WHEREAS, after due advertisement, bids were received and publicly opened by the Finance
Department at 3.00 p.m., on the 2nd day of July 1997 at the County Administration Building,
320 Chestnut Street, Wilmington, North Carolina, and the following bids were received for a water
treatment program for the W ASTEC Facility of the Environmental Management Department,

AND WHEREAS, the staff had concerns with all bids received because the bids received had
errors and were incomplete and therefore, staff is requesting all bids be rejected with staff to begin
bid process again;
AND WHEREAS, the Environmental Management Director the Finance Director and the
County Manager recommend that all bids received be rejected;
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the bids received for a water treatment program for the W ASTEC Facility of
the Environmental Management Department, Bid # 98-0005 be rejected.

WHEREAS, New Hanover County desires to consider acceptance of said offer.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of
New Hanover County authorizes the Chairman of the Board of Commissioners to execute a deed
conveying its interest in and to the below indicated parcel to Coming, Inc., following advertisement
of this proposed transaction: 5005-001-003-000, Deed Book 1576, Page 1177 New Hanover County

AND WHEREAS, the bids received by Stevens Fire, Custom Fire, and Gastonia Fire did not
include the required specifications to allow review by staff and was therefore considered non-
responsive and not considered for award;
AND WHEREAS, the bId received from C. W Williams had numerous exceptions which
were not acceptable and therefore their bid was considered non-responsive and not considered for
award;
AND WHEREAS, it was determined bv staff that the following equipment and options were
desirable and that the award be made for twelve (12) self contained breathing apparatus, including option 2
(SCBA as specified with Carbon Cylinder), option 3 (spare lightweight carbon-based cvlinder) and
option 5 (face masks) and therefore staff configured each bidder s price based upon the same
configuration utilizing the pricing supplied in the proposal and the results were as follows:

AND WHEREAS, the Fire Service Administrator the Finance Director and the County
Manager recommend that the contract be awarded to Vall en Safety Supply a foreign corporation
organized under the laws of the State of Texas, the lowest responsive bidder in the amount of
Twenty-nine Thousand Nine Hundred Thirty-seven and Fifty-eight Cents ($29,937.58);
AND WHEREAS, funds have been previously appropriated and are now in Account No
130-436-4370-6400 to cover this contract;
NOW THEREFORE, BE IT RESOL YED by the Board of County Commissioners of New
Hanover County that the contract for twelve self contained breathing apparatus and requested options
for the Fire Services Administration, Bid # 97-0441 be awarded to Vallen Safety Supply in the
amount of Twenty-nine Thousand Nine Hundred Thirty-seven Dollars and Fifty-eight Cents
($29,937.58); and that the County is hereby authorized and directed to execute the contract, contract
form to be approved by the County Attorney

A RESOLUTION
OF THE
NEW HANOVER COUNTY
BOARD OF COMMISSIONERS
WHEREAS, on May 19 1997 the New Hanover County Board of Commissioners adopted
an ordinance pertaining to personal watercraft which was amended June 16, 1997, and
WHEREAS, the New Hanover County Sheriffs Department is charged with enforcing the
ordinance, but has no boat to use in the enforcement; and
WHEREAS, it would require six (6) weeks to receive formal bids for a boat; and
WHEREAS, N.C.G.S. SI43-129(a) allows for the purchase of equipment without public
bidding in special emergencies involving the health and safety of the people and their property; and
WHEREAS, the Sheriffs Department must have a boat as soon as possible in order to
protect the public health and safety,
NOW, THEREFORE, BE IT RESOLVED THAT the New Hanover County Board of
Commissioners does hereby authorize the New Hanover County Sheriffs Department to purchase
a boat through informal bids that will enable it to enforce the Personal Watercraft Ordinance.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, it is the County s intention to comply with North Carolina General Statute
143-129 and any other applicable statutes in regards to the solicitation and award of all bids and
disposal of property
AND WHEREAS, Senate Bill 891 ratified by the North Carolina General Assembly on
June 2, 1997 signed by the Governor on June 12,1997 and effective July 1,1997 changes limit
requirements that determine when bidding and approvals are required;
AND WHEREAS, General Statute changes which effect the County s purchasing policy are:
Formal bidding required for purchases of$30,000 or more (previous law and
current County policy $20,000).
2. Allows governing body to waive requirement for a bid bond for purchases
more than $100,000 but allows staff to require a bid bond if deemed necessary
(previous law and current County policy allow waiver of bid bond for
purchases up to $100,000 but requires bid bond on purchases of $ 100,000 or
more).
3 Allows governing body to authorize staff person to dispose of items valued
at less than $5,000 without board approval (previous law and current County
policy less than $500). The official authorized to approve disposal must keep
a record of all disposal but no further report to the Board of Commissioners
is necessary (previous law and current County policy requires report to be
filed with Board of Commissioners twice a year).
4 Allows governing body to delegate to the manager or the chief purchasing
official the authority to award or reject bids and to re-advertise to receive bids
(previous law and current County policy do not allow for this).
AND WHEREAS, staff has reviewed the new law and in order to revise the County s policy
to make it consist with the General Statutes staff recommends the following changes to the current
purchasing policy.
Formal bidding procedures are required for purchases of $30,000 or more
2. A bid bond is not required for contracts involving purchases that require
formal bids. However, if the purchase requires specific performance criteria,

relates to items that are highly technical in nature, or it is determined that a bid
bond may be appropriate in a specific case, the Purchasing Agent may require
a bid bond.
3 Authorize the Finance Director or his designated representative to dispose of
any item or group of items valued at less than $5 000 In accordance with the
General Statutes, the Finance Director or his designated representative shall
keep a record of all property sold under this provision.
4 Authorize the County Manager or his designated representative to reject bids
and to re-advertise to receive bids.
AND WHEREAS, after review and discussion of the staff's recommendations, the Board of
Commissioners has adopted staff's recommendations except for item 4 and the limit in item 3 to be
$1 000 00 instead of the recommended $5 000 00.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County that the following changes are approved as revisions to the current County Policy.
