ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District held a Regular Meeting on Monday, June 21,
1993, at 10:16 A.M. in the Assembly Room of the New Hanover County
Courthouse, 24 North Third Street, Wilmington, North Carolina.
Members present were: District Commissioners William A.
Caster; Robert G. Greer; William E. Sisson, Jr.; Vice-Chairman
Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen
O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District
Board, Lucie F. Harrell.
Chairman Mathews called the meeting to order.
APPROVAL OF MINUTES
Motion: Vice-Chairman Barone MOVED, SECONDED by District
Commissioner Greer to approve the minutes of the Regular Meeting of
June 7, 1993, as presented by the Clerk to the District Board.
Upon vote, the MOTION CARRIED UNANIMOUSLY.
NON-AGENDA ITEMS
Chairman Mathews inquired as to whether anyone from the
general public would like to comment on an item not listed on the
Regular Agenda.
No items or remarks were received.
APPROVAL OF SEWER ALLOCATION FOR THE WILMINGTON BOX COMPANY
BUILDING
County Engineer, Wyatt Blanchard, reported Mrs. Frances
Orrell, owner of the Wilmington Box Company Building located at
1506 North Kerr Avenue, is requesting a sewer allocation of 250
gallons per day. Granting this request will leave an unused
allocation of 41,574. Staff recommends approval of the allocation
as requested.
Motion: Vice-Chairman Barone MOVED, SECONDED by District
Commissioner Sisson to approve the sewer allocation of 250 gallons
per day as requested by Mrs. Frances Orrell. Upon vote, the MOTION
CARRIED UNANIMOUSLY.
APPROVAL OF EXEMPTION FROM WASTEWATER CAPACITY FEE FOR TAKEDA
CHEMICAL PRODUCTS, USA
County Engineer, Wyatt Blanchard, reported Takeda Chemical is
requesting a building permit for construction to modify its
production process. The project will generate an estimated
wastewater flow of 36,396 gallons per day. This flow requires a
payment of $45,495 for the wastewater treatment plant capacity fee.
The capacity fee is required by Sections 15-121 and 15-14 of the
Water & Sewer Ordinance. Takeda Chemical is requesting the

exemption because the wastewater flow from the plant will not be
discharged to the Sewer System.
Staff is fully aware of Takeda's significant investment in New
Hanover County; however, there is concern for exempting the impact
fee, which will require other sources of revenue to accommodate the
design and construction of the Wastewater Treatment Plant.
If the District Board decides to amend the Water & Sewer
Ordinance, the County Attorney should be directed to develop the
specific language for the amendment which will have to be placed on
an agenda to be considered by the New Hanover County Board of
Commissioners.
Vice-Chairman Mathews inquired as to when the Sewer System
will be available in this portion of New Hanover County?
County Engineer Blanchard reported sewer will not be available
in this part of county for many years.
Mr. Ralph Godwin reported Takeda has an $8 million waste
treatment facility permitted under a Pollutant Discharge
Elimination System (NPDES) permit. Takeda treats its own waste and
is monitored by the State of North Carolina with discharge of waste
into the Cape Fear River in compliance to State regulations. The
impact fee was paid to the County for sanitary sewer when
requesting three small building permits. It is difficult to
imagine that the County sewer would ever be used for the wastewater
flow from the plant with the current waste treatment facility
permitted by the State. Takeda does not question the impact fee
for sanitary sewer, but feels the plant should be exempt from
paying the fee on the current building permit. The Commissioners
were requested to approve the exemption and amend the Water & Sewer
Ordinance accordingly.
District Commissioner Greer recommended incorporating a clause
in the exemption that will require Takeda to pay the impact fee if
in the future the State should change its regulations and Takeda
would be required to use the County System for disposal of the
daily wastewater flow from the plant.
Mr. Godwin agreed with the recommendation and reported Takeda
would not expect the citizens of the County to pay for the daily
wastewater flow from the plant.
Motion: District Commissioner Greer MOVED to exempt Takeda from
payment of the impact fee. The floor was opened for discussion.
County Attorney Copley recommended amending the Sewer
Ordinance to exempt industries that have a NPDES permit and
maintain a wastewater treatment facility with capacity sufficient

to cover the average daily wastewater flow. Also, the ordinance
should be retroactive to June 1, 1993.
Motion Amended: District Commissioner Greer MOVED, SECONDED by
Vice-Chairman Barone to exempt Takeda from payment of the impact
fee with the following requirements: (1) preparation of an
amendment to the New Hanover County Water & Sewer Ordinance,
Division 9 Fee Schedule, exempting industries with NPDES permits
who maintain wastewater treatment facilities with sufficient
capacity to cover the average daily wastewater flow; (2) the
amendment is to be retroactive to June 1, 1993; (3) the amendment
will not exempt any non-process domestic wastewater; (4) a clause
is to be incorporated into the amendment requiring payment of the
impact fee by a non-residential unit with a NPDES permit upon
availability of the County Sewer if the system is to be used for
daily wastewater flow from the industry; and (5) the amendment to
the Water & Sewer Ordinance is to be placed on the agenda for the
New Hanover County Board of Commissioners on July 6, 1993, for the
first reading. Upon vote, the MOTION CARRIED UNANIMOUSLY.

Motion: District Commissioner Sisson MOVED, SECONDED by Vice-
Chairman Barone to adjourn.
Chairman Mathews adjourned the meeting at 10:30 A.M.
