1991-11-18 Water & Sewer20 MINUTES OF REGULAR MEETING, NOVEMBER 18, 1991 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, November 18, 1991, at 11:21 o'clock A.M. in the Assembly Room of the New Hanover County Courthouse, 24 North Third Street, Wilmington, North Carolina. Members present were: District Commissioners E. L. Mathews, Jr.; Fred Retchin; William H. Sutton; Vice-Chairman Robert G. Greer; Chairman Jonathan Barfield, Sr.; County Manager, Allen O'Neal; Assistant County Attorney, Wanda Copley, and Clerk to the Board, Lucie F. Harrell. Chairman Barfield called the meeting to order. APPROVAL OF MINUTES Motion: District Commissioner Retchin MOVED, SECONDED by Vice- Chairman Greer to approve the minutes of the Regular Meeting of November 4, 1991, as presented by the Clerk to the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. NON-AGENDA ITEMS 0 Chairman Barfield asked if anyone from the general public would like present an item that is not listed on the Regular Agenda. No items were presented. APPROVAL OF SENIOR CITIZENS EXCLUSION FOR SEWER USER CHARGES District Commissioner Retchin commented on the need to provide relief to our senior citizens with low incomes, and recommended adoption of a $4.00 per month deduction in the sewer user charge for each customer who qualifies for the property tax exemption. After review of persons receiving the homestead exemption for property taxes, there are approximately 96 customers who would qualify for the exclusion. Based on this figure, future revenues would decrease by $4,608 per year. Motion: District commissioner Retchin MOVED, SECONDED by District Commissioner Mathews to approve the $4.00 per month deduction in the sewer bill to only those customers who qualify for the homestead tax exemption. The floor was opened for discussion. County Engineer, Wyatt Blanchard, commented on the impact of the sewer exclusion and stated the District Board should consider the future impact in revenues even though the immediate impact is 0 minimal. 21 MINUTES OF REGULAR MEETING, NOVEMBER 18, 1991 Further discussion was held on the importance of informing the public that only persons qualifying for the homestead tax exemption will be eligible to receive the sewer exclusion. Chairman Barfield called for a vote on the motion to grant a senior citizens exclusion for sewer user charges. Upon vote, the MOTION CARRIED UNANIMOUSLY. ADOPTION OF RESOLUTION ACCEPTING OF STREET RIGHT-OF-WAY IN MOONBEAM SUBDIVISION County Engineer, Wyatt Blanchard, recommended acceptance of a street right-of-way in Moonbeam Subdivision, as recorded in Map Book 27, Page 131, in the New Hanover County Registry, to 'allow for construction and maintenance of the sewer in this area. Acceptance of the street right-of-way does not include maintenance of the street. Motion: District Commissioner Retchin MOVED, SECONDED by Vice- Chairman Greer to adopt a resolution accepting the street right-of- way as recommended by the County Engineer. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the resolution is hereby incorporated as a part of the minutes and is contained in W&S Exhibit Book II, Page 3. APPROVAL OF AGREEMENT WITH D. H. CAISON FOR EXTENSION OF SEWER SYSTEM IN COUNTRY HAVEN AND SWEETWATER DRIVE County Engineer, Wyatt Blanchard, recommended approval of an agreement with D. H. Caison for extension of the sewer system in Country Haven and Sweetwater Drive. The agreement stipulates that the District would pay for the cost of materials, estimated to be $20,000, with labor, equipment, and installation costs paid by Mr. Caison. Approximately 2,000 feet of pipe will be installed at an approximate cost of $10 per footi whereas, the cost to the District would be between $25 to $30 per foot for installation of the same amount of sewer pipe. The lines will be installed in compliance'"to the District's specifications. Motion: District Commissioner Retchin MOVED, SECONDED by District Commissioner Sutton to approve an agreement with D. H. Caison for extension of the sewer system in Country Haven and Sweetwater Drive. The Chairman was authorized to execute the contract documents. Upon vote, the MOTION CARRIED UNANIMOUSLY. A copy of the agreement is on file in the Legal Department. APPROVAL OF EXEMPTION FROM SEWER CONSTRUCTION REQUIREMENTS FOR HERITAGE BAPTIST CHURCH '0' County Engineer, Wyatt Blanchard, recommended granting an exemption from sewer construction requirements for Heritage Baptist' Church since the District will be installing a main trunk line behind the property during Phase II of the sewer system. ~ 22 MINUTES OF REGULAR MEETING, NOVEMBER 18, 1991 Motion: Chairman Barfield MOVED, SECONDED by Vice-Chairman Greer to grant an exemption from sewer construction requirements' to Heritage Baptist Church contingent upon facilities on the property connecting to the sewer system when constructed along College Road or closer. Upon vote, the MOTION CARRIED UNANIMOUSLY. APPROVAL OF EXEMPTION FROM SEWER CONSTRUCTION REQUIREMENTS FOR R. C. MURRAY, JR. AND WIFE, EMMA Y. MURRAY County Engineer, Wyatt Blanchard, recommended granting an exemption from sewer construction requirements for R. C. Murray, Jr. and Wife, Emma Y. Murray for a minor subdivision since the tract of land is 4,000 feet long and will cost the owners $100,000 for dry sewer installation. The subdivision is located north of Porters Neck Road and is perpendicular to, and connects to Market Street. Any homes located on the property will be required to connect to the sewer system when constructed along Market Street or closer. Motion: After discussion, District commissioner Retchin MOVED, SECONDED by District commissioner Sutton to grant an exemption from sewer construction requirements to R. C. Murray, Jr. and wife, Emma Y. Murray contingent upon homes on the property connecting to the sewer system when constructed along Market Street or closer. Upon vote, the MOTION CARRIED UNANIMOUSLY. WITHDRAWN OF ITEM #9, A REQUEST FOR CONDEMNATION OF TEMPORARY CONSTRUCTION EASEMENT LOCATED AT 608 YULAN DRIVE County Engineer, Wyatt Blanchard, stated this item has been withdrawn since an agreement has .been reached and condemnation procedures will not be necessary. ~ APPROVAL OF SEWER TREATMENT RATE INCREASE AS REQUESTED BY CAPE FEAR UTILITIES County Engineer, Wyatt Blanchard, requested approval of an increase in the sewer treatment rate to $1.26 per 1,000 gallons as requested by Cape Fear utilities. The increase is to cover the city's additional $.10 charge for the treatment of wastewater and is calculated as follows: Operation and Maintenance Northeast Interceptor Operation and Maintenance Souths ide WWTP Debt Retirement Operation and Maintenance Meter $0.361 $0.575 $0.300 $0.020 $1. 256/1000 Motion: District commissioner Retchin MOVED, SECONDED by District commissioner Sutton to approve the rate increase for Cape Fear utilities as requested by the County Engineer.
