ASSEMBLY
The District Board of Commissioners of the New Hanover
County Water & Sewer District met in Regular Session on Monday,
August 19, 1991, at 9:32 o'clock A.M. in the Assembly Room of the
New Hanover county Courthouse, 24 North Third street, Wilmington,
North Carolina.
Members present were: District Commissioners E. L. Mathews,
Jr.; Fred Retchin; William H. sutton; Vice-Chairman Robert G.
Greer; Chairman Jonathan Barfield, Sr.; County -Manager, Allen
O'Neal; County Attorney, Robert W. Pope; and Clerk to the Board,
Lucie F. Harrell.
Chairman Barfield called the meeting to order.
APPROVAL OF MINUTES
Motion: District commissioner Retchin MOVED, SECONDED by
Vice-Chairman Greer to approve the minutes of the Regular Meeting
of July 22, 1991, and the Regular Meeting of August 5, 1991, as
presented by the Clerk to the District Board. Upon vote, the
MOTION CARRIED UNANIMOUSLY.

Chairman Barfield asked if anyone from the general public
would like to speak on an item not listed on the Regular Agenda.
No items were presented.
RECOMMENDATION FOR ADOPTION OF ORDINANCE AMENDING CHAPTER 15,
SECTION 15-6; SECTION 15-18; DIVISION 3, SECTION 15-36; SECTION
15-90; SECTION 15-93; SECTION 15-94; SECTION 15-98; SECTION
15-101; SECTION 15-102; SECTION 15-121; SECTION 15-122; AND
SECTION 15-124; OF THE NEW HANOVER COUNTY CODE
Deputy Finance Director, Julie Griffin, presented revisions
to the current Water and Sewer Ordinance and stated the
recommended changes are basically for clarification of policies
with specific attention to ordinances 15-6 and 15-124 for
increases in bi-monthly user fees for water and sewer. Emphasis
was placed on the fact that water user fees are being increased
for the first time in ten (10) years. Sewer user fees are being
increased as mandated by the 201 Facility Plan Update approved by
the Board of County Commissioners in 1988.
Motion: After discussion of the need to revise the various
sections of the Water & Sewer Ordinance, District commissioner
Retchin MOVED, SECONDED by Chairman Barfield to recommend to the
New Hanover County Board of Commissioners approval' of the
revisions to the Water & Sewer Ordinance as presented by the
Deputy Finance Director. The floor was opened for discussion.

District, Commissioner .Sutton inquired as to why the monthly
increase is necessary? Deputy Finance Director Griffin stated
the rate increase is necessary to absorb the City's increase in
rates charged for sewer treatment and water usage plus complying
to the 201 Facility Plan Update utilized for obtaining EPA
federal grants.
District Commissioner Retchin recommended clarification of
the bi-monthly residential metered rate as $26.00 for the first
5,000 gallons with an additional charge of $2.30 per $1,000
gallons after usage ~f the first 5,000 gallons.
Assistant County Manager, Dave Weaver, stated the ordinance
clearly defines the rate structure for the gallons used; however,
on the example presented in the agenda packet, it is not clearly
stated.
After further discussion, Chairman Barfield called for a
vote on the MOTION to recommend to the New Hanover County Board
of Commissioners approval of the revisions as presented. Upon
vote, the MOTION CARRIED UNANIMOUSLY. "
RECOMMENDATION FOR ADOPTION OF AN AMENDMENT TO CHAPTER 15,
ARTICLE II, SECTION 15-47 OF THE NEW HANOVER COUNTY SEWER
ORDINANCE TO THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS
County Attorney, Robert W. Pope, stated in accordance with
section 15-47 of the Sewer Ordinance, sewer lines are being
constructed in mobile home parks. Parks owners have inquired as
to what will happen if they decide to develop the land
differently, which will necessitate the abandonment of the sewer
line. He stated in order to address this issue, he would
recommend an amendment to section 15-47 of the Sewer Ordinance to
read as follows:
"In the event the County abandons the sewer lines
located within a mobile home park, the County will
reconvey the right-of-way or easement to its grantor
or heirs, assignees or nominees, pursuant to
N.C.G.S. 153A-177, upon payment to the County the
value of the sewer lines and accessories at the time
of the reconveyance. The value of the system shall
be based upon the original construction costs of the
sewer lines depreciated on a straight line basis
with a forty (40) year life."
Motion: After discussion, District commissioner Mathews MOVED,
SECONDED by District commissioner Retchin to recommend to the New
. Hanover County Board of Commissioners adoption of an amendment to
section 15-47 of the Sewer Ordinance as presented to address
. abandonment of _ sewer lines. Upon vote, the MOTION CARRIED
