MINUTES OF REGULAR MEETING, AUGUST 17, 1992
ASSEMBLY
The District Board of Commissioners of the New Hanover County
Water & Sewer District met in Regular Session on Monday, August 17,
1992, at 10:01 A.M. in the Assembly Room of the New Hanover County
Courthouse, 24 North Third Street, Wilmington, North Carolina. .
Members present were: District commissioners E. L. Mathews,
Jr.; Fred Retchin; William H. Sutton; Vice-Chairman Robert G.
Greer; Chairman Jonathan Barfield, Sr.; Assistant County Manager,
Dave Weaver; County Attorney, Wanda M. Copley; and Clerk to the
District Board, Lucie F. Harrell.
Chairman Barfield called the meeting to order.
APPROVAL OF MINUTES
Motion: District commissioner Retchin MOVED, SECONDED by District
commissioner Mathews to approve the minutes of the Regular Meeting
of August 3, 1992, as presented by the Deputy Clerk to the District
Board. Upon vote, the MOTION CARRIED UNANIMOUSLY.

APPROVAL OF AMENDMENT TO THE NEW HANOVER COUNTY WATER & SEWER
ORDINANCE, SECTION 15-91, SEWER CONSTRUCTION REQUIREMENTS, OF THE
NEW HANOVER COUNTY CODE
County Engineer, Wyatt Blanchard, presented an amendment to
the Water & Sewer Ordinance, Section 15-91, to provide more
discretion in allowing subdivisions up to five lots to be exempt
from the dry sewer construction requirement. The amendment
authorizes the County Engineer to grant the exemption contingent
upon the following conditions being met: (1) the subdivision is
neither in an existing sewered area nor in an area planned to be
sewered within two years of the application for the subdivision;
and (2) all lot owners within the subdivision will be assessed by
the County for the full cost of the County providing sewer service
to the subdivision at the time the District sewer becomes available
to the subdivision. An appropriate note must be recorded on the
subdivision plat and placed as a restriction on all deeds. The
District Board was requested to adopt the amendment as presented.
Motion: District commissioner Retchin MOVED, SECONDED by District
commissioner Sutton to adopt the amendment to the Water & Sewer
Ordinance, amending Section 15-91 and adding Section 15-18. Upon
vote, the MOTION CARRIED UNANIMOUSLY.
A copy of the Ordinance is hereby incorporated as a part of
the minutes and is contained in W&S Exhibit Book II, Page 6.

The Clerk to the District Board requested action be taken in
the Regular Session of the New Hanover County Board of
Commissioners since this is a County Ordinance and should be
adopted.by that Board.
