WHEREAS, after due advertisement, bids were received and publicly opened by the Finance Department
at 11.30 a.m., on the 25th dav of March, 1997 at the County Administration Building, 320 Chestnut Street,
Wihninglon, North Carolina, and the following bids were received for a crane bucket for the W ASTEC Facility
of the Environmental Management Department, Bid # 97-0333

AND WHEREAS, the proposal from Pro-Line Machine Repair was deficient in several areas and
therefore the staff determined that the bid was nonresponsive and would not be considered;
AND WHEREAS, the proposal from the next lowest bidder, Anvil Attachments a Division ofD&S
Manufacturing Co., Inc., met all the bid requirements and was determined by starr to be the lowest bidder
submitting a responsive bid proposal;
AND WHEREAS, the Environmental Management Director, the Finance Director and the County
Manager recommend that the contract be awarded to Anvil Attachments a Division of D&S Manufacturing Co.,
Inc., the lowest responsible bidder, in the amount of Twenty-six Thousand Seven Hundred Ten Dollars
($26,710 00):
AND WHEREAS, funds have been previously appropriated and arc now in Account No.
700-485-4193-6400 to cover this contract,
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover
County that the contract for a crane bucket for the WASTEC Facility of the Environmental Management
Department, Bid # 97-0333 be awarded to Anvil Attaclmlents a Division of D&S Manufacturing Co., Inc. in the
amount of Twenty-six Thousand Seven Hundred Ten Dollars ($26,71000); and that the County is hereby
authorized and directed to execute the contract, contract form to be approved by the County Attorney

RESOLUTION AUTHORIZING CONVEYANCE OF LOTS TO THE WILMINGTON
HOUSING FINANCE AND DEVELOPMENT INC. (WHFD)
RESOLVED'
In accordance with the real property policy adopted by City Council and the County Commission,
the following lots have been identified by Wilmington Housing Finance and Development, Inc. (WHFD) as
suitable for construction of owner-occupied, single-family residences.
In accordance with the policy WHFD must construct or move existing owner-occupied single
family residences onto the lots within 18 months.
The Wilmington City Council will be requested to convey its interest in the lots at its April I, 1997
meeting.
NOW THEREFORE, BE IT RESOLVED'

BY PRIVATE SALE
Please take notice that the Wilmington City Council adopted a resolution dated April I,
1997 and the Board of Commissioners of New Hanover County adopted a resolution on April 7
1997 authorizing the eonveyanec by private sale to Wilmington Housing Finance and
Development, Inc. (WHFD), a non-profit corporation, for the following described property.

This property will be conveyed to the Wilmington Housing Finance and Development, Inc.
(WHFD) without monetary consideration to be used in a program with the purpose of constructing

bidder at the discounts otfmanufacturer's price list as quoted in the proposal;
AND WHEREAS, all purchases will go through normal County budgetary approval and
appropriation procedures for any purchases from this contract;

RESOLUTION
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
WHEREAS, the Parkinson s Disease Support Group and European Parkinson's Disease
Awareness Associations are committed to elevating public awareness of the disease and,
WHEREAS, the support of public officials aids in heightening the public's awareness and
concern in order to become better educated about health issues, and
WHEREAS, Parkinson s Disease affects millions of Americans, and
WHEREAS, April 11 is the anniversary of the birth of Dr James Parkinson,
NOW, THEREFORE, BE IT RESOLVED that the New Hanover County Board of
Commissioners declares April 11, 1997 as the First Parkinson's Disease Awareness Day
in New Hanover County

It appearing to the Board of County Commissioners of New Hanover County that a Resolution
ofIntent to close/reduce a portion of Burke Avenue was adopted by the County Commissioners on the
lath day of March, 1997 and it further appearing that said resolution called for a hearing to be held on
the 7th day of April, 1997 at which time the County Commissioners would hear complaints and
comments of interested persons, and it further appearing that notice of said hearing was published in the
Wilmington Star News in accordance with the Road Closing Ordinance of New Hanover County and
after conducting such hearing the County Commissioners are of the opinion that a portion of Burke
Avenue in the County of New Hanover should be reduced and are satisfied that the reduction of same is
not contrary to the public interest, and that no individual owning property in the vicinity of the roads
will be deprived of reasonable means of ingress and egress to his property by such reduction, the legal
description of said road being as follows:
Beginning at the northeastern corner of lot 7 Villa View Subdivision as recorded
in Book 52, Page 563 of the New Hanover C01lnty Registry and is approximately
250 feet east of Dick Avenue (currently know as Pavilion Place) running thence
from the northeastern corner of lot 7 approximately 150 feet southwest to the
northeastern corner of lot 34 1/2, thence from said point south 126feet to the
southeastern corner of lot 33 as shown on the Villa View plat; thence 50 feet east
to the southwestern corner of lot 39 thence 146.6feet north to the northwestern
corner of lot 39 thence 150 feet northeast to the northwestern corner of lot 12 as
shown on the Villa View plat; thence 50 feet northwest to the point of beginning.
NOW THEREFORE, IT IS ORDERED AND DECREED that the above
described road be hereby reduced to a thirty foot wide easement by deleting 10 feet from
each side of the eastern and western rights-of-way Provided, however a 50 ft. wide
utility easement is reserved and retained, over on, and across said Burke Avenue.

ORDER
It appearing to the Board of County Commissioners of New Hanover County that a Resolution
ofIntent to close/reduce a portion of Burke Avenue was adopted by the County Commissioners on the
10th day of March, 1997 and it further appearing that said resolution called for a hearing to be held on
the 7th day of April, 1997 at which time the County Commissioners would hear complaints and
comments of interested persons, and it further appearing that notice of said hearing was published in the
Wilmington Star News in accordance with the Road Closing Ordinance of New Hanover County and
after conducting such hearing the County Commissioners are of the opinion that a portion of Burke
Avenue in the County of New Hanover should be reduced and are satisfied that the reduction of same is
not contrary to the public interest, and that no individual owning property in the vicinity of the roads
will be deprived of reasonable means of ingress and egress to his property by such reduction, the legal
description of said road being as follows:
Beginning at the northeastern corner of lot 7 Villa View Subdivision as recorded
in Book 52, Page 563 of the New Hanover County Registry and is approximately

Whereas, county government traces its roots to the English shire of a thousand years ago,
serving as the citizen's local government voice since its inceptionj and
Whereas, when the federal government was formed, the framers of the Constitution chose
to provide states the freedom to create county governments. Subsequently, early
state constitutions conceptualized the importance of county government and its dual
value to both the state and federal governmentj and
Whereas, changes in structure and greater autonomy from the states, rising revenues and
stronger political accountability have ushered in a new era for county government as
they enter the 21st centuryj and
Whereas, the practice of devolution - the shift of responsibilities and programs from the
federal level to state and county governments- continues to evolve and with these
changes come the possibility of greater autonomy and flexibility That flexibility and
greater local control presents expanded opportunities to New Hanover County, as
we pursue what is best for citizens and communities in which they Iivej and
Whereas, the county will pursue key initiatives by seeking public input through the
Community Countdown 2000, which is a national campaign to raise public
confidence and increase understanding abut the roles and responsibilities of countiesj
and
Whereas, county governments have seized opportunities and met challenges in the past. In
recognition of the leadership, innovation and valuable service provided by our
nation's counties:
Now, therefore, be it resolved that the New Hanover County Board of Commissioners, of
New Hanover County, North Carolina hereby proclaims April 13 19, 1997

AN ORDINANCE
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
The Board of Commissioners of New Hanover County, North Carolina, does hereby
ordain that Chapter 8, Fire Prevention and Protection, New Hanover County Code, is hereby
amended as follows:
Amend Section 8-21, Duties of the Fire Marshal, to read:
The Fire Marshal shall have the following duties and authority in fire prevention and code
enforcement as permitted in G.S. Sections 153A-234 58-79-20, and 58-79-1 including, but not
limited to
I Making fire prevention inspections, including the periodic inspections and reports of
school buildings required by Chapter 115 and the inspection of day-care facilities required by
Chapter 110
2. Exercising, as Director of the Fire Prevention Division of the Department of Fire
Services Administration, all duties, powers, and authority express and inherent in that office,
including the enforcement of the State Fire Prevention Code.
3 Investigating the cause, origin, and circumstances of fires occurring in the
unincorporated county in which property has been damaged or destroyed.
Add Section 8-22, Delegation.
The Fire Marshal may utilize duly authorized deputy fire marshals or local fire
department personnel in the performance of his/her duties.
