1993-04-19 Water & Sewer NEW HANOVER COUNTY BOARD WATER AND SEWER DISTRICTBOOK 2 REGULAR MEETING, APRIL 19, 1993PAGE 101 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, April 19, 1993, at 10:46 A.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Commissioners William A. Caster; Robert G. Greer; William E. Sisson, Jr.; Vice-Chairman Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District Board, Lucie F. Harrell. Chairman Mathews called the meeting to order. APPROVAL OF MINUTES Motion: District Commissioner Greer MOVED, SECONDED by District Commissioner Sisson to approve the minutes of the Regular Meeting of April 5, 1993. Upon vote, the MOTION CARRIED UNANIMOUSLY. NON-AGENDA ITEMS Chairman Mathews inquired as to whether anyone from the general public would like to present an item not listed on the Regular Agenda. No items were presented. SEWER TASK FORCE REPORT Mr. Dean Potter, Chairman of the Sewer Task Force, reported on the need to initiate the design process for the proposed Northside Wastewater Treatment Plant as soon as practical. The treatment plant will allow for expansion of the sewer system into the northern part of the County. Also, the treatment capacity added by the treatment plant will allow the waste load from the northeastern part of the County to be diverted from the Southside Wastewater Treatment Plant. This will allow for additional expansion of the County Sewer System into the areas of the County served by the Southside Wastewater Treatment Plant. The following factors were considered in this recommendation: 1) The Northside Wastewater Treatment Plant will require approximately three to four years from the initiation of design to construction. It is anticipated that sufficient funds in the Sewer Impact Fee Account will be available for financing the construction of the facility. 2) The County has just recently received a draft NPDES permit from the State; therefore, design should not be initiated until the County has received the final NPDES permit. The final permit should be received within the next several months. NEW HANOVER COUNTY BOARD WATER AND SEWER DISTRICTBOOK 2 REGULAR MEETING, APRIL 19, 1993PAGE 102 3) A site must be secured. 4) Federal funds may be available in the near future based on a letter from Representative Eva Clayton, U. S. House of Representatives. 5) Explore the feasibility of developing a joint Wastewater Treatment Plant with the City of Wilmington for the Northside Plant. Motion: After discussion of receiving pertinent data from the engineering firm of Espey, Huston & Associates in order to proceed with the design, Vice-Chairman Barone MOVED, SECONDED by District Commissioner Sisson to authorize staff to proceed with design of the Northside Wastewater Treatment Plant as recommended by the Sewer Task Force. Upon vote, the MOTION CARRIED UNANIMOUSLY. ESTABLISHMENT OF GROUNDWATER PlANNING COMMITTEE Assistant County Manager, Dave Weaver, recommended establishing a Groundwater Planning Committee for the following purposes: 1) Develop a well-head protection plan to protect the water supply. 2) Develop rules and regulations to protect the recharge area from development or pollution. 3) Conduct a feasibility study and long-range plan to purchase private water systems and build a County Water System using groundwater as the source. 4) Research possible sources of funds to conduct a groundwater study to accomplish the above purposes. The Groundwater Planning Committee shall consist of seven members, all appointed by the Board of County Commissioners: 1 County Commissioner 1 Representative from State Division of Environmental Management 4 members from local industry and engineering firms with groundwater expertise 1 member from the public at-large. The Chairman and Vice-Chairman of the Committee shall be selected from and voted on by the Committee. The County Manager will provide support and liaison with the County Commissioners. The members shall serve at the pleasure of the Board of County Commissioners and until the Committee's objectives are obtained. The Committee shall meet on an as-needed basis as agreed upon by the members. The members will receive expenses for out-of-town travel, although none is anticipated, as requested by staff. Motion: After discussion of the importance of factually studying the groundwater supply, Vice-Chairman Barone MOVED, SECONDED by District Commissioner Sisson to establish a Groundwater Planning Committee. The floor was opened for discussion. District Commissioner Greer recommended inviting a member from the Wilmington City Council to serve on the committee. Motion Amended: Vice-Chairman Barone amended the MOTION, SECONDED by District Commissioner Sisson to include a member from the Wilmington City Council to serve on the Groundwater Planning Committee. Upon vote, the MOTION CARRIED UNANIMOUSLY. ADOPTION OF RESOLUTION AUTHORIZING CONDEMNATION OF PROPERTY ON MASONBORO SOUND ROAD County Engineer, Wyatt Blanchard, reported on the need to condemn property on Masonboro Sound Road in order to construct a gravity sewer line along Masonboro Sound Road to allow two subdivisions and the surrounding area to be served by one large pump station. Without the easements, the County will have to construct an additional pump station which will be quite costly. The permanent easements are Tax Parcel #06700005002004 and Tax Parcel #06700005002006. The District Board was requested to adopt a resolution authorizing staff to proceed with the condemnation of the easements. Motion: After discussion of unsuccessful negotiations with the property owners, District Commissioner Greer MOVED, SECONDED by Vice-Chairman Barone to adopt a resolution authorizing condemnation of the properties on Masonboro Sound Road. The floor was opened for discussion. District Commissioner Sisson reported on being contacted by two of the parties involved who had inquired as to why their property should be taken in order for someone else to develop a subdivision when the subdivisions were not planned at the time of purchase? NEW HANOVER COUNTY BOARD WATER AND SEWER DISTRICTBOOK 2 REGULAR MEETING, APRIL 19, 1993PAGE 104 Assistant County Manager, Dave Weaver, reported the District can serve the new subdivisions without having to condemn the property, but a new pump station would have to be installed creating an additional cost for the District. District Commissioner Sisson expressed concern for this type of situation occurring and recommended furnishing the Technical Review Committee information on all applications where easements will be required for installation of the sewer system so that this factor can be considered during the subdivision review process. Chairman Mathews called for a vote on the MOTION to authorize staff to proceed with the condemnation. Upon vote, the MOTION CARRIED UNANIMOUSLY. Copies of the resolutions are hereby incorporated as a part of the minutes and are contained in Exhibit Book II, Page 9. ADJOURNMENT Motion: Vice-Chairman Barone MOVED, SECONDED by District Commissioner Sisson to adjourn. Upon vote, the MOTION CARRIED UNANIMOUSLY. Chairman Mathews adjourned the meeting at 11:05 A.M.
