HomeMy WebLinkAbout12/06/1972 O~3 MINUTES OF BOARD OF HEALTH MEETING - December 6, 1972 Present: Dr. James Smith, Vice Chairman, Dr. Frank Reynolds, Mr. R. E. Carter, Mr. John Oxenfeld and Mr. James Fox, Attorney .......... Dr. Reynolds made the motion, seconded by Mr. Carter, that the minutes of the September, October and November meetings be approved. Motion carried. New Board Members: A letter of resignation from the Board of Health by Mr. H. A. Marks was read. Mr. Oxenfeld made the motion that we accept this resignation with regrets and that a letter of appreciation be written to Mr. Marks. Mr. Carter seconded the motion, motion carried. Mr. Oxenfeld, on December 4, as chairman of the County Commissioners became an ex-officio member of the Board of Health - this left the two positions vacant that were added to the Board of Health by a request from the Board of County Commissioners that two "Interested citizens" be added to the Board. Mr. Fox advised that we have an official Board without these two members. It was suggested that Mr. Oxenfeld study the matter and that we wait and see what the new commissioners want done about these two positions before we fill them. Ordinance to Control and Restrain the Spread of Infectious Diseases: Copies of this ordinance had been sent to the members of the Board of Health for study. Dr. Reynolds made the motion that the ordinance be passed - motion was seconded by Mr. Carter and carried. The ordinance is to be made effective January 1, 1973 and is to be published in the newspaper and posted on the court house door. The ordinance as adopted is as follows: Be it ordained by the Board of Health of New Hanover County: -. SECTION 1. To protect the general health of the public, to control, deal with and prevent the introduction of contagious, infectious diseases, to control and restrain the spread of epidemics, and to determine and isolate the sources of disease and infection, every person, firm or corporation carrying on or engaged in any business, trade or profession set forth in Section 2 hereof, shall comply with all terms and provisions of this ordinance. SECTION 2. This ordinance shall apply to every person, firm or corporation: (a) Operating a licensed hospital, nursing home, sanitarium, or medical office. (b) Engaging in the practice of physical therapy, medicine, chiro- practic, osteopathic, registered or practical nursing. (c) Operating a massage parlor, reducing salon, health salon, or physical culture studio. (d) Engaging in an occupation requiring continued physical contact with or manipulation of the human body. -'"~ SECTION 3. Each person, firm or corporation designated in Section 2 hereof shall maintain a correct and accurate record of the name and address of each patient or customer receiving treatment or physical manipulation by such person, firm or corporation, or an employee, agent or representative thereof, the date of such treatment or manipulation, and the name of the person administering such treat- ment or who is in continued physical contact with or manipulation of the body of "" . 00574 such patient or customer. Said records shall be subject to inspection at any time by any employee of the Board of Health of New Hanover County. SECTION 4. If any person shall violate this ordinance, he shall be guilty of a misdemeanor, and fined not exceeding $50.00 or imprisoned not exceeding thirty (30) days, in the discretion of the court. If any corporation shall violate this ordinance, each management officer of such corporation shall be guilty of a misdemeanor, and fined not exceeding $50.00 or imprisoned not exceeding thirty (30) days, in the discretion of the court. SECTION 5. If any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance. SECTION 6. This ordinance shall be effective on and after the 1st day of January, 1973. There being no further business the meeting was adjourned. .
