MINUTES OF REGULAR MEETING, DECEMBER 16, 1991

ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Monday, December
16, 1991, at 11:08 o'clock A.M. in the Assembly Room of the New
Hanover County Courthouse, 24 North Third Street, Wilmington, North
Carolina.
Members present were: District Commissioners E. L. Mathews,
Jr.; Fred Retchin; William H. sutton; Vice-Chairman Robert G.
Greer; Chairman Jonathan Barfield, Sr.; County Manager, Allen
O'Neal; County Attorney, Robert W. Pope; and Clerk to the District
Board, Lucie F. Harrell.
Chairman Barfield called the meeting to order.
APPROVAL OF MINUTES
Motion: District commissioner Retchin MOVED, SECONDED by District
commissioner Mathews to approve the minutes of the Regular Meeting
of December 2, 1991, as presented by the Clerk to the District
Board. Upon vote, the MOTION CARRIED UNANIMOUSLY.
NON-AGENDA ITEMS
Chairman Barfield asked if anyone from the general public
would like to present an item not listed on the Regular Agenda. 0
No items were presented.
DISCUSSION OF AMENDING THE NEW HANOVER COUNTY SEWER ORDINANCE FOR
CONSTRUCTION OF MOBILE HOME PARKS
County Engineer, Wyatt Blanchard, commented on the need to
amend Section 15-47 of the Sewer Ordinance in order to obtain the
necessary easements when constructing internal sewer lines in
mobile home parks. Under the existing ordinance, the District will
construct the internal sewer lines in mobile home parks provided
that th~ owner furnishes all necessary easements in the most
feasible place considering cost and construction. The District's
consulting engineers have designed the internal system for six
mobile home parks in the Phase I area, and the systems are now
under contract. Two of the mobile home parks have refused to grant
easements creating a time problem for the contractors; therefore,
in order to avoid situations of this type in the future, Staff
would recommend adding Section 15-47 to the Sewer Ordinance as
follows:
"The park owner must grant the necessary easements within 30
days of notification of request for easements by the District.
If easements are not granted within 30 days, the park owner
would be notified that he or she has six months to permit and 0
construct the system at his or her expense and connect to the
District's sewer system."

Chairman Barfield commented on 30 days after notification
being a short period of time and recommended extending the number
of days to 90.
Motion: After discussion, District Commissioner sutton MOVED,
SECONDED by District Commissioner Retchin to approve the amendment
to the Sewer Ordinance changing the number of days after
notification from 30 to 90 days. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Chairman Barfield stated since this ordinance is a part of the
County Code, the amendment must be approved by the B.oard .of County
Commissioners.
DISCUSSION OF ESTABLISHING SPECIFIC DUE DATES FOR SEWER BILLINGS
District Commissioner Sutton commented on complaints received
from elderly persons living on fixed incomes relative to no
established due date f.or sewer billings, and requested Staff to
c.onsider establishing a due date'on sewer bills to accommodate this
group of citizens.
County Engineer, Wyatt Blanchard, explained that the District
employs only two meter readers; therefore, variable dates are used
in order to better utilize their services; however, he will check
into this matter and forward a recommendation.
APPROVAL OF CONTRACT #92-0248 WITH CEDAR ISLAND NORTH ASSOCIATION
FOR REIMBURSEMENT OF COST FOR OVERSIZING A PUMP STATION AND SEWER
LINE EXTENSIONS IN THE CEDAR ISLAND AREA
County Engineer, Wyatt Blanchard, presented a contract with
Cedar Island North Association for reimbursement of costs for
oversizing a pump station and sewer line extensi.ons in the Cedar
Island area. The total cost of the pump station and sewer lines is
$123,025. The District will pay $89,808 with $25,000 being paid"at
the time of acceptance of the system and the remaining balance
being paid one year after the date .of acceptance.
Motion: After discussion of the amount of money saved by all.owing
the private contractor to construct the pump station and sewer line
extensi.ons, District C.ommissioner Retchin MOVED, SECONDED by Vice-
Chairman Greer to approve the contract and authorize the Chairman
to execute the necessary documents. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
A copy of the contract is on file in the Legal Department.
WITHDRAWAL OF ITEM #6, VARIANCE REQUEST FROM SEWER SYSTEM
CONSTRUCTION REQUIREMENTS
County Engineer, Wyatt Blanchard, stated the petitioner, Mr.
Jack Moore, has withdrawn the variance request due to not" being
ready to proceed with the project.

AUTHORIZATION TO PROCEED WITH CONDEMNATION - TAX PARCELS #72-90-08-
03 AND #72-00-08-06 - FRIENDLY LANE
c.ounty Engineer, Wyatt Blanchard, requested authorization t.o
pr.oceed with condemnation of the tax parcels since no satisfactory
agreement has been reached with the property .owner.
Motion: After further discussi.on, Vice-Chairman Greer MOVED,
SECONDED by District Commissi.oner Mathews to authorize Staff to
proceed with condemnation proceedings and authorize the Chairman to
execute the necessary d.ocuments. Upon v.ote, the MOTION CARRIED
UNANIMOUSLY.
Chairman Barfield stated this acti.on will also have to be
appr.oved by the Board of County Commissioners.
ADJOURNMENT
Motion: District Commissioner Retchin MOVED, SECONDED by District
Commissioner Mathews to adjourn. Upon vote, the MOTION CARRIED
UNANIMOUSLY.
Chairman Barfield adjourned the meeting at 11:30 o'clock A.M.
