1999-11-01 RM Exhibits AN EMERGENCY PROCLAMATION OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS WHEREAS, New Hanover County suffered three "major disasters"due to Hurricane Dennis, August 29,1999, Hurricane Floyd, September 15, 1999, and Hurricane Irene, October 17,1999; and WHEREAS, severe property damage has occurred within New Hanover County, creating drainage obstructions on public and private property; and WHEREAS, pursuant to Chapter 6.7-23(c) ofthe New Hanover County Code, an emergency proclamation may be issued to maintain order and protect lives or property during the state of emergency, NOW, THEREFORE, IT IS PROCLAIMED by the Chairman ofthe New Hanover County Board of Commissioners that it is necessary to authorize County officials, their agents, or assigns to enter onto private property within New Hanover County for the purpose of removing drainage obstructions, IT IS FURTHER PROCLAIMED that this proclamation shall take effect upon its execution, and shall remain in effect for one hundred eighty days thereafter This the 1" day of November, 1999 NEW HANOVER COUNTY iJ~~~ William A. WHEREAS, the above Lessee is a political subdivision of the State in which Lessee is located (the "State") and is duly organized and existing pursuant to the constitution and laws of the State. WHEREAS, pursuant to applicable law, the governing body of the Lessee ("Governing Body") is authorized to acquire, dispose of and encumber real and personal property, including, without limitation, rights and interests in property, leases and easements necessary to the functions or operations of the Lessee WHEREAS, the Governing Body hereby finds and determines that the execution of one or more lease-purchase agreements ("Equipment Leases") in the principal amount not exceeding the amount stated above ("Principal Amount") for the purpose-of acquiring the property generally described below ("Property") and to be described more specifically in the Equipment Leases is appropriate and necessary to the functions and operations of the Lessee. Brief Description of Property: Computer System for Register of Deeds Patrol Vehicles for Sheriff's Department Pumper Tanker for Fire Department WHEREAS, Bank One Leasing Corporation ("Lessor") is expected to act as the lessor under the Equipment Leases. WHEREAS, the Lessee may pay certain capital expenditures in connection with the Property prior to its receipt of proceeds of the Equipment Leases ("Lease Purchase Proceeds") for such expenditures and such expenditures are not expected to exceed the Principal Amount. WHEREAS, the U S Treasury Department regulations do not allow the proceeds of a tax-exempt borrowing to be spent on working capital and the Lessee shall hereby declare its official intent to be reimbursed for any capital expenditures for Property from the Lease Purchase Proceeds. NOW, THEREFORE, Be It Resolved by the Governing Body of the Lessee. Section 1. Either one of the County Manager OR the Finance Director (each an "Authorized Representative") acting of behalf on the Lessee is hereby authorized to negotiate, enter into, execute, and deliver one or more Equipment Leases in substantially the form set forth in the document presently before the Governing Body, which document is available for public inspection at the office of the Lessee. Each Authorized Representative acting on behalf of the Lessee is hereby authorized to negotiate, enter into, execute, and deliver such other documents relating to the Equipment Lease (including, but not limited to, escrow agreements) as the Authorized Representative deems necessary and appropriate. All other related contracts and I agreements necessary and incidental to the Equipment Leases are hereby authorized. Section 2. By a written instrument signed by any Authorized Representative, said Authorized Representative may designate specifically identified officers or employees of the Lessee to execute and deliver agreements and documents relating to the Equipment Leases on behalf of the Lessee. Section 3. The aggregate original principal amount of the Equipment Leases shall not exceed the Principal Amount and shall bear interest as set forth in the Equipment Leases and the Equipment Leases shall contain such options to purchase by the Lessee as set forth therein. Section 4. The Lessee's obligations under the Equipment Leases shall be subject to annual appropriation or renewal by the Governing Body as set forth in each Equipment Lease and the Lessee's obligations under the Equipment Leases shall not constitute a general obligations of the Lessee or indebtedness under the Constitution or laws of the State. Section 5. The Governing Body of Lessee anticipates that the Lessee may pay certain capital expenditures in connection with the Property prior to the receipt of the Lease Purchase Proceeds for the Property The Governing Body of Lessee hereby declares the Lessee's official intent to use the Lease Purchase Proceeds to reimburse itself for Property expenditures. This section of the Resolution is adopted by the Governing Body of Lessee for the purpose of establishing compliance with the requirements of Section 1 150-2 of Treasury Regulations. This section of the Resolution does not bind the Lessee to make any expenditure, incur any indebtedness, or proceed with the purchase of the Property Section 6. This Resolution shall take effect immediately upon its adoption and approval. ADOPTED AND APPROVED on this 1st day of November, 1999 (SEAL) ~A~f>.-- (1 ~ Chairman, Board of County Commissioners ~ ~ '</ ~ Cler to the Board STATE OF NORTH CAROLINA COUNTY OF NEW HANOVER BEFORE THE BOARD OF COUNTY C01vlMlSSIONERS IN THE MATTER OF RENAMING A PRlV A TE ROAD FROM LEE PARKER DRlVE TO JOHN'S CREEK ROAD ORDINANCE It appearing to the Board of County Commissioners of New Hanover County that consideration has been given to the renaming of Lee Parker Drive to John s Creek Road located approximately 1,200 feet east of the John's Creek Road - MYlile Grove Road intersection, extending from said point south 192.85 feet to termination and recorded as part of Map Book 27, Page 26 of the New Hanover County Registry and it further appearing that a public hearing was held on Monday, November I, 1999, at which time all persons were heard on the question of whether or not the renaming would be in the public interest; and it further appearing that notice of said hearing was transmitted to all adjoinll1g resident owners and prominently posted in at least two (2) locations along said road, and published in the Star News local newspaper, and the Board of County Commissioners is of the opinion that said road in New Hanover County should be renamed and the renaming of same is in the public interest, the description of which is delmeated on the attached exhibIt. NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road is hereby renamed to John's Creek Road. IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office of the Register of Deeds of New Hanover County, North Carolina, and that notice of the action taken by the Board of County Commissioners be transmitted to the postmaster having jurisdiction over the road, the North Carolina Board of Transportation and to any city within five (5) miles of said road in accordance with N C. Caster, Chairman ~}(/ Y~jA< C k to the Board PROCLAMATION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, the Board of Commissioners of New Hanover County, acting by and through its Chairperson, is empowered under Section 6.7 of the New Hanover County Code to suspend certain County Ordinances for the public health, safety and welfare in times of emergency; and WHEREAS, there is an urgent need for temporary housing in New Hanover County during the aftermath of Hurricanes Dennis, Floyd and Irene, both for displaced residents and persons assisting with the rebuilding of homes and businesses; and WHEREAS, the New Hanover County Zoning Ordinance prohibits the residential occupancy of travel trailers and recreational vehicles except in approved travel trailer parks; NOW, THEREFORE, BE IT PROCLAIMED that the prohibitions against residential occupancy of travel trailers and recreational vehicles contained in Sections 6] -] and 69 7 of the New Hanover County Zoning Ordinance are hereby SUSPENDED for a period of ninety (90) days from this date, on the following conditions: ] That a building permit be obtained for each such unit, at the same permit fee as is charged for mobile home permits; and 2.
