ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Tuesday, December
21, 1993, at 11:51 A.M. in the First Floor Assembly Room of the New
Hanover County Administration Building, 320 Chestnut Street,
Wilmington, North Carolina.
Members present were: District Commissioners William A.
Caster; Robert G. Greer; William E. Sisson, Jr.; Vice-Chairman
Sandra Barone; Chairman E. L. Mathews, Jr.; County Manager, Allen
O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District
Board, Lucie F. Harrell.
Chairman Mathews called the meeting to order.
APPROVAL OF MINUTES
Motion: District Commissioner Sisson MOVED, SECONDED by District
Commissioner Greer to approve the minutes of the Regular Meeting of
December 6, 1993, as presented by the Clerk to the District Board.
Upon vote, the MOTION CARRIED UNANIMOUSLY.
NON-AGENDA ITEMS
Chairman Mathews inquired as to whether anyone from the
general public would like to present an item not listed on the
Regular Agenda.
No items were presented.
TRANSFER OF OWNERSHIP FROM OGDEN VILLAGE UTILITIES, INC. TO NEW
HANOVER COUNTY WATER & SEWER DISTRICT
County Engineer, Wyatt Blanchard, reported the owner of Ogden
Village Utilities, Inc. has requested the District to accept the
sewer system for ownership, operation and maintenance. The
transfer of the system has been approved by the N. C. Utility
Commission.
This system serves the Food Lion Shopping Center in Ogden and
the residential area behind the Shopping Center called Wendover
North, Jacobs Run, Emerald Forest and Willow Brook. The system has
approximately 10,000 feet of main lines, 28 customers, and there
are plans to construct another 2,000 feet.
Ogden Village Utilities, Inc. is presently a customer of the
District. The owner is willing to donate the system to the
District, if the District is willing to pay all costs related to
transferring the system. Staff recommends approval of the transfer
and feels this system will help to interconnect other areas of the
County that are not being served.
Vice-Chairman Barone inquired as to the condition of the sewer
system and asked if additional expenses would be incurred?

County Engineer Blanchard reported the sewer system is in
excellent condition since it is only five years old.
District Commissioner Sisson inquired as to when the District
will reach a critical threshold relative to the northern
interceptor and the strain on this system?
County Engineer Blanchard reported McKim & Creed is in the
process of performing a study on the northern interceptor and based
on this study, the threshold will be reached by 1997 or 1998. A
copy of the report will be forwarded to the District Board within
the next two weeks.
Motion: District Commissioner Sisson MOVED, SECONDED by Vice-
Chairman Barone to approve the transfer of the ownership of Ogden
Village Utilities, Inc. to the New Hanover County Water & Sewer
District with the District paying all costs related to transferring
the system. The Chairman was authorized to execute the necessary
contract documents after the transfer of the system. Upon vote,
the MOTION CARRIED UNANIMOUSLY.
ACCEPTANCE OF EASEMENT AND RIGHTS-OF-WAYS (Contract #W&S-90-0360)
-KINGSLAND WOODS SUBDIVISION
County Engineer, Wyatt Blanchard, reported the pump station
and sewer lines in Kingsland Woods were constructed by the
developer and donated to the District. Normally, the developer
will deed the easements to the District; however, in this
particular case, this did not occur. The District Board is
requested to accept the easements and rights-of-way for water and
sewer purposes only.
District Commissioner Sisson commented on the need to clearly
define easements so that persons purchasing property are aware of
where utility easements will be located and suggested using a
method that will provide this information to future buyers.
County Engineer Blanchard reported normally when an area is
developed, easements are deeded at the beginning of the project.
District Commissioner Sisson recommended informing developers
at the preliminary plat approval process that easements should be
deeded at the beginning of a project.
Motion: Vice-Chairman Barone MOVED, SECONDED by District
Commissioner Sisson to accept the easements and rights-of-way for
water and sewer purposes only in Kingsland Woods Subdivision. The
Chairman was authorized to execute the necessary agreements. Upon
vote, the MOTION CARRIED UNANIMOUSLY.

the minutes and is contained in W&S Exhibit Book II, Page 12.

ADJOURNMENT
Motion: Vice-Chairman Barone MOVED, SECONDED by District
Commissioner Caster to adjourn. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Chairman Mathews adjourned the meeting at 12:24 P.M.
