RESOLVED, that pursuant to the requirements of Chapter 109 of the North
Carolina General Statutes, the Board of Commissioners of New Hanover County, at its
regular meeting on December 4, 2000, approved the bonds of the Clerk IOf Superior
Court of New Hanover County, New Hanover County Finance Officer, Niw Hanover
County Sheriff, Register of Deeds of New Hanover County, and New Hahover County

Tax Collector and FURTHER RESOLVED, the Chairman of the Board of
Commissioners is hereby authorized, empowered and directed to certify said approval
of such Bonds, with the exception of the Bond of the Clerk of Superior Court, which is
not physically present in New Hanover County

Section I That the Wilmington-New Hanover Comprehensive Land Use Plan, update Policy 4.8

adopted on September 7,1999 be modified with additional language in bold, and the same is hereby
further amended as follows:
4.8 Allow the development of marinas, dry stack storage, and moorings as a means of providing
public access to the extent that their development shall not adversely effedt estuarine
resources or public trust waters. I
. Commercial marinas shall not be allowed in Primary Nursery Areas (PNA),

Outstanding Resource Waters (ORW), or open Shell fishing Waters (SA).
. Moorings and mooring fields shall not be allowed where they may hhve an adverse
effect on navigation channels. I
. Pumpout facilities shall be required for existing commercial marinas which have boats
containing enclosed heads.
Section 2. Any order or any part of any order in conflict with this order, to the extent of such conflict,
is hereby repealed. I
Section 3 This order is adopted in the interest of public health, safety, morals and general \velfare of

the inhabitants of the County of New Hanover, North Carolina, and shall be in full force and effect from
and after its adoption

Discourage the-development of undeveloped barrier and eSluarine system islands.
Continue the phased development and extension of the CoJ~ty Jwer system within the
urban services area as a means of eliminating water pollution ffom malfunctioning or
inadequate septic systems and package treatment plants. In Consbrvation and Resource
Protection areas an environmental review shall be required ~rior to sewer system
development or extension and no additional density shall be allowed in these areas. Planned
Residential Development, Planned Unit Development and oth~r methods of cluster

development shall be encouraged to allow greater design flexibili!)'
Allow only tertiary sewage treatment plants of the highest qUalJ, whose standards of
operation provide the greatest measure of water quality protection, to discharge into public
surface waters; and then only if it is not feasible to connect to the p'ublic sewer system, or
as an alternative, on or off-site land application located away fron\ surface waters.

Allow uses of estuarine and public trust waters that provide benefits to the public and which
satisfy riparian access needs of private property owners. In tidal J,aters, docks shall be
limited to the minimum necessary to provide riparian access to waterfront property owners

Not allow new dredging activities in Primary Nursery Areas (PNA), Outstanding Resource
Waters (OR W), or Shellfishing Waters (SA) , except for the purpose of scientific research,
designed for the purpose of protecting and enhancing water quality, and where supported
by sound scientific and technical knowledge. Limited exceptions may be allowed for the
urban waterfront and Wilmington's ports, consistent with the goalstand objectives of the
Cape Fear River Corridor Plan (J 997) and the Downtown 2020 Plan (1998) and for the New
Hanover County Mason Inlet Relocation Project as permitted by th~ U.S. Army Corps of
Engineers. I
Clearcutting or mowing of coastal wetland vegetation within any coastal wetland AEC shall
not be allowed.

Program to make federal contracts to assist local governments in the improvement of high\~ay safety,
