NEW HANOVER COUNTY BOARD OF COMMISSIONERS
PROCLAMATION
WHEREAS, the League of Women Voters-United States, hereafter known as L WV -US
was founded upon the passage of the 19th Amendment to the Constitution of the United States
for the expressed purpose of educating women in the use of their voting rights; and
WHEREAS, the L WV -US quickly became an organization to which all voters could turn
for information about issues, voting procedures and/or any aspect of the political process; and
WHEREAS, The League ofW omen Voters is organized on the local, state and national
levels so they may serve voters in every political jurisdiction which affects them; and
WHEREAS, the LWV (consisting ofLWV-US and all state and local Leagues) never
endorses or opposes candidates, politicians or political parties, but encourages each member to
become as politically active and/or partisan as he or she sees fit; and
WHEREAS, the L WV is actively concerned with encouraging all adults over the age of
18 to register to vote and to educate themselves on both sides of issues before they vote; and
WHEREAS, the LWV of New Hanover County has been faithfully serving this region
for twenty-five years and will celebrate its twenty-fifth birthday on April 25, 1999;
NOW, THEREFORE BE IT PROCLAIMED by the New Hanover County Board of
Commissioners that Sunday, April 25, 1999 be declared League of Women Voters Day in New
Hanover County in order that all may know and appreciate the work and community service that
has been accomplished by this group in our county

Appreciation Week for
County Departments of Social Services Employees
April 18-24, 1999
WHEREAS, dedicated men and women in the New Hanover County
Department of Social Services provide services and support for thousands of our
citizens; and
WHEREAS, these Social Services professionals accomplish many goals in their
life's work; they provide [mancial and medical assistance for those unable to meet
basic needs; protect children, older adults and the disabled; guide the needy toward
self-sufficiency through education and job placement; offer services to children, older
adults and the disabled that enhance their quality of life; and provide administrative
support for program operations; and
WHEREAS, these Social Services professionals are dedicated to improving the
quality of hfe for the citizens of this County They also strive to improve the delivery
of services and to operate social services programs as efficiently and effectively as
possible;
NOW, THEREFORE BE IT RESOLVED THAT the New Hanover County
Board of Commissioners proclaims the week of April 18-24, 1999, "APPRECIATION
WEEK FOR COUNTY DEPARTMENTS OF SOCIAL SER VICES EMPLOYEES"
in New Hanover County, and urge our citizens to recognize these professionals and
commend them for their efforts.

PROCLAMA TION
WHEREAS, the week of April 18-24, 1999 has been proclaimed Volunteer Week
in North Carolina; and
WHEREAS, volunteers do the greatest works in the smallest gestures, without
expectations of financial reward, because they care about people and the community
in which we live; and
WHEREAS, New Hanover County recognizes the value of volunteers who assist
in providing county government services and related programs, resulting in an
estimated savings to our taxpayers of $13.74 per hour; and
WHEREAS, New Hanover County also recognizes the crucial role of volunteers
in non-countyorganizations within our communities for they help make a difference in
people's lives through their work; and
WHEREAS, 1999 is the 2f!' annual National Volunteer Week celebration;
NOW, THEREFORE, BE IT RESOL VED that the New Hanover County Board
of Commissioners proclaims April 18-24, 1999 to be Volunteer Week; and, BE IT
FURTHER RESOL VED that New Hanover County commits to further supporting and
enhancing the networks and partnerships related to volunteer programs throughout our
county, e~pecially those programs targeting children and youth at risk.

RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, New Hanover County has advertised and bid certain clearing
and grading work constituting a portion of Phone 1-A of the Pilot's Ridge School
Project, more specifically being site work in preparation for construction of the Middle
School/High School/Art Center; and
WHEREAS, contract and construction management can be facilitated and
maximized by the County assigning the bid to the Board of Education, such that the
Board of Education would enter directly into an agreement with the acceptable lowest
responsible bidder; and
WHEREAS, by an assignment of bid the Board of Education and County can
eliminate the necessity of a further funding transfer
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of
Commissioners that the above-referenced Phase 1-A Pilot's Ridge bid is hereby
assigned to and for the benefit of the New Hanover County Board of Education, subject
to acceptance and approval of said assignment by the Board of Education.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, G.S. 143-129 allows local governments to buy off of another government's
contract if the vendor is willing to provide the item at the same or better price;
AND WHEREAS, the City of North Miami Beach, Florida formally bid the purchase of a
Computer Aided Dispatch (CAD) System, a Records Management Systems (RMS), Mugshot
Software, and Mobile Units and Open Software Solutions, Inc. was awarded the bid by the City of
North Miami Beach, Florida;
AND WHEREAS, the Albemarle-Charlottesville Regional Jail Authority in Virginia formally
bid the purchase of a Jail Records Management System and Open Software Solutions, Inc. was
awarded the bid by the Albemarle-Charlottesville Regional Jail Authority in Virginia;
AND WHEREAS, Open Software Solutions, Inc. has offered to extend to New Hanover
County pricing based on the contract with the City of North Miami Beach and the Albemarle-
Charlottesville Regional Jail Authority to purchase a Computer Aided Dispatch (CAD) System, a
Records Management Systems (RMS), Mugshot Software, Mobile Units and a Jail Records
Management System in the amount of Seven Hundred Sixty-five Thousand Two Hundred Seventy-
nine Dollars ($765,279 00);
AND WHEREAS, the Sheriff, the Finance Director, and the County Manager recommend that
the contract for the replacement of the existing systems atthe Sheriffs Department and Jail be awarded
to Open Software Solutions;Inc., pricing extended to New Hanover County based on the contract with
the City of North Miami Beach, Florida and the Albemarle-Charlottesville Regional Jail Authority in
Virginia, resulting in a total contract amount of Seven Hundred Sixty-five Thousand Two Hundred
Seventy-nine Dollars ($765,279 00) with Open Software Solutions, Inc.,
AND WHEREAS, replacement of existing computer hardware, other related equipment and
services will be necessary and costs for the purchase of the hardware equipment, other related
equipment and services are expected to be One Million Two Hundred Ninety-six Thousand Three
Hundred Sixty-nine Dollars and Eighty-one Cents ($1,296,369.81) and purchase of computer
hardware, other related equipment and services is not part of the contract amount awarded to Open
Software Solutions, Inc.,
AND WHEREAS, the contract with Open Software Solutions, Inc. in the amount of Seven
Hundred Sixty-five Thousand Two Hundred Seventy-nine Dollars ($765,27900) and the other
computer hardware, other.related equipment and services in the amount of One Million Two Hundred
Ninety-six Thousand Three Hundred Sixty-nine Dollars and Eighty-one Cents ($1 ,296,369.81) results
in a total amount for the project of Two Million Sixty-one Thousand Six Hundred Forty-eight Dollars
and Eighty-one Cents ($2,061,648.81);
AND WHEREAS, funds are available in the 911 surcharge funds to upgrade the Sheriffs
existing Emergency 911 System and budget amendment # 99-0125 transferring the funds to the
Sheriff's Department to purchase the upgrade and replace existing hardware is attached;
AND WHEREAS, the portion of the contract for the Sheriff's Department that is not CAD
related will be purchased with installment financing through an existing agreement with Bank One and
budget amendment # 99-0125.recognizirig the proceeds from the installment financing and budgeting
the payment portion required for this fiscal years budget is attached;
AND WHEREAS, the portion of the contract for the Fire Services Department will be
purchased through the Fire Service District budget and budget amendment # 99-0125 transferring
funds in the Fire District's Budget is attached;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the contract for the replacement of the existing systems at the Sheriffs
Department and Jail be awarded to Open Software Solutions, Inc. in the amount of Seven Hundred
Sixty-five Thousand Two Hundred Seventy-nine Dollars ($765,27900); and that the County is hereby
authorized and directed to execute contract # 99-0313, contract form to be approved by the County
Attorney; related budget amendment # 99-0125 is approved; and staff is directed to replace computer
hardware, other related equipment and services in an amount of One Million Two Hundred Ninety-six
Thousand Three Hundred Sixty-nine Dollars and Eighty-one Cents ($1 ,296,369.81); resulting in a total
project cost of Two Million Sixty-one Thousand Six Hundred Forty-eight Dollars and Eighty-one
Cents ($2,061,648.81).

IN SUPPORT OF THE HEAL THY CAROLINIANS GOALS
WHEREAS, there is no ongoing funding to support the Healthy Carolinians initiative in individual
counties; and
WHEREAS, there is a lack of significant progress to formalize collaboration between all the
necessary partners in most North Carolina counties; and
WHEREAS, the Healthy Carolinians Goals are deemed worthwhile and beneficial to the citizens
of the State of North Carolina; and
WHEREAS, achieving the goals of Healthy Carolinians will improve health indices leading to
longer, healthier more productive lives for our citizens; and
WHEREAS, one dollar spent in preventive medicine methodologies such as Healthy Carolinians
results in anywhere from three to ten dollars saved from treatments averted, and
WHEREAS, many fledgling Healthy Carolinians Task Forces may wither on the vine without
solid, ongoing funding; and
WHEREAS, the proposed legislation would provide the basis for continued growth and stabilization
of the needed collaboration that will bring the Health Carolinians effort to fruition,
THEREFORE BE IT RESOLVED, the New Hanover County Board of Commissioners
wholeheartedly supports the proposed legislation and urges New Hanover County's state legislative
delegation to support it, and any other public health organization or association to support it as well.

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that Chapter 3, Animals and Fowl, Article II, Dangerous Dog/Potentially Dangerous Dog,
Sections 3-25, 3-26, 3-27, 3-28, and 3-29 of the New Hanover County Code be amended as
follows:
1 Section 3-25, Definitions, shall read:
Sec. 3-25. Definitions.
As used in this article, unless the context clearly requires otherwise, and except as
modified in subsection (b) of this section, the term:
(1) Dangerous dog means:
a. A dog that without provocation has killed or inflicted severe injury on a
person; or
b. Any dog owned or harbored primarily or in part for the purpose of dog
fighting, or any dog trained for dog fighting.
(2) Potentially dangerous dog means a dog that
a. Inflicted a bite on a person that resulted in broken bones or broken skin
or required cosmetic surgery or hospitalization; or
b. Killed or inflicted severe injury upon a domestic animal when not on the
owner's real property; or
c. Approached a person when not on the owner's property in a vicious or
terrorizing manner in an apparent attitude of attack.
(3) Owner means any person or legal entity that has a possessory property right in a
dog.
(4) Owner's real property means any real property owned or ieased by the owner of
the dog, but does not include any public right-of-way or a common area of a
condominium, apartment complex or townhouse development.
(5) Severe injury means any physical injury that results in broken bones or
lacerations or required cosmetic surgery or hospitalization, the cost of said
medical treatment exceeding One Hundred Dollars ($100 00).
(6) Secure enclosure means a padlocked pen, with a concrete bottom and a
secured top and/or a locked home or locked outbuilding with a concrete bottom.
(7) Dog means any male or female member of the order of Genus Canis.
2. Section 3-26, formerly entitled "Applications," shall read:
Sec. 3-26. Exclusions.
The provisions of this article do not apply to:
(1) A dog being used by a law enforcement officer to carry out the law enforcement
officer's official duties;
(2) A dog where the injury or damage inflicted by the dog was sustained by a
domestic animal while the dog was working as a lawful hunting dog, herding dog,
or predator control dog on the property of, or under the control of, its owner or
keeper and the damage or injury was to a species or type of domestic animal
appropriate to the work of the dog; or
(3) A dog where the injury was inflicted by the dog was sustained by a person who,
at the time of the injury, was committing a willful trespass or other tort, was
tormenting, abusing, or assaulting the dog, or had tormented, abused, assaulted
the dog or was committing or attempting to commit a crime
3. Section 3-27, Procedure, shall read:
Sec. 3-27. Procedure.
(a) The New Hanover County Board of Health will appoint a committee of two (2)
people who will be responsible for determining when a dog is a "dangerous" or
"potentially dangerous dog." When making the determination that a dog is a
"dangerous dog" or a "potentially dangerous dog," Animal Control Services must
notify the owner in writing, giving the reasons before the dog may be considered
dangerous or potentially dangerous under this article. The Committee shall
consider any written response by the owner to the written notification. If there is
a split decision, the Chairman of the Board of Health or his designee will make
the final determination. Once a decision has been made, the owner must
provide Animal Control with a current address where the dog will be housed,
notify Animal Control within forty-eight (48) hours of any change in address of
the owner or the dangerous dog, and follow all State laws and County ordinance
dealing with dangerous or potentially dangerous dogs until all appeals have been
exhausted and a final decision rendered or no appeal is requested and the
decision is final.
(b) The owner may appeal the determination of a dangerous dog or potentially
dangerous dog. Notice of appeal is by filing written objections with the Appellate
Board within ten (10) business days after receiving written notice together with
such Appellant's filing fees as may be established by the New Hanover County
Board of Health. The Appellate Board shall, within ten (10) business days of the
filing of the appeal, schedule a hearing. Until the appeal is final, the dog must be
controlled and confined pursuant to the ruling from which the appeal was taken.
Any appeal from the final decision of such Appellate Board shall be taken to
Superior Court by filing notice of appeal and a petition for review within ten (10)
business days from the final decision of the Appellate Board.
(c) Appeals from ruling of the Appellate Board shall be heard in Superior Court. The
appeal shall be heard as a review of the record and not de novo before a
Superior Court Judge sitting in New Hanover County
4 Section 3-28, Precautions Against Attacks by Dangerous Dogs/Potentially Dangerous
Dogs, shall read:
Sec. 3-28. Precautions Against Attacks by Dangerous or Potentially Dangerous
Dogs
(a) If so ordered in the determination made pursuant to Section 3-27, it is unlawful
for an owner to:
(1) Leave a dangerous dog/potentially dangerous dog unattended on the
owner's real property unless the dog is confined indoors, in a securely
enclosed and padlocked pen, with a concrete bottom and a secure top,
along with the posting of the premises with four (4) clearly visible warning
signs adequate to inform the public, including children, of the presence of
a dangerous dog, and strategically placed on the property as designated
by the appropriate County authority
(2) Permit a dangerous dog/potentially dangerous dog to go beyond the
owner's real property unless the owner or guardian has the dog leashed
and the leash in hand and the dog muzzled or is otherwise securely
restrained and muzzled.
(3) Even in the presence of an owner or others, permit a dangerous
dog/potentially dangerous dog on the owner's property, not confined in a
secured enclosure, to be without a muzzle.
In the Section 3-27 determination, any of the foregoing measures may be waived by the
Committee or the Appellate Board, or other similar measures or conditions may be
substituted in their place.
(b) Within seven (7) days after a dangerous dog/potentially dangerous dog
determination becomes final, the owner must have the dangerous dog/potentially
dangerous dog tattooed with an identification number of micro-chip identification
as directed by the Animal Control Director on the inside of the right hind leg.
Within seventy-two (72) hours of the death of a dangerous dog/potentially
dangerous dog, the owner of the dog shall provide written notification of the
dog's death to the Animal Control Services. If the dog's body is not available, the
notification shall fully identify the dog and shall bear the notarized signature of
the owner and a licensed veterinarian, all attesting to the dog's death.
(c) If the owner of a dangerous dog/potentially dangerous dog transfers ownership
or possession of the dog to another person, the owner shall provide written
notice within forty-eight (48) hours to:
(1) The authority that made the determination under this article, stating the
name and address of the new owner or possessor of the dog; and
(2) The person taking ownership or possession of the dog, specifying the
dog's dangerous behavior and the authority's determination.
(d) The person taking ownership of the dog shall notify Animal Control Services
within forty-eight (48) hours of the dog's change of address and their knowledge
of the Committee's determination.
(e)
Violation of this section is a misdemeanor punishable by a fine not to exceed
Five Hundred Dollars ($500.00) or imprisonment for not more than thirty (30)
days or both.

5 Section 3-29, formerly entitled "Euthanizing Dangerous Dogs/Potentially Dangerous
Dogs," shall read:
Sec. 3-29. Violation of Conditions; Euthanization.
(a) Animal Control Services may take possession of any dog concerning whom it
has cause to believe an owner has violated section 3-28 For this purpose, the
requirement for sufficient cause shall be satisfied if an officer observes the
violation or if Animal Control Services obtains an affidavit setting forth the
violation. An owner who violates Section 3-28 in a willful or grossly negligent
manner may be found by the Committee to have forfeited all rights of ownership
of the dog, and upon a final determination of such violation the dog may be
humanely euthanized by Animal Control. The Committee or Board responsible
for determining that the dog is dangerous/potentially dangerous shall determine
whether the owner's violation was willful or grossly negligent, and the Committee
or Board must notify the owner in writing, giving the reasons for the
determination, before the dog may be euthanized. The Committee or Appellate
Board, rather than ordering euthanasia, may impose other conditions, including
but not limited to any conditions enumerated in Section 3-28(a). The owner may
appeal the determination by filing written objections with the Appellate Board
within five (5) days of receipt of the notice The Appellate Board shall schedule a
hearing within ten (10) days of the filing of objections. Any appeal from the final
decision of such Appellate Board shall be taken to the Superior Court by filing
notice of appeal and a petition for review within ten (10) days of the final decision
of the Appellate Board.
(b) Appeals from rulings of the Appellate Board shall be heard in Superior Court.
The appeal shall be heard as a review of the record before a Superior Court
Judge sitting in New Hanover County
Except as specifically amended above, Chapter 3 shall remain unaltered and in full force
and effect.

BOARD OF COMMISSIONERS
WHEREAS, New Hanover County has advertised and bid certain clearing and
grading work constituting a portion of Phase 1-A of the Pilot's Ridge School Project,
more specifically being site work in preparation for construction of the Middle
School/High School/Art Center; and
WHEREAS, contract and construction management can be facilitated and
maximized by the County assigning the bid to the Board of Education, such that the
Board of Education would enter directly into an agreement with the acceptable lowest
responsible bidder; and
WHEREAS, by an assignment of bid the Board of Education and County can
eliminate the necessity of a further funding transfer
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of
Commissioners that the above-referenced Phase 1-A Pilot's Ridge bid is hereby
assigned to and for the benefit of the New Hanover County Board of Education, subject
to acceptance and approval of said assignment by the Board of Education.

was founded upon the passage of the 191h Amendment to the Constitution of the United States

COMMUNITY DEVELOPMENT CORPORATION (CDC)
RESOLVED:
1 The New Hanover County Commission hereby approves the conveyance of the lot
located at 808 Russell Alley to WilmingtonlNew Hanover County Community
Development Corporation (CDC) for the construction of single family, owner-
occupied residence.
2. The conveyance shall be subject to the condition that the lot be used to construct
single family, owner-occupied residences for low to moderate income citizens in
accordance with requirements adopted by resolution on April 19, 1994 and passage
of a similar resolution of conveyance by the City of Wilmington.
3 The deed for conveyance for the lot shall not be delivered until ten days after notice
of the conveyance has been advertised, as required by G.S 160A-267

Please take notice that the Wilmington City Council adopted a resolution dated April 6,
1999 and the Board of Commissioners of New Hanover Council adopted a resolution on April 19,
1999 authorizing the conveyance by private sale to the Wilmington/New Hanover County

Whereas, Anthony W Wade became Director of New Hanover Connty's Human Relations
Commission on July 5, 1995; and
Whereas, since that day Mr. Wade has worked diligently and tirelessly to improve human relations
among all citizens of New Hanover Connty; and
Whereas, Mr. Wade, the staff, and members of the Human Relations Commission have been
instrumental in the Towns ofWrightsville Beach, Kure Beach and Carolina Beach adopting ordinance. which
afforded their re.ident. local access to redress employment i.sue. via coverage nnder the New Hanover Connty
Fair Employment Ordinance; and
Whereas, Mr. Wade'. development and he and his staff's eloquent presentation of the Sexual
Haras.ment in the Workplace training program has received wide acclaim; it has been presented to hnndreds
of public and private sector employees, managers, supervisors, national and state human rights and equal
employment agency officials, other organizations such as the N C. Association of Mnnicipal Clerks; and is
being reque.ted by employers, employment organizations and local government entities throughout the
nation; and
Wherea., Mr. Wade employed a "management by example" approach to accomplishing the goals of
the New Hanover Human Relations Commission with personal involvement and membership in
organizations such as Commission for Women, Coastal Horizons, Committee for the Deaf & Hard of
Hearing, Organization for Latin American., Tapestry Theatre, 1898 Centennial Commission and its
Pariners for Economic Inclusion Subcommittee, National As,ociation for the Advancement of Colored
People and manv other.; and
Wherea., Mr. Wade has accepted an offer of employment in Denver, Colorado,
NOW HEREBY BE IT RESOLVED, THAT the New Hanover Connty Board of Commissioners
expresses its gratitude and appreciation of Anthony W Wade'. facilitative leadership, objectivity, and ability
to understand and address sensitive issues in a superb and extremely professional manner among diverse
populations of our commnnity; his leadership has resulted in the New Hanover Human Relations
Commission becoming a proactive agent for change in our commnnity; he has mentored a .taff of
profes.ional. who will continue such great work in our commnnity; Anthony W Wade has been an invaluable
