1991-09-03 Water & Sewer11 ,., MINUTES OF THE NEW HANOVER COUNTY WATER .Ii SEWER DISTRICT SEPTEMBER 3, 1991 ASSEMBLY The District Board of commissioners of the New Hanover County Water .Ii Sewer District met in Regular Session on Tuesday, September 3, 1991, at 6:51 o'clock P.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District commissioners E. L. Mathews, Jr.; Fred Retchin; William H. sutton; Vice-Chairman Robert G. Greer; Chairman Jonathan Barfield, Sr.; County Manager, Allen O'Neal; County Attorney, Robert W. Pope; and Clerk to the Board, Lucie F. Harrell. Chairman Barfield called the meeting to order. APPROVAL OF MINUTES Motion: District Vice-Chairman Greer of August 19, 1991, UNANIMOUSLY. commissioner to approve the as presented. Retchin MOVED, SECONDED by minutes of the Regular Meeting Upon vote, the MOTION CARRIED NON-AGENDA ITEMS Chairman Barfield asked if anyone from the general public would like to present an item not listed on the Regular Agenda. No items were presented. ADDITIONAL ITEM - COUNTY MANAGER RECOMMENDATION FOR THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS TO PROCEED WITH CONDEMNATION PROCEDURE ON TAX PARCELS 3600005006000 .Ii 3600005006001 Assistant County Manager, Dave Weaver, commented on numerous meetings with the property owner and stated staff has not been able to reach an agreement for acquisition of these easements with the property owner. All easements have been acquired except for these parcels; therefore, in order to continue construction along Market Street, it is necessary to acquire a fifteen foot easement along the edge of the referenced parcels. Vice-Chairman Greer inquired as to why the property owner was not willing to grant the easements. Assistant County Manager Weaver stated the property owner expressed concern for the existing residents in the Porters Neck area not receiving fair treatment on extension of the sewer line as well as concern for expenditures involved with maintenance and construction of the line. Staff explained to the property owner that the sewer line would not be in the process of being constructed unless the District had entered into a cooperative agreement with the developer. 12 MINUTES OF REGULAR MEETING, SEPTEMBER 3, 1991 District commissioner Retchin asked if the property owner 0 desired to connect to the sewer line? Assistant County Manager Weaver stated he would like to tap on to the line immediately. Discussion was held on the District's policy with reference to persons desiring to connect to the line. Assistant County Manager Weaver stated the District will allow anyone desiring to tap on if they are experiencing septic tank problems or desire to develop property; however, due to the line being a force main, they are informed that additional expenses will be incurred due to the necessity of having to purchase and install a pump. Motion: After further discussion, District commissioner Mathews MOVED, SECONDED by Vice-Chairman Greer to recommend to the New Hanover County Board of Commissioners that the County Engineer has authority to proceed with the condemnation of Tax Parcels #3600005006000 and #3600005006001 for a fifteen foot easement along the edge of the referenced parcels.
