RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, after due advertisement, bids were received and publicly opened by the Finance
Department at 10:00 a.m., on the 22nd day of September ] 998, at the County Administration Building,
320 Chestnut Street, Wilmington, North Carolina, and the following bids were received for three (3) used
vehicles for the Sheriff s Department, Bid # 99-0096
Cape Fear Ford $56,550.00
Bob King Pontiac GMC, Inc. $47,400.00
.Cape Fear Ford $31,852.00.
('This bid was determined to be nonresponsive and was
not considered because the vehicles bid were mid-size and
not the required full-size)
AND WHEREAS, the Sheriff, the Finance Director and the County Manager recommend that
the contract be awarded to Bob King Pontiac GMC, Inc. of Wilmington, North Carolina, the lowest
responsible bidder in the amount of Forty-seven Thousand Four Hundred Dollars ($47400.00);
AND WHEREAS, funds have been previously appropriated and arc now in Account No.
348-431-8000-7300-6000-Job # FFPSH050 to cover this contract;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that Contract # 99-0096 for used vehicles for the Sheriffs Department, Bid # 99-0096
be awarded to Bob King Pontiac GMC, Inc. in the amount of Fortv-seven Thousand Four Hundred
Dollars ($47 400.00); and that the County is hereby authorized and directed to execute the contract,
contract form to be approved by the County Attorney

NEW HANOVER COUNTY
WHEREAS, New Hanover County previously approved through the adoption of the current
budget the purchase of equipment (800 MHZ radios for Sheriffs Department, bulldozer for the
Landfill, and dump trucks for Environmental Management) through installment purchase financing;
AND WHEREAS, staffis requesting approval of Contract # 99-0122, an installment contract
with Heller Public Finance, LLC for the financing of the equipment as authorized by North Carolina
General Statue 160A-20;
AND WHEREAS, all equipment to be financed through this contract will be purchased in
accordance with the General Statutes of North Carolina;
AND WHEREAS, budget amendment # 99-0034 has been prepared and is submitted for
approval as part of this request;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that Contract # 99-0 122 with Heller Public Finance, LLC for financing the purchase
of equipment (800 MHZ radios for Sheriffs Department, bulldozer for the Landfill, and dump trucks
for Environmental Management) is approved and the Chairman of the Board of Commissioners,
Finance Officer and County Manager of New Hanover County are hereby authorized and directed
to act on behalf of the County of New Hanover in regard to Contract # 99-0122 and other actions not
inconsistent with this resolution, including a commitment letter with Heller Public Finance, LLC
relating to said financing; and associated Budget Amendment # 99-0034 is approved.

AN ORDINANCE OF THE COUNTY OF
NEW HANOVER, NORTH CAROLINA,
AMENDING THE ZONING ORDINANCE OF
NEW HANOVER COUNTY ADOPTED
OCTOBER 6,1969
THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY DOTH ORDAIN
Section 1 That the Zoning Ordinance of the County of New Hanover adopted October 6, 1969, as
amended be and the same is hereby further amended as follows:
-Delete in the Table of Permitted Uses, "Duplexes, and "single-family dwelling-attached"
from the RA Rural Agriculture District.
-Reword Section 59.5-1 as follows:
59.5-1 Rural Agriculture District (7/2/85)
The RA Rural Agriculture District is established as a district in which the principal
use of land isfor low density single familv residential purposes. The regulations of
this district encourage rural farming activities, the preservation of open space and
permilling development compatible with the preservation of its rural character and
providing limited growth. The district is designed to promote exurban, low density
residential development not requiring urban services while maintaining prime farm
land and a rural lifestyle. Duplexes, residential elusters, allached residential, and
high density allached residential uses shall not be permilled. (lO/5/98)

Section 2. Any ordinance or part of any ordinance in conflict with this ordinance, to the extent of
such conflict is hereby repealed.
Section 3 This ordinance is adopted in the interest of public health, safety morals, and general
welfare of the inhabitants of the County of New Hanover North Carolina, and shall be in full force
and effect from and after its adoption.

NEW HANOVER COUNTY BOARD OF COMMISSIONERS
RESOLUTION
IN SUPPORT OF THE PROPOSED STATE BOND ISSUES
FOR WATER, SEWER AND NATURAL GAS
WHEREAS, the North Carolina General Assembly in its ] 998 session ratified Senate Bill 1354 the Clean Water
and Natural Gas Critical Needs Bond Act of 1998, and Governor James B. Hunt, Jr signed the bill into law and
pledged his aelive support, and
WHEREAS, SB 1354 provides $800 million in loans and grants for much needed water and wastewater capital
projects; and
WHEREAS, SB ] 354 provides $200 million to extend natural gas service into under served areas of the state;
and
WHEREAS, a recent study has identified more than $11 billion in water and sewer capital needs, and the bonds
are a critical step in meeting these long-range infrastructure needs; and
WHEREAS, the water and sewer bonds will assist local governments in all areas of the state to protect the quality
of our surface and drinking waters and to promote sound economic development, and
WHEREAS, the water, sewer and natural gas bonds will facilitate smart gro\\1h and result in more jobs for North
Carolinians; and
WHEREAS, the bond issues will help move North Carolina forward;
NO W, THEREFORE BE IT RESOL VED that the New Hanover County Board of Commissioners strongly
supports the bond issues proposed by SB 1354 for water sewer and natural gas and encourages citizens to vote
in favor of these bond issues at the polls on November 3
