HomeMy WebLinkAbout2000-07-10 RM Exhibits RESOLUTION OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS WHEREAS, New Hanover County and the City of Wilmington were owners of the property located at 808 Russell Alley (Parcel No. 3127151151000) having purchased such property at the Execution Sale thereof held on November 8, 1988. WHEREAS, on May 18, 1999, New Hanover County and the City of Wilmington transferred such property to Wilmington/New Hanover Community Development Corporation (CDC). WHEREAS, on April 31, 1989, Marilyn Banister and James Ernest Banister sold such property to E.R. Banister by warranty deed, and on June 19, 1989, E.R. Banister sold such property to Richard M. Allen by warranty deed. WHEREAS, Richard M. Allen claims title to such property through the former owners. WHEREAS, under the provisions of North Carolina General Statute Section 105- 376, New Hanover County is authorized to resell the property purchased at an execution foreclosure sale to the former owner or to any other person formerly having an interest in the property at private sale for an amount not less than the County's interest therein. WHEREAS, Richard M. Allen has agreed to transfer, his title, if any, to a portion of the property to CDC, and CDC has agreed to transfer title to a portion of the property to Richard M. Allen. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of New Hanover County that the County Manager is authorized to sell a portion of the property located at 808 Russell Alley (Parcel No. 31271541151000) to Richard M. Allen at private sale for an amount not less than the County's interest therein. Caster, Chairman ATTEST ~~/~~ C rk to the Board AN ORDER OF THE COUNTY OF NEW HANOVER, NORTH CAROLINA AMENDING THE WILMINGTON-NEW HANOVER COMPREHENSIVE LAND USE PLAN UPDATE (1997-2010) POLICY 4:10 LUP #09,05/00 THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN Section I That the Wilmington-New Hanover Comprehensive Land Use Plan, update Policy 4 10 adopted on September 7, 1999 be modified with additional language in bold, and the same is hereby further amended as follows: Not allowing new dredging activities in Primary Nursery Areas (PNA), Outstanding Resource Waters (ORW), or Shell fishing Waters (SA), except for the purpose of scientific research, designed for the purpose of protecting and enhancing water quality, and where supported by sound scientific and technical knowledge. Limited exceptions may be allowed for the urban waterfront and Wilmington's ports, consistent with the goals and objectives of the Cape Fear River Corridor Plan ('97) and the Downtown 2020 Plan ('98) and for the New Hanover County Mason Inlet Relocation Project as permitted by the Army Corp of Engineers. Section 2. Any order or any part of any order in conflict with this order, to the extend of such conflict, is hereby repealed. Section 3 This order is adopted in the interest of public health, safety, morals, and general welfare of the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from and after its adoption. Adopted this 10th day of July 2000 D~O~ William Caster Chairman Board of County Commissioners Attest: ~,~ ,Y~~~ lerk to the Board I ~ RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, after due advertisement, bids were received and publicly opened by the Finance Department at 11.00 a.m., on the 23rd day of May, 2000, at the County Administration Building, 320 Chestnut Street, Wilmington, North Carolina, and the following bids were received for the purchase and installation of mobile data terminals for the Sheriffs Department, Bid # 00-0348 Pomeroy Computer Resources $1,001,66000 $1,195,88400 Motorola, Inc. AND WHEREAS, the bid proposal submitted by Pomeroy Computer Resources did not include the following required costs and information which resulted in their bid being determined to be nonresponsive: a. The cost of the installation and programing of the radio modems; b. The information requested in the clarification regarding the ability to provide Motorola products was not provided, c. Costs to provide the interface module; AND WHEREAS, the bid submitted by Motorola, Inc. was higher that the amount budgeted for the purchase and staff negotiated with Motorola, Inc. in accordance with General Statue 143-129, resulting in a negotiated contract amount of one million sixty-seven thousand seven hundred ninety-six dollars ($1,067,796.00); AND WHEREAS, the Sheriff, the Information Technology Director, the Finance Director, and the County Manager recommend that the contract be awarded to Motorola, Inc., the only responsible bidder, in the amount of one million sixty-seven thousand seven hundred ninety-six dollars ($1,067,796.00); AND WHEREAS, the purchase of other related equipment and services will be necessary and costs for the related equipment and services are expected to be twenty-six thousand one hundred ninety-five dollars ($26,195 00) and purchase of these items are not part of the contract amount awarded to Motorola, Inc., AND WHEREAS, the contract with Motorola, Inc. in the amount of one million sixty-seven thousand seven hundred ninety-six dollars ($1,067,796.00) and the other related equipment and services in the amount of twenty-six thousand one hundred ninety-five dollars ($26,195 00) results in a total amount for the purchase and installation of mobile data terminals of one million ninety- three thousand nine hundred ninety-one dollars ($1,093,99100); ., AND WHEREAS, as per the attached budget amendment # 0 I -0002, funds approved for this purchase from FYOO are being transferred to FYOI budget and the remaining funds needed are being transferred from the 911 surcharge funds to Account No. 110-431-4312-6400,4210,3816 to cover this contract; additional funds in the budget amendment are to pay for remaining items needed to complete this phase of the project but are not part of the contract with Motorola, Inc., NOW, THEREFORE, BE IT RESOL VED by the Board of County Commissioners of New Hanover County that the contract for the purchase and installation of the mobile data terminals for the Sheriffs Department, Bid # 00-0348 be awarded to Motorola, Inc. in the amount of one million sixty-seven thousand seven hundred ninety-six dollars ($1,067,796.00); and that the County is hereby authorized and directed to execute contract # 00-0348, contract form to be approved by the County Attorney, related budget amendment # 01-0002 is approved, and staff is directed to purchase other related equipment and services in an amount of twenty-six thousand one hundred ninety-five thousand ($26,195.00); resulting in a total cost of one million ninety-three thousand nine hundred ninety-one thousand dollars ($1,093,99 I 00). COMBINED COLLECTION PERCENTAGE EXCLUDING BANKRUPTCIES AND APPEALS _ 98.05% RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, G.S. 143-129 allows local governments to buy off of another government's contract if the vendor is willing to provide the item at the same or better price; AND WHEREAS, the City of Rutherfordton, North Carolina formally bid the purchase of a pumper truck and awarded the bid to Pierce Manufacturing, Inc., the lowest of two (2) bidders, and bid award by the City of Rutherfordton to Pierce Manufacturing, Inc. (Triad Fire, Inc.sales agency) was made August 2, 1999; AND WHEREAS, Pierce Manufacturing, Inc. has offered to extend to New Hanover County the same pricing provided to the City of Rutherford ton, North Carolina to purchase the pumper truck, pricing as follows: Pumper Truck Pierce Manufacturing, Inc. $235,064.00 AND WHEREAS, the purchase of a fire pumper truck for the Ogden Volunteer Fire Department was approved in FYOO as an installment purchase transaction and the budgeted amount of two hundred fifty thousand dollars ($250,000 00) was borrowed through installment purchase financing for the purchase of the unit; AND WHEREAS, budget amendment #01-0003 transfers the funds received in FYOO through installment loan financing to FYO I, AND WHEREAS, the Fire Services Director, the Finance Director, and the County Manager recommend that the contract for a pumper truck for Ogden Volunteer Fire Station be awarded to Pierce Manufacturing, Inc., based on the price as contained in the award by the City of Rutherfordton, North Carolina, resulting in a total contract amount of two hundred thirty-five thousand sixty-four dollars ($235,06400); AND WHEREAS, through approval of budget amendment #01-0003 funds will be available in account number 130-436-4340-6450 to cover this contract; NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that the contract for a pumper truck for Ogden Volunteer Fire Station, be awarded to Pierce Manufacturing, Inc. in the amount of two hundred thirty-five thousand sixty-four dollars ($235,064.00); budget amendment # 01-0003 is approved; and that the County is hereby autborized and directed to execute contract # 00-0360, contract form to be approved by the County Attorney This 10th day of July, 2000 (SEAL) 'LJ~C ~ Chairman, Board of County Commissioners
