MINUTES OF BOARD OF HEALTH MEETING - December 14, 1977
Present: All Members of the Board, Mr. James Fox, Attorney, and Mr. Dan
Eller, County Manager
Absent: None
Minutes of the November meeting were approved with one addition. Mrs. Wright
asked that a sentence be added to the paragraph on Teenage Pregnancies stating
"Mrs. Wright stated that she did not approve of the Board of Health passing
such a resolution, that she felt this was a moral question".
Septic Tank Ordinance. Attorney James Fox and Frank Olive, Sanitarian Director
compared the new State Ordinance with the ordinance now in effect in New
Hanover County and had mailed copies of a suggested ordinance to Members of the
Board for study and possible adoption. Mr. Melvin made a motion that the
ordinance be adopted as presented. Motion was seconded by Mrs. Hall and
carried unanimously. Copy of this Ordinance will be posted and published.
A copy is attached to these minutes as a permanent record.
Grievance Policy' A suggested Grievance Policy for the Board of Health had
been drawn up by Gary Cannon, County Personnel Officer. This ordinance is
much the same as the one already in effect except that it is more specific.
Motion was made by Dr. Seidel, seconded by Mr. Melvin, that this Grievance
Policy, which had been mailed to board members in advance, be adopted.
Motion carried. A copy is attached to these minutes as a permanent record.

WIC Program: Dr. Furr reported that his committee was not ready to give a full
report. He said they had still not determined whether or not there is a need
in New Hanover County for this type of program. He stated that before their
final recommendation to the Board the public will be allowed to speak.
Report of Committee to study Sewage Disposal for New Hanover County: Mr Reaves
reported that his committee had contacted a number of builders, developers,
installers of septic tanks, etc. for comments and all reports are not in at
this time.
Computer Programs: Dr. Finger asked the board for permission to enter the
EPSDT Program and Personnel Time and Cost Accounting on the computer. The
EPSDT Program is put on the computer in Raleigh already and this would just
mean it would be put on by our office instead. Mr. Carter made a motion that
permission be granted to put these two programs on the computer. Motion was
seconded by Mr. Melvin. Mr. Wright asked that the two programs be voted on
separately. On the EPSDT program, all members voted yes except Mrs. Wright
who voted No On Personnel Time and Cost Accounting all members voted Yes.
Marker for Thomas F. Wood, M. D.: Dr. Finger read a letter to the Board from
the North Carolina Department of Cultural Resources, Division of Archives and
History, stating that a marker to Dr. Thomas F Wood would be erected in Wil-
mington near the intersection of Third and Chestnut streets. The inscription
is' "Thomas F. Wood, 1841-1892 - Organizer and Secretary-Treasurer of State
Board of Health, 1877-1892 - Founded N. C Medical Journal in 1878. Home was
1 block west."

Resolution on Sex Education in the Schools Dr. Seidel made a motion that the
Board of Health pass a resolution endorsing a family development course,
parenting education, dimensions of living. A comprehensive course, the con-
tents of which would be determined by their own school curriculum advisory
committee, which is considering these problems anyway. This course to
obviously include giving increasing knowledge of self, understanding bodily
functions, their growth and development, their personality development - so
that they understand family structure, their role in families, their respon-
sibilities as parents, what parenting is all about, and the morals of it.
He stated that he was concerned with the health aspect of teenange pregnancies
and welfare cost, not the morals. He also read endorsements of such a program
in the schools from two churches in Wilmington.

Mrs. Wright stated that she is interested in welfare costs but mainly the
morals. She also stated that there are 140 churches in Wilmington and only
two have been heard from. She also stated that this is a Board of Health,
not the Board of Education. Also, she stated her concern that teachers are
chosen by morals and that this type of teaching in the wrong hands could
be very destructive.
Mr. Melvin expressed the op1n1on that there is a great need for this type of
education - that many teenage pregnancies occur in daughters of unmarried
mothers who are unable to educate their children because they are not educa-
ted themselves.
Mr. Glenn Moore spoke next stating that she is the mother of six and that she ~
feels this type of education does not belong in the schools but in the homes
and churches. She feels it is a moral issue.

Mata Lahmann suggested floating teachers who had been well trained.
Mrs. Doris Pierce, mother of eight and grandmother of three, begged the board
not to "endorse the unknown". Rev. J. C. Wallace stated that if this was
taught in the schools he would have to take his children out of school and
this would result in his being jailed. Dr. Furr made a motion to table the
motion stating that he needed much more information before he was willing to
vote on this issue. Motion was seconded by Mr. Melvin. All voted yes except
Dr. Seidel who voted No.
Dr. Reynolds last Meeting' Dr. Reynolds told the Board that he had enjoyed
being a member of the Board and appreciated the cooperation during his year
as Chairman of the Board. He expressed fear that the Board of Health would
become political.
There being no further business, the meeting was adjourned.

GRIEVANCE POLICY
FOR NEW HANOVER COUNTY
HEALTH DEPARTMENT
PURPOSE
In the continuing effort to provide and maintain the best possible conditions of
work for all New Hanover County Health Department employees and to improve harmo-
nious relationships among all its staff, the management of New Hanover County
Health Department encourages the prompt, fair settlement of problems and differ-
ences through an orderly appeals procedure.
POLICY
Every employee shall have the right to present his problem or grievance in accord-
ance with these procedures, with or without a representative of his own choosing,
free from interference, coercion, restraint, discrimination, penalty, or reprisal.
This includes any cause for dissatisfaction outside the employee's control or
anything connected with his job that he thinks or feels is wrong. Every employee
will be allowed such time off from his regular duties as may be deemed by management
to be necessary and reasonable for the processing of a grievance under these pro-
cedures without loss of pay, vacation, or of other time credits.
OBJECTIVES:
The objectives of this policy include the following:
(a) To assure employees of a means to get their problems or complaints
considered rapidly, fairly, and without fear of reprisal.
(b) To encourage employees to express themselves about .how their con-
ditions of work affect them as employees.
(c) To provide better understanding of policies, practices, and pro-
cedures which affect employees.
(d) To provide supervisors with greater opportunity both to exercise
proper responsibility in dealing with employees and to improve
their effectiveness in carrying out established policies.
(e) To improve opportunities for all staff members to perform their
duties with effectiveness and satisfaction.
We are deeply committed to the principle of equal opportunity for all employees
and applicants for employment without any discrimination against any employee or
applicant because of race, color, religion, national origin, sex, age, or physical
or mental impairment. This policy of non-discrimination applies to recruitment
of employees and to treatment during employment (including rates of pay, selec-
tion for training, upgrading, promotion, demotion, transfer, suspension, and dis-
missal). The New Hanover County Health Department is determined to make every
effort to see to it that no employee is subjected to unfair treatment for
whatever reason.

To encourage clear understanding and to reduce fears or false impressions of
unfair treatment, personnel policies include the following provisions.
(a) Employees and their supervisors are urged to communicate freely
with one another concerning conditions of employment, such as
job requirements, hours of work, vacation and leave allowances,
promotions, rates of pay, and the like. Supervisors should keep
themselves well informed on personnel policies and practices,
making use of the New Hanover County Personnel Office and the
Department of Human Resources as often as necessary for this
purpose.
(b) No action involving demotion, suspension, or dismissal is to be
taken against any employee for disciplinary reasons until such
disciplinary action has been recommended to and approved by the
next higher level of management, except when, in the judgment of
the employee's supervisor, immediate suspension is necessary to
protect the safety of persons or property. In no case sh?uld an
employee be dismissed without approval of the Director of the New
Hanover County Health Department.
The procedure shall consist of the following steps:
STEP 1 - DISCUSSIONS BETWEEN EMPLOYEE AND IMMEDIATE SUPERVISOR
The employee who has a problem or grievance will discuss it first with
his immediate supervisor. The supervisor may call higher level supervisors
into the discussion if the employee agrees. Or, the supervisor may consult
with hi~her level supervisors to seek any needed advice or counsel from his
administrative superiors before givin~ any answer.
The employee shall receive an answer as soon as possible but not later than
five working days after the grievance is presented to the supervisor, or be
advised as to the conditions which prevent an answer within five working
days and be informed as to when an answer may be expected.
STEP 2 - APPEAL TO THE DIRECTOR
If the decision is not sufficiently satisfactory to the employee in Step I,
or if he fails to receive an answer within the period provided in Step 1,
he may request the Personnel Officer for the New Hanover County Health Depart-
ment to consider the matter. The request may be presented either in person
or in writing but must be presented within five working days after receipt of
the Step 1 decision. Depending on the nature of the appeal, the Personnel
Officer will determine to what extent facts will be required in writing.
The supervisor and employee shall provide all pertinent information to the
Personnel Officer, who will review the facts and hold whatever discussions
he deems desirable or the employee or supervisor may request.
(a) After all necessary discussions are held, the Personnel Officer shall
forward all pertinent information and his recommendation to the Director
of the Health Department. The Director will review the facts with the
Personnel Officer and seek any other sources of information or consulta-
tions he may desire. At this step arrangements will be made for the
employee to review his case with the Director, if the employee so desires.
The Director will make a decision within five working days after the

grievance has been presented to him and his decision will be
announced immediately to all parties concerned. If the nature
of the appeal is such as to involve formulation of policy or
modification of existing policy, the Director may refer the matter
to the New Hanover County Personnel Office for advice before reach-
ing a decision.
(b) If the decision reached by the Director is not acceptable to the
employee, he may request that his case be presented to the New
Hanover County Board of Health for its consideration. This request
should be made through the Director. Facts surrounding the case
will be presented to the Board of Health at the next meeting,
provided that the request for hearing was filed within IO days of
the next Board meeting. After reviewing the data, the Board of
Health will consult with whatever other sources it deems appropriate
and shall render a decision to all parties concerned within five (5)
working days after having heard the appeal.
STEP 3 - APPEAL TO THE SECRETARY, DEPARTMENT OF HUMAN RESOURCES

If the decision reached in Step 2 is not satisfactory to the employee, he
may request, within five working days of receipt of the Board of Health's
decision, a hearing by the Department of Human Resources' Regional Griev-
ance Committee. The employee's request should be filed through the
Department's Personnel Officer. The Regional Grievance Committee shall
consist of either three or five employees appointed by the Regional
Manpower Director from within the respective regional boundaries but
shall not include an employee from the New Hanover County Health Department.
The Committee shall be responsible for determining that the evidence or
questions are all-inclusive, the records accurate, the proceedings fair,
and shall make their recommendations, within five working days after the
hearing, to the SECRETARY, Department of Human Resources.
The Secretary, and staff members he deems necessary, will review the recommen-
dations of the Regional Committee. If the facts and circumstances appear
relevant and all-inclusive, a decision will be made within five working days
following receipt of the recommendations. If the Secretary feels that more
evidence or explanation is necessary or if he feels the best interest would
be served through a personal discussion with the aggrieved employee, a
decision will be delayed not more than five additional working days so that
a best judgment decision can be made. Decisions at this step will be for-
warded to the Regional Manpower Director for implementation.
STEP 4 - APPEALS TO STATE PERSONNEL BOARD
If the employee is not satisfied with the decision rendered, he may request,
within five working days of receipt of the decision, a public hearing by the
State Personnel Board. In cases of dismissal, the appeal shall be filed in
writing to the State Personnel Director not later than 30 days after the
effective date of dismissal. His request should be filed through the Depart-
ment Personnel Officer. If the employee so desires, he may ask the Department
for help in submitting his appeal in writing. The date and time for the
employee's meeting with the State Personnel Board will be determined by the
State Personnel Director. The date will be set as early as possible after the
request is received from the employee. The State Personnel Director will

determine the parties deemed necessary for the hearing and request their
presence. The State Personnel Board, within five working days after the
hearing, shall make its recommendation to the Secretary, Department of
Human Resources. After considering the Board's recommendation, the
Secretary shall make his decision and shall notify the parent division
and the employee in writing of that decision.
By written agreement between the State and the Federal grantor agencies,
the Department of Human Resources will comply with the recommendations
of the State Personnel Board in cases of discrimination.

at its regular meeting December 14, 1977, has adopted an ordinance entitled
"Regulations Governing Ground Absorption Seuage Disposal Systems of 3000 Gallons
or Less llesigned Capacity".
Notice is hereby given that a copy of the said ordinance "Regulations
Governing Ground Absorption Sewage Disposal Systems of 3000 Callons or Less
Designed Capacity" is posted on the door of the New Hanover County Court House,
and that copies are on file and available for inspection in the office of New
Hanover County Health Department, 2029 South 17th Street, Hilmington, l10rth
Carolina. Ibis ordinance will be enforced beginning January 1, 1978.

REGULATIONS COVERING GROUND ABSORPTION SEWAGE
DISPOSAL SYSTEMS OF 3,000 GALLONS OR LESS DESIGNED CAPACITY
It is herewith ordained by the Board of Health
that the following regulations are hereby adopted and shall
govern throughout New Hanover County ground absorption
sewage disposal systems of 3,000 gallons or less designed
capacity:
1. The rules and regulations governing ground
absorption disposal systems adopted by the North Carolina
Department of Human Resources, effective July 1, 1977, and
as thereafter amended shall apply throughout New Hanover
County, subject to the additional rules and regulations
hereinafter set forth.
2. No septic tank system or privy shall be used
to serve two or more separate houses, buildings or mobile
homes.
3. The minimum lot sizes to be served by a
ground absorption disposal system shall be as follows:

a. 15,000 square feet when an individual
septic tank and well is located on a single lot.
b. 10,000 square feet when an individual
well or septic tank (but not both) is located on a single
lot.
4. No person shall construct, install or use a
cesspool in New Hanover County unless approved by the New
Hanover County Health Director (hereinafter "Health Director") .
5. A permit to construct, install, repair or
alter septic tank systems or privies shall be revoked when-
ever the Health Director determines that said construction,
installation, repair work or alteration is not being conducted
in accordance with these laws and rules. Said permit may be
reinstated when the Health Director determines that the
provisions of the laws and rules will be complied with.
6. All built in place septic tanks shall be con-
structed as follows:
a. All poured in place concrete septic
tanks shall have a minimum wall thickness of five inches and
shall have a minimum bottom thickness of four inches.
b. All septic tanks built of concrete
blocks shall be plastered with one coat of 1:3 mix (1 part
mix, 3 parts sand) 3/8 to 1/2 inch thick.

c. All septic tanks built of concrete
blocks or brick shall have a wall thickness of at least six
inches when the capacity of the tank is less than 1,000 gal-
lons. All tanks with a capacity of 1,000 gallons or greater
shall have a wall thickness of at least eight inches.
d. Specifications for lids of septic tanks
built of concrete blocks, bricks or concrete poured in place
are as follows:
1. Precast lids shall be of poured
concrete, 3 1/2 inches thick and not more than 20 inches
wide and reinforced with 3/8 inch rods on 8 inch centers.
2. Solid poured in place lids shall be
reinforced with 3/8 inch rods on 8 inch centers with one
2 1/2 foot by 2 1/4 foot manhole in each end of the tank
cover.
7. A distribution box with multiple outlets
shall be placed at the head of the nitrification lines.
8. Each nitrification line shall be connected
separately to the distribution box and shall not be subdivided
unless authorized by the Health Director.
9. A single nitrification line shall not exceed
100' in length unless authorized by the Health Director.
10. A one inch by six inch grade board shall be
set to a uniform grade of not more than 1/4 inch fall in ten
feet and supported by stakes at least every ten feet.

11. The minimum depth of filter material to be
used beneath the tile in the nitrification line shall be six
inches and the minimum depth of filter material over the
tile shall be two inches and graded level.
12. All nitrification lines shall be so constructed
no deeper than 24 inches from the bottom of the nitrification
trench to the finished surface grade unless authorized by
the Health Director.
13. The outlet pipes from the distribution box
shall be water leveled and subject to a water test. The
distribution box shall also be water tight as evidenced by
this water test.
14. The invert of the inlet pipe must enter the
distribution box at least one inch above the invert of the
outlet pipe.
15. The outlet pipes shall be located at least
four inches above the floor of the distribution box in order
to permit water retention.
16. The distribution box shall be located at
least two feet from the septic tank and on solid undisturbed
earth or a concrete slab and shall be at least two feet from
the nearest open section of nitrification line. No filter
material shall be placed between the septic tank and the
distribution box or the distribution box and the beginning
of the nitrification lines.

17. All septic tanks shall have a minimum of nine
inches free-board.
18. If any person willfully violates any of these
rules or shall willfully fail to perform any of the acts
required by these rules, he shall be guilty of a misdemeanor
and shall be punished as provided in G.S. 130-203 through
205.
19. All rules heretofore adopted by the Board of
Health of New Hanover County which are in conflict with the
provisions of this ordinance are hereby repealed.
20. If any provision of these rules or the appli-
cation thereof to any person or circumstances is held invalid,
the remainder of the rules or the application of such pro-
visions to other persons or circumstances shall not be
affected thereby.
21. This ordinance shall be effective January 1,
1978.
