Resolution of Intent
To Close a Portion of Buena Vista Circle
Buena Vista (Middle Sound Community)
Whereas, a petition has been filed pursuant to N.C.G.S. l53-A 241 requesting the Board
of Commissioners of New Hanover County to close the southern portion of the following
described private road;
Beginning at a point in the northeastern right-of-way line of Buena Vista Circle, formerlv
Central Drive. Said point of beginning being the southernmost corner of Lot 43 as
shown on a map of Buena Vista recorded in Map Book 4 at page 4 of the New Hanover
County Registry Running thence from said point of beginning North 53 degrees 06
minutes 30 seconds East 1 70ft. to a point, thence South 37 degrees 17 minutes 00
seconds East 169 17ft. to a point, thence South 73 degrees 13 minutes 00 seconds West
286.04 ft. to a point; thence North 26 degrees 22 minutes 02 seconds East 41 12ft. to a
point thence North 73 degrees /3 minutes 00 seconds East 214 65ft. to a point, thence
North 37 degrees /7 minutes 00 seconds West /25.92 ft. to a point. thence North 52
degrees 43 minutes 00 seconds East 1 70ft. to a point, thence North 37 degrees /7
minutes 00 seconds West 46 64 ft. to a point, thence North 28 degrees U6 minutes 34
seconds East 29 30ft. to a point, thence South 37 degrees /7 minutes 00 seconds East
58.85 ft. to the point of be ginning. The above described tract represents a portion of
Buena Vista Circle (formerly Central Drive) that is to be closed.
Now therefore, be it resolved that this Board is considering closing the southern portion
of Buena Vista Circle to vehicular use, and that a public hearing on this questions will be held on
the 7th day of December 1998 at 7.30 p.m. in the General Assembly Room of the County
Courthouse at 24 North Third St. in Wilmington, N C. at which time the Board will hear all
interested citizens and make a final determination as to whether the road shall be closed.
The foregoing resolution was adopted by the New Hanover County Board of
Commissioners on the 19th day of October, 1998.

WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above described
road(s), the location of which has been indicated in red on the attached map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described road(s), and to take over the road(s) for maintenance if they
meet established standards and criteria

WHEREAS, after due advertisement, bids were received and publicly opened by the Finance
Department at 3.00 p.m., on the 22nd day of September, 1998, at the County Administration
Building, 320 Chestnut Street, Wilmington, North Carolina, and the following bid was received for
two (2) used tandem axle dump trucks for the Environmental Management Department,

Dollars ($77,000.00);
AND WHEREAS, funds have been previously appropriated and are now in Account No
700-485-4194-6450 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the contract for two (2) used tandem axle dump trucks for the Environmental
Management Department, Bid # 99-0085 be awarded to Salem Leasing Corporation in the amount
of Seventy-seven Thousand Dollars ($77,00000); and that the County is hereby authorized and
directed to execute the contract, contract form to be approved by the County Attornev

WHEREAS, the use of conveyors are required in the routine operation ofthe W ASTEC Facility;
AND WHEREAS, replacement parts are needed to complete scheduled maintenance repairs to
the existing Beaumont Birch conveyors;
AND WHEREAS, the required replacement parts are unique to the Beaumont Birch conveyors
and can only be obtained from Beaumont Birch Company;
AND WHEREAS, General Statute l43-l29(f) allows an exemption from formal bidding for
purchase contracts when a needed product is available from only one source of supply'
AND WHEREAS, the W ASTEC staff has explored options and has been able to find the
replacement parts only from the manufacturer;
AND WHEREAS, funds have been previously appropriated and are now in Account No
700-485-4195-3920-27 to cover this contract, contract amount of forty-seven thousand five hundred
six dollars and seventy-five cents ($47,506.75);
AND WHEREAS, the Environmental Management Director, the Finance Director, and the
County Manager recommend thatthe contract be awarded to Beaumont Birch Company the sole source
for these parts;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the contract # 99-0130 for Beaumont Birch conveyor parts for the W ASTEC
Facility of the Environmental Management Department, be awarded to Beaumont Birch Company in
the amount of forty-seven thousand five hundred six dollars and seventy five cents ($47,506 75); and
that the County is hereby authorized and directed to execute the contract, contract form to be approved
by the County Attorney

WHEREAS, more than one million Americans reach out to help others every year on
the fourth Saturday of October; and

WHEREAS, communities across the nation continue to be devastated by severe
weather; and

WHEREAS, The Weather Channel, The Cape Fear Chapter of the American Red
Cross, Time Warner Cable, and the Cape Fear Area United Way Volunteer Center are
participating in a promotion to encourage families to stop and take the time to prepare
for a disaster before it happens as part of 'Project Safeside" and
WllliREAS, 1998 has been proclaimed 'Year of the Volunteer by Governor lames
B. Hunt, and that volunteers will gather at the gazebo at Carolina Beach to canvass the
Pleasure Island communities with door hangers containing 'Project Safeside" weather
preparedness information;

RESOLUTION
OF THE NEW HANOVER COUNTY BOARD OF COMMISSIONERS
October Designated as Breast Cancer Awareness Month
WHEREAS, breast cancer is the most commonly diagnosed cancer and the second leading cause
of cancer deaths among women in the United States; and
WHEREAS, in North Carolina 6,000 women will be diagnosed with breast cancer and 1,300 will die
from the disease this year and
WHEREAS, every woman is at risk for breast cancer even if she has no family history of the disease
and women over the age of 50 are at greatest risk for contracting breast cancer. and
WHEREAS, modern treatment methods have made it possible for 9 out of 10 women with breast
cancer to survive the disease when caught at its earliest stages; and
WHEREAS, mammograms can detect breast cancer years before it can be felt by a woman or her
health care provider. and regular and combined use of age-appropriate mammograms, clinical breast exams,
and breast self-exam are our best line of defense against late stage detection; and
WHEREAS, an estimated $65,000 to $75,000 in medical costs will be saved for every woman whose
breast cancer is found at an early stage rather than at a late stage; and
WHEREAS, October is designated as NATIONAL BREAST CANCER AWARENESS MONTH; and
WHEREAS, the pink ribbon is the internationally recognized symbol of breast cancer awareness; and
WHEREAS, churches, employers, and community organizations can playa special roie in educating
their members/employees about breast cancer
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County that October be and is proclaimed NATIONAL BREAST CANCER AWARENESS MONTH. We urge
all New Hanover County residents to wear pink ribbons in recognition of breast cancer awareness and in
honor of New Hanover County women who lost their lives to breast cancer

AND WHEREAS, funds have been previously appropriated and are now in Account No. 700-480-4191-6400
and the additional funds needed are to be provided through the attached budget amendment # 99-0042 to cover this
contract;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover County that
the contract for a bulldozer for the Environmental Management Department, Bid # 99-0112 be awarded to Gregory Poole
Equipment Company in the amount of Three Hundred Ninety-three Thousand Seven Hundred Forty-eight Dollars

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County North Carolina, does hereby
ordain that Chapter 15 Water Supply SYstem, Article II, Wastewater Collection and Treatment.
of the New Hanover County Code, is hereby amended as follows:
Add the following new sections:
Section 15-103. Utility Easement Obstruction Prohibited.
No person shall place, construct, deposit, leave, permit to be or remain on, within, or
over any easement for public water and/or sewer use, any construction materials, metals,
lumber trees, berms, water bodies, rubbish, refuge, fences, structures, buildings, or other
obstructions. Such obstruction shall constitute an easement nuisance hereunder
Section 15-104. Abatement.
Whenever an easement nuisance is found to exist within the County the County
Engineer or some other duly designated officer of the County shall give written notice to abate
directed to the owner on whose property the easement exists or upon the person or entity
causing, allowing, or continuing the nuisance. Said easement nuisance may be abated, costs
collected, and enforced by utilizing that process set forth in New Hanover County Code
Chapter 11 Article V for a drainage nuisance Any and all costs incurred by the County in the
abatement shall constitute a lien upon that property on which the easement exists, collectable in
the same manner as ad valorem taxes.
Except as expressly amended above Chapter 15 of the New Hanover County Code
shall remain unaltered, in full force and effect.
