Robinson, Bradshaw & Hinson, P.A. is designated to serve as bond counsel for the issuance of the Bonds. 2. IN WITNESS WHEREOF I have hereunto set my hand and have hereunto affixed the seal of the County on September 21,1998. 3 C-SJOB89vOl .13704.00013 ( STATE OF NORTH CAROLINA COUNTY OF NEW HANOVER BEFORE THE COUNTY OF NEW HANOVER IN THE MATTER OF Review and Recommendations of Technical Audit Report of Falcon Cable Media's Cable Distribution System serving New Hanover County, North Carolina, NC-0152 ) NOTICE OF ) NON-COMPLIANCE ) WITH FCC TECHNICAL ) STANDARDS AND ) 60 DAYS TO CURE WHEREAS, on August 6 and 7 1998, consultants for the County conducted a technical audit of Falcon Cable Media's cable distribution system serving unincorporated areas of New Hanover County performing a computer analysis of cable signals at 37 test locations, and visually inspecting over 209 road-miles of cable plant; WHEREAS, 17 test sites, 1,2,3,7 14,18,20,21,23,24,26,30,32,34,35 36,37,failedthe FCC minimum visual carrier level (All CH >) standard on one or more channels; WHEREAS, 26 test sites, 1,2,4,5 6,7 9 10 II 12, 13 15, 16, 17, 18, 19 25 26 27 28 29, 30 31 33 36, 37,failedthe Industry maximum visual carrier level (All CH <) standard on one or more channels; WHEREAS, 9 test sites, I 2, 7, 12, 21, 25 30, 31, 36,failed the FCC all-channel visual carrier separation level (All CH) standard; WHEREAS, 9 test sites, 2, 19, 22, 23, 24, 25, 36, 37,failed the FCC maximum Hum level standard on one or more channels; WHEREAS, all 37 test sitesfailedthe FCC maximum aural carrier level (Max NV) standard on one or more channels; WHEREAS, 3 test sites, 2, 29 31,failed the FCC minimum aural carrier level (Min NY) standard on one or more channels; WHEREAS, all 37 test sites failed the FCC adjacent-channel visual carrier level (CH-CH) standard on one or more channels; WHEREAS, 27 test sites, 1 2,3 5 6, 7 10, 13, 14, 15 17 18, 19 20,21,22,23,24,25 26,27 30,32,34,35 36, 37,failedthe FCC carrier-to-noise ratio standard on one or more channels; WHEREAS, 7 test sites, 1 2,7 12,21 30 36, exceeded 10 dB in system Tilt; WHEREAS, 7 test sites, 1,2,3 4, 8,31,37 failed the FCC Peak-to-VaIIey standard ofless than 10 dB, WHEREAS, 4 houses in new subdivisions inspected by the consultants have 8-port, 11 dB splitters attached to them; WHEREAS, the outputs of 8-port splitters are 11 dB less than the input to the splitter and decrease the signal level by 11 dB present at the subscriber's terminal; WHEREAS, not all of the outputs of said splitters were in use, connected to cables, or properly terminated; WHEREAS, Center conductors on cable heads at several test sites were corroded and discolored, such as Site 14, 7103 Grouper Ct; WHEREAS, the threads of many cable connectors were not coated with a protective agent (e.g., Vaseline) to guard against salt-air corrosion, such as 1812 Canal Street; WHEREAS, an unburried cable drop lying across a road was observed at 6131 Indian Cove Ave; WHEREAS, an improperly burried cable drop was observed at 6218 Spring Oaks Mobile Home Park, unit 9B, and, WHEREAS, it is reasonable to infer that the deficiencies observed at the 37 sites visited by the consultants exist at the residences of other cable subscribers. IT IS THEREFORE ORDERED: THAT, Falcon Cable Media is in violation of FCC technical standards as set out in 47 C F.R. Subpart K, 9 76 605 THAT, Falcon Cable Media shall correct within 60 days from the date this executed order is mailed the deficiencies identified in the Findings of Fact in this report; THAT, Falcon shall bury all unburried cable drops that should be burried, and shall properly bury all improperly burried cable drops, shall clean all corrosion from the center conductors of cable drops, shall apply appropriate corrosion resistant material to cable connectors, shall use signal splitters with appropriate attenuation to ensure that the cable signal level present at the subscriber's terminal meets the FCC technical standards of no less than 0 dBmV, , THAT, Falcon Cable Media shall ensure that within 60 days from the mailing of this executed order the cable television signals received by all subscribers in unincorporated New Hanover County franchise NC-0152 fully comply with all tcchnical standards sct out in 47 C.P.R.
