MINUTES OF REGULAR MEETING, APRIL 6, 1992
ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Monday, April 6,
1992, at 9:26 P.M. in the Assembly Room of the New Hanover County
Courthouse, 24 North Third Street, Wilmington, N. C.
Members present were: District Commissioners E. L. Mathews,
Jr.; Fred Retchin; William H. Sutton; Vice-Chairman Robert G.
Greer; Chairman Jonathan Barfield, Sr.; County Manager, Allen
O'Neal; County Attorney, Wanda M. Copley, and Clerk to the District
Board, Lucie F. Harrell.
Chairman Barfield called the meeting to order.
APPROVAL OF MINUTES
Motion: District Commissioner Retchin MOVED, SECONDED by Vice-
Chairman Greer to approve the minutes of the Regular Meeting of
March 16, 1992, as presented by the Clerk to the District Board.
Upon vote, the MOTION CARRIED UNANIMOUSLY. I

APPROVAL OF VARIANCE FROM SEWER CONSTRUCTION REQUIREMENTS FOR
LOCATION OF A TEMPORARY MOBILE HOME ON A WATER TANK SITE LOCATED ON'
WESTBROOK AVENUE OWNED BY CAPE FEAR UTILITIES
County Engineer, Wyatt Blanchard, stated Cape Fear utilities
has requested a variance from sewer construction requirements for
the temporary location of a mobile home on Westbrook Avenue near a
water tank owned by the company. The purpose of the request is to
provide a dwelling for a watchman to protect against property and
water tank vandalism. This item has been before the District Board
with postponement of the first request; denial of the second
request; and no action on the third request since an agreement was:
negotiated between Cape Fear utilities and the Rogers family for
construction of the sewer line. Since that time the Rogers family
has decided not to uphold the agreement; therefore, Cape Fear
utilities is requesting an exemption. After review, Staff
recommends approval of the variance on a temporary basis of one
year or less.
Attorney Kenneth Shanklin, representing cape Fear utilities,'
requested a period of two years.
Motion: After further discussion, District Commissioner Retchin
MOVED, SECONDED by Chairman Barfield to grant the variance to Cape
Fear utilities for location of the temporary mobile home on the
site located on Westbrook Avenue with a one-year limitation and a

maximum lifetime cap of two years. Upon vote, the MOTION CARRIED 0
UNANIMOUSLY.
APPROVAL OF VARIANCE FROM SEWER CONSTRUCTION REQUIREMENTS FOR A s-
LOT SUBDIVISION ON DUNBAR ROAD
County Engineer, Wyatt Blanchard, stated Claud and Judy
O'Shields are subdividing a tract of land adjacent to Dunbar Road
into a 5-lot subdivision. Lots 4-7 will be served by a Dunbar Road
community sewer system. The exemption is being requested for Lot
8. 'Staff- recommends an exemption be granted with the condition
that the owner of Lot 8 will connect to the County sewer system
when available on Dunbar Road. This condition must be recorded in
the deed.
Motion: After discussion, District Commissioner Retchin MOVED,
SECONDED by Chairman Barfield to grant the variance from sewer
construction requirements for a subdivision on Dunbar Road owned by
Claud and Judy 0' Shields contingent upon the owner of Lot 8
connecting to the County sewer system upon availability. This
condition is to be recorded in the deed. Upon vote, the MOTION
CARRIED UNANIMOUSLY.
