844.60 M&A Construction Company $22,727.00 District Commissioner Sisson commented on requiring the developer to construct dry sewer lines as specified by the Sewer Ordinance and expressed concern for subsidizing the developer until building permits are issued for the lots. County Engineer Blanchard reported that streets in Wood Cove were developed and laid out prior to the dry sewer requirement. No houses were built in the subdivision before construction of the sewer system; therefore, no sewer line was installed for the subdivision. The cost for installation of the sewer line will now be the responsibility of the individuals purchasing homes. District Commissioner Sisson inquired as to why the developer does not pay the money up front and recoup the money from the individuals purchasing lots? County Engineer Blanchard stated in small projects of this type, it has been the policy of the District Board to work with the developer. District Commissioner Sisson expressed concern for restricting the use of these District funds until the project has been completed and recommended reviewing this policy in order to avoid the District paying for hidden subsidies. Motion: After further discussion, District Commissioner Greer MOVED, SECONDED by Vice-Chairman Barone to award the contract to the low bidder, Rivenbark Construction Company, in the amount of $17,650 and to authorize the Chairman to execute the contract documents. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the contract is on file in the Legal Department.
