SI43-129(a) allows for the purchase of equipment without public bidding in special emergencies involving the health and safety of the people and their property; and WHEREAS, the Sheriffs Department must have a boat as soon as possible in order to protect the public health and safety, NOW, THEREFORE, BE IT RESOLVED THAT the New Hanover County Board of Commissioners does hereby authorize the New Hanover County Sheriffs Department to purchase a boat through informal bids that will enable it to enforce the Personal Watercraft Ordinance. This the 21st day ofJuly, 1997 New Hanover County 1J;1J~ Robert G Greer, Chairman ATTEST ~~/~ lerk to the Board RESOLUTION OF THE BOARD OF COMMISSIONERS OF NEW HANOVER COUNTY WHEREAS, it is the County s intention to comply with North Carolina General Statute 143-129 and any other applicable statutes in regards to the solicitation and award of all bids and disposal of property AND WHEREAS, Senate Bill 891 ratified by the North Carolina General Assembly on June 2, 1997 signed by the Governor on June 12,1997 and effective July 1,1997 changes limit requirements that determine when bidding and approvals are required; AND WHEREAS, General Statute changes which effect the County s purchasing policy are: Formal bidding required for purchases of$30,000 or more (previous law and current County policy $20,000). 2. Allows governing body to waive requirement for a bid bond for purchases more than $100,000 but allows staff to require a bid bond if deemed necessary (previous law and current County policy allow waiver of bid bond for purchases up to $100,000 but requires bid bond on purchases of $ 100,000 or more). 3 Allows governing body to authorize staff person to dispose of items valued at less than $5,000 without board approval (previous law and current County policy less than $500). The official authorized to approve disposal must keep a record of all disposal but no further report to the Board of Commissioners is necessary (previous law and current County policy requires report to be filed with Board of Commissioners twice a year). 4 Allows governing body to delegate to the manager or the chief purchasing official the authority to award or reject bids and to re-advertise to receive bids (previous law and current County policy do not allow for this). AND WHEREAS, staff has reviewed the new law and in order to revise the County s policy to make it consist with the General Statutes staff recommends the following changes to the current purchasing policy. Formal bidding procedures are required for purchases of $30,000 or more 2. A bid bond is not required for contracts involving purchases that require formal bids. However, if the purchase requires specific performance criteria, . relates to items that are highly technical in nature, or it is determined that a bid bond may be appropriate in a specific case, the Purchasing Agent may require a bid bond. 3 Authorize the Finance Director or his designated representative to dispose of any item or group of items valued at less than $5 000 In accordance with the General Statutes, the Finance Director or his designated representative shall keep a record of all property sold under this provision. 4 Authorize the County Manager or his designated representative to reject bids and to re-advertise to receive bids. AND WHEREAS, after review and discussion of the staff's recommendations, the Board of Commissioners has adopted staff's recommendations except for item 4 and the limit in item 3 to be $1 000 00 instead of the recommended $5 000 00.
