1992-07-06 Water & Sewer61 : MINUTES OF REGULAR MEETING, JULY 6, 1992 ASSEMBLY The District Board of Commissioners of the New Hanover County Water & Sewer District met in Regular Session on Monday, July 6, 1992, at 9:51 P.M. in the Assembly Room of the New Hanover Cou~ty Courthouse, 24 North Third Street, Wilmington, North Carolina. . Members present were: District Commissioners E. L. Mathews, Jr.; Fred Retchin; William H. Sutton; Vice-Chairman Robert G. Greer; Chairman, Jonathan Barfield, Sr.; County Manager, Allen O'Neal; County Attorney, Wanda M. Copley; and Clerk to the District Board, Lucie F. Harrell. Chairman Barfield called the meeting to order. APPROVAL OF MINUTES Motion: District Commissioner Retchin MOVED, SECONDED by District Commissioner Mathews to approve the minutes of the Regular Meetings of June 1, 1992, and June 15, 1992, as presented by the Clerk to the District Board. Upon vote, the MOTION CARRIED UNANIMOUSLY. NON-AGENDA ITEMS Chairman Barfield asked if anyone from the general public would like to present an item not listed on the Regular Agenda. No items were presented. APPROVAL OF REQUEST FOR EXEMPTION FROM SEWER CONSTRUCTION REQUIREMENTS FOR LYNDA'S HOLLOW LOCATED ADJACENT TO CAROLINA BEACH ROAD (U. S. HIGHWAY 421) County Engineer, Wyatt Blanchard, stated since the June 15, 1992, District Board meeting, the proposed subdivision has been reduced from a 4-lot subdivision to a 3-lot subdivision; therefore, the owner has requested exemption from the sewer construction requirements. After review of the request and the fact that the sewer has not been constructed in the southern part of the County, staff recommends approval upon a written clause in the deed requiring the lot owners to build either an individual or a collective sewer to the District sewer when it is available and adjacent to the subdivision. Chairman Barfield commented on this item being placed on the agenda and recommended granting authorization to the County Engineer, Wyatt Blanchard, to approve requests for exemption from sewer requirements for 1-3 lot subdivisions as regulated by the Sewer Ordinance. County Manager O'Neal recommended preparing and presenting a resolution to grant this authority to the County Engineer at the next District meeting scheduled for July 20, 1992. ~ 62 MINUTES OF REGULAR MEETING, JULY 6, 1992 Motion: District Commissioner Retchin MOVED, SECONDED by District Commissioner Mathews to approve the request for exemption from the sewer construction requirements for Lynda's Hollow contingent upon a written clause in the deed requiring the lot owners to build either an individual or a collective sewer to the District sewer upon availability. Upon vote, the MOTION CARRIED UNANIMOUSLY. APPROVAL OF REQUEST FOR EXEMPTION FROM SEWER CONSTRUCTION REQUIREMENTS FOR SUBDIVISION ON OAKLEY ROAD County Engineer, Wyatt Blanchard, stated Mr. Robert Goslee, on behalf of Mr. Hugh M. Guyton, is requesting an exemption from the sewer construction requirements for a 3-lot subdivision located in the northern part of the County off of Oakley Road. After review, staff recommends approval of the exemption contingent upon the owners of the three lots being required to pay for a sewer line extension into the subdivision when the District sewer line is constructed along Oakley Road. This figure will be assessed at that time and these requirements are to be written in the deeds. , I I , j 1 ! Motion: District Commissioner Retchin MOVED, SECONDED by District Commissioner Mathews to approve the request for exemption from the sewer construction requirements for Mr. Hugh M. Guyton contingent upon a written clause in the deeds that will require the owners of the three lots to pay for a sewer line extension into the subdivision when the District sewer line is constructed along Oakley Road with assessment of this figure at that time. Upon vote, the MOTION CARRIED UNANIMOUSLY. DISCUSSION OF SEWAGE SPILL INTO HEWLETT'S CREEK District Commissioner Sutton inquired about the sewage spill into Hewlett's Creek and asked if there is a chemical that can be used to counteract the negative impact of the bacteria in the creek, and if so is the District prepared to use the chemical? County Engineer, Wyatt Blanchard, stated no discussion has been held with the city to find why this problem occurred; however, a meeting is being scheduled today. The City is responsible for operating the pump station located on piner Road through an interlocal agreement. In instances of this type, the State requires the use of chlorine, which is usually discharged in a liquid or powder form, to counteract the bacteria. The Sewer District is prepared to immediately apply the chlorine when necessary. Discussion was held on the importance of the County Sewer System having the capability of avoiding a problem of this type if a power failure occurs. County Engineer Blanchard stated the telemetry system used by the County would have immediately notified the Engineering Office of the power failure and batteries would have automatically functioned for a 3-hour period. The City does need to update its telemetry system since it forwards only one signal, indicating high water. If the City's present telemetry system fails, they are not notified that the system is down; 63 MINUTES OF REGULAR MEETING, JULY 6, 1992 whereas, the County's system automatically calls each computer unit hourly and asks if the station is working with notification of any failure. It was generally concurred that situations of this type must be avoided and, hopefully, the City will update their telemetry system or consider joining the County's system.
