Mr Fred Connor stressed the importance of informing the
public of the cost of pumping out septic tanks commenting on
the City's current fee charged to haulers.
Chairman O'Shields expressed his appreciation to the
persons attending the meeting and commenting on issues of
concern assuring them that these issues will be addressed.

O'Neal to adjourn the meeting Upon vote, the MOTION CARRIED
UNANIMOUSLY

SPECIAL MEETING - DECEMBER 19, 1983
ASSEMBLY
A Special Meeting of the New Hanover County Water
and Sewer District was held on Monday, December 19,
1983, at 9 00 o'clock A.M in the New Hanover County
Administration Building, Wilmington, North Carolina
Members present were Commissioners Jonathan
Barfield, Sr; Donald P Blake; Karen E. Gottovi; Nolan
O'Neal; Chairman Claud O'Shields, Jr; County Manager G
Felix Cooper: County Attorney Robert Pope; and Clerk to
the Board, Lucie F Smith.

Chairman O'Shields called the Special Meeting to
order stating the purpose of the meeting was to hold a

DISCUSSION OF AGREEMENT BETWEEN NEW HANOVER COUNTY AND
CITY OF WILMINGTON FOR COUNTY SEWER SYSTEM
Public Hearing for the adoption of the Bond Order and
Call for Election.
County Manager Cooper gave an update on the
proposed agreement between the City of Wilmington and
New Hanover County stating that some very favorable
arrangements had been made and presented to Bond
Counsel He explained Bond Counsel had suggested
minor changes be made by the County and City in order to
have an acceptable agreement for all parties concerned;
therefore, upon completion of the proposed agreement, it
would be presented to the District for review and
adoption at the January 3, 1984, meeting

Engineering Director Hilton gave background
information on the proposed agreement stating the
County and City would be working mutually to provide
and install needed services within a certain area with
no front footage assessments for individuals in this
zone He explained this would be accomplished by
allowing the City to operate and maintain the system
with the City being the agent for construction
services The City will build the major outfalls with
the District providing the Collection System He
emphasized that the adoption of this agreement would
eventually entail the discussion of a consolidated sewer
system
The Clerk reported to the District that the bond
order entitled, "Bond Order Authorizing the Issuance of
$46,000,000 Sanitary Sewer Bonds of New Hanover County
Water and Sewer District", which had been introduced on
December 12, 1983, had been published in a qualified
newspaper with notice to hold a Public Hearing on
December 19, 1983 The Clerk also reported that the
District's Finance Officer had filed in her office a
Statement of Debt complying with the provisions of The
Local Government Bond Act

After discussion, Chairman O'Shields, on behalf of
the District, expressed his appreciation to persons
commenting on this issue assuring them that the citizens
of New Hanover County would be provided accurate and
adequate data on the County Sewer System

ADOPTION OF BOND ORDER AND CALL FOR ELECTION
Commissioner Barfield MOVED, SECONDED by
Commissioner O'Neal to adopt the following Bond Order

WHEREAS, the Board of Commissioners of New
Hanover County, sitting as the governing body of the New
Hanover County Water and Sewer District, has adopted the
bond order hereinafter described authorizing the
issuance of $46,000,000 Sanitary Sewer Bonds and such
bond order and the indebtedness to be incurred by the
issuance of such bonds and the tax to be levied for the
payment of such bonds should be submitted to the voters
of the New Hanover Water and Sewer District for their
approval or disapproval in order to comply with the
Constitution and laws of North Carolina; NOW, THEREFORE,
BE IT RESOLVED by the Board of Commissioners
of New Hanover Countv, sittinq as the governina body of the New
Hanover Water and Sewer District, as follows
(1) The questions whether the qualified
voters of the New Hanover Water and Sewer District shall
approve or disapprove (a) the indebtedness to be
incurred by issuance of the bonds of the District
authorized by said bond order, which indebtedness shall
be secured by a pledge of the District's faith and
credi t, (b) the levy of a tax for the payment thereof,
and (c) said bond order shall be submitted to the qualified
voters of said

District at an election to be held in said District on

(2) The Clerk of the Board of Commissioners
and of the District is hereby authorized and directed to
publish a notice of said election which shall be in
substantially the following form
NEW HANOVER COUNTY WATER AND SEWER DISTRICT, NORTH
CAROLINA
NOTICE OF SPECIAL BOND ELECTION

NOTICE IS HEREBY GIVEN that a special bond
election will be held in the New Hanover County Water &
Sewer District, North Carolina, on March 6, 1984, for
the purpose of submitting to the qualified voters of
said District the questions whether they shall approve
or disapprove (1) the indebtedness to be incurred by
the issuance of bonds of said District of the maximum
principal amount of $46,000,000, which indebtedness
shall be secured by a pledge of the District's faith and
credit, and (2) the levy of a tax for the payment of
such bonds, and (3) the bond order entitled, "BOND
AUTHORIZING THE ISSUANCE OF $46,000,000 SANITARY SEWER
BONDS OF NEW HANOVER COUNTY WATER AND SEWER DISTRICT",
adopted by the Board of Commissioners of New Hanover
County, sitting as the governing body of said District
on December 19, 1983, to authorize the issuance of said
bonds and the levy of such tax.
The $46,000,000 Sanitary Sewer Bonds are
authorized to pay capital costs of providing sanitary
sewer collection facilities and waste water treatment
facili ties, including the acquisition and construction
of lines, force mains and interceptors and including the
acquisition and installation of equipment and machinery
required therefor and the acquisition of land or rights-
in-land required therefor

The ballots to be used at said election shall
contain the words, "SHALL the order authori zing
$46,000,000 of bonds secured by a pledge of the faith
and credit of the New Hanover County Water and Sewer
District to pay capital costs of providing sanitary
sewer collection facilities and waste water treatment

In the event a majority of the qualified
voters voting at said election vote to approve the
order, the incurring of indebtedness and the levy of a
tax related thereto, said bonds shall be issued and
taxes shall be levied for the payment of such bonds
The polls for the election will open at the
hour of 6 30 o'clock, A.M and will close at the hour of
7 30 o'clock, P M The election will be held in the

The registration records for said election
will be kept open at the office of the New Hanover
County Board of Elections, at 149 North Fourth Street,
in Wilmington, from 8 00 o'clock AM, until 5 00
o'clock PM, each weekday, and at the New Hanover
County Public Library at 201 Chestnut Street, in
Wilmington, during normal library hours, through
February 6, 1984 Additionally, the Registrar and Judge
for the Election Precinct may register voters by
appointment, through February 6, 1984 Information
concerning the names and addresses of the Registrar and
Judge may be obtained from the New Hanover County Board
of Elections at the office set forth above The last
day of registration for the special election shall be
February 6, 1984

Any qualified voter who (1) expects to be
absent from the District during the entire period that
the polls are open on said election day, or (2) because
of sickness or other physical disability will be unable
to be present at the polls to vote in person on said
day, or (3) is incarcerated and otherwise entitled to
vote in said election or (4) is an employee of the
County Board of Elections and his assigned duties on the
day of election will cause him to be unable to vote in
person, may apply for an absentee ballot to be used in
voting at said election Information concerning the
time and manner for applying for an absentee ballot,
including the last day for making such application, can
be obtained from the County Board of Elections at the
office in Wilmington set forth above.

By order of the Board of Commissioners of New
Hanover County, sitting as the governing body of the New
Hanover Water and Sewer District.
Said notice of special election shall be published
at least twice. The first publication shall be not less
than 14 days and the second publication not less than 7
days before the last day on which voters may register
for the special election
(3) The New Hanover County Board of Elections
is hereby requested to print and distribute the
necessary ballots and to provide the equipment for the
holding of said election and to conduct and to supervise
said election.
(4) The Clerk of the Board of Commissioners
and of the District shall mail or deliver a certified
copy of this resolution to the New Hanover County Board
of Elections within three days after the resolution is
adopted
