Chairman O'Shields called the meeting to order

Barfield to approve the minutes of Regular Meeting of August

ACCEPTANCE OF BOND APPLICATION BY LOCAL GOVERNMENT
COMMISSION
County Attorney Robert Pope advised the Board that
receipt of the District's Application for Approval of
Issuance of Bonds on August 15, 1983, had been ack~owledged
by the Local Government Commission by telephone.
FILING OF DEBT STATEMENT
The New Hanover County Water and Sewer District's
Statement of Debt, certified by the County Finance Officer,
was filed with the Clerk to the Board of Commissioners, to
be held on file for public inspection.
DISCUSSION - TIME SCHEDULE FOR BOND REFERENDUM
Chairman O'Shields stated that according to the
proposed timetable prepared by the County Attorney, the
Board was requested to adopt the Introduction of the Bond
Order thereby publishing notice of a Public Hearing to be
held on Monday, August 22, 1983, at 9 00 o'clock A M for
adoption of the Bond Order and establishment of a Bond
Referendum date.

Commissioner Gottovi expressed her concern for the
establishment of an early Bond Referendum date emphasizing
the importance of allowing adequate time for staff to
prepare the necessary promotional materials and information
to thoroughly inform the general public before voting on the
issue
Chairman O'Shields asked County Attorney Pope if
introducing the Bond Order to hold the Public Hearing would
lock-in the referendum date of November 8, 1983, stating
that the Board would like to have flexibility in setting the
final referendum date. County Attorney Pope stated that he
felt that adoption of the Introduction of the Bond Order
would not specifically hold the District to this date and
stated that he would prepare an alternate timetable to be
presented at the Public Hearing

After further discussion, Assistant County Manager
Cannon stated that staff was preparing a package program to
be presented to various civic organizations or anyone
requesting information on the Sewer System explaining all
the pertinent facts and details of the System The
Commissioners volunteered to participate in these
presentations and Engineering Director Hilton stated that
the League of Women Voters had volunteered their services in
helping to promote the project.
INTRODUCTION AND ADOPTION OF BOND ORDER AND CALL FOR PUBLIC

HEARING
Commissioner Gottovi introduced the following Bond
Order, which was read at length
nBOND ORDER AUTHORIZING THE ISSUANCE OF $40,000,000 SANITARY
SEWER BONDS OF NEW HANOVER COUNTY WATER AND SEWER DISTRICT
WHEREAS, the Board of Commissioners of the County
of New Hanover is the governing body of the New Hanover
County Water and Sewer District; and
WHEREAS, the Board of Commissioners of the County
of New Hanover deems it advisable to make the improvements
hereinafter described; and

WHEREAS, the Board of Commissioners has caused to
be filed with the Secretary of the Local Government
Commission of North Carolina an application for Commission
approval of the bonds hereinafter described as required by

The Local Government Finance Act, and the Secretary of the
Local Government Commission has notified the Board that the
application has been filed and accepted for submission to
the Local Government Commission; NOW, THEREFORE,
BE IT ORDERED by the Commissioners of the County
of New Hanover, sitting as the governing body of the New
Hanover County Water and Sewer District, as follows
Section 1 The Board of Commissioners has
ascertatned and hereby determines that it is necessary to
provide sanitary sewer collection facilities, including the
acquisi tion and construction of lines, force mains and
interceptors and including the acquisition and installation
of equipment and machinery required therefor and the
acquisition of land or rights-in-land required therefor, and
to pay capital costs of such improvements
Section 2 In order to raise the money required
to pay capital costs of providing the improvements as set
forth above, in addition to any funds which may be made
available for such prupose from any other source, bonds of
the New Hanover County Water and Sewer District are hereby
authorized and shall be issued pursuant to The Local
Government Finance Act of North Carolina The maximum
aggregate principal amount of said bonds authorized by this
bond order shall be $40,000,000
Section 3 A tax sufficient to pay the principal
of and interest on said bonds when due shall be annually
levied and collected The revenues of the facilities
hereinbefore described may be pledged to the payment of the
interest on and principal of said bonds if and to the extent
that the Board shall hereafter determine by resolution prior
to the issuance of said bonds In such event, the tax in
the District to pay the principal of and interest on said
bonds may be reduced by the amount of such revenues
available for the payment of such principal and interest.
Section 4 A sworn statement of the District's
debt has been filed with the Clerk to the Board of
Commissioners and is open to public inspection.
Section 5 This bond order shall take effect when
approved by the voters of the New Hanover County Water and
Sewer District at a referendum "

RESOLUTION (CONTINUED)
Commissioner Gottovi MOVED the adoption of the
following resolution
WHEREAS, the bond order entitled, "BOND ORDER
AUTHORIZING THE ISSUANCE OF $40,000,000 SANITARY SEWER BONDS
OF NEW HANOVER WATER AND SEWER DISTRICT", has been
introduced at the meeting of the Board of Commissioners,
sitting as the governing body of the district, held on
August 15, 1983 and the Board desires to provide for the
holding of a public hearing thereon and the submission of a
statement of debt in connection therewith as required by The
Local Government Bond Act; NOW THEREFORE,
BE IT RESOLVED by the Board of Commissioners of
the County of New Hanover, sitting as the governing body of
the New Hanover County Water and Sewer District, as follows
I
(1) The public hearing upon said bond order shall
be held on the 22nd day of August, 1983 at 9 00 o'clock A.M.
in the Commissioners' Assembly Room, County Administration
Building, 320 Chestnut Street, in Wilmington, North Carolina.
(2) The Clerk of the Board of Commissioners is
hereby directed to cause a copy of the bond order to be
published with a notice of such hearing in the form
prescribed by law in a qualified newspaper no fewer than six
days prior to such public hearing
(3) The District's Finance Officer is hereby
directed to file with the Clerk to the Board of
Commissioners, prior to publication of the bond order with
the notice of such public hearing, a statement setting forth
the debt incurred or to be incurred by the District, the
appraised value of property subject to taxation by the
District and the net debt of the District.
The MOTION was SECONDED by Commissioner Barfield
and was ADOPTED by the following vote

DISCUSSION OF WASTEWATER COLLECTION SYSTEM BY ENGINEERING
DIRECTOR HILTON DEFERRED UNTIL PUBLIC HEARING~O BE HELD ON

MONDAY, AUGUST 22, 1983
It was the-consensus of the Board to have Engineering
Director Hilton make his presentation on the Wastewater
Collection System reflecting the final facts and figures at
the Public Hearing scheduled for Monday, August 22, 1983, at
9 00 o'clock A.M. in the County Administration Building
REQUEST FOR DISCUSSION OF
PROPERTY OWNERS
Commissioner Gottovi requested Engineering Director
Hilton to be prepared to discuss the logistics of never
obtaining assessments from property owners at the Public
Hearing to be held on August 22, 1983
