The Board of County Commissioners of New Hanover County, North Carolina, does hereby
resolve as follows:
WHEREAS, the General Assembly has enacted new legislation codified as Section 4730.2
requiring that every County appoint one or more review officers to examine and approve plats and
maps prior to recordation at the Registry of Deeds; and
WHEREAS, a review officer must examine and approve plats and maps to ascertain
mapping accuracy and consistency
NOW, THEREFORE, BE IT RESOLVED by the New Hanover County Board of
Commissioners that for unincorporated New Hanover County and the Towns of Wrightsville Beach,
Carolina Beach, and Kure Beach, that the designated Review Officers are Dexter Hayes Planning
Director, Billy Oakes - Director of Land Records, or Sam Burgess - Planner, and that for the City
of Wilmington the designated Review Officers are Benjamin Brown City Surveyor or William C.

WHEREAS, after due advertisement, bids were reeeived and publicly opened by the Financc Department
at 3.00 p.m., on the 28th dav of August, 1997 at the County Administration Building, 320 Chestnut Street,
Wilmington, North Carolina, and the following bids werc rcceived for a water treatment program for the

Thousand Nine Hundred Ninety-cight Dollars and Thirty-five Ccnts ($19998.35), estimated amount for the three
year contract is Sixty-two Thousand Four Hundred Twenty-six Dollars and Eight-five Cents ($62,426.85);
AND WHEREAS, funds havc becn previouslv appropriated and are now or will be appropriated in
subsequcnt vcar s budgct in Account No. 700-845-4194-4230 to cover this contract,
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New Hanover

Hunting and Fishing Day
WHEREAS, hunting and fishing have always been an imponant pan of the p-aditions of Nonh
Carolina, and
WHEREAS, hunting and fishing are much more than recreational pursuits. For over one
hundred years, hunters and anglers have been at the forefront of the conservation movement giving of
their time and finances. They have provided more than $20 billion to wildlife management programs,
contributing $3.5 million per day nationally In 1996, Nonh Carolinians contributed nearly $30 million
for licenses and wildlife stamp and excise taxes on sponing equipment; and
WHEREAS, the financial suppon has provided the basis for scientific research, habitat
restoration, and education, which have led to the dramatic come back of wildlife in Nonh Carolina,
such as wild turkey river otters, tundra swans, shore birds, bald eagles, alligatorsJur bearers, and
others, and
WHEREAS, hunters and anglers are also important to the economy with the average sponsman
spending $1,024 on food, lodging, equipment, real estate leases, and conservationfees, which suppon
one million jobs directly or indirectly; and
WHEREAS, responsible hunters and anglers are appreciated for their awareness and respect
of the natural environment and their efforts in contributions to its conservation,
NOW, THEREFORE BE IT RESOLVED, that the New Hanover County Board of
Commissioners does hereby proclaim Saturday September 27 1997 as "Hunting and Fishing
Day" in New Hanover County and urge all our citizens to join with hunters, anglers and other
responsible conservationists to ensure the wise use and proper management of our natural resources to
benefit future generations.

WHEREAS, the attached petition has been filed with the Board of County
Commissioners of the County of New Hanover requesting that the above described
raad(s) the location of which has been indicated in red on the attached map, be
added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s)
meets minimum standards and criteria established by the Division of Highways of
the Department of Transportation for the addition of roads to the System
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County
of New Hanover that the Division of Highways is hereby requested to review the
above described raad(s), and to take over the raad(s) for maintenance if they
meet established standards and criteria

BY THE COUNTY OF NEW HANOVER:
WHEREAS, on June 30, 1997, Falcon Cable Media (Falcon) filed an FCC Form 1240 Updating
Annual Maximum Permitted Rates For Regulated Cable Services with New Hanover County, NC-0152.
Falcon's filing seeks to recover past external costs and inflation incurred during the True Up Period
(July 1, 1996, through June 30, 1997), and anticipated external costs and inflation during the Projected
Period (October 1, 1997 through September 30, 1998);
WHEREAS, Falcon used an inflation figure of 1.93% for its True Up Period inflation, and
1.83% for its estimated Projected Period inflation;
WHEREAS, Falcon intends on implementing its FCC Form 1240 rate adjustment on October 1,
1997;
WHEREAS, Falcon included in its maximum permitted rate $.23 in external cost adjustments
from the "gap" period (September 30, 1992, to July 14, 1994);
WHEREAS, in its Memorandum Opinion and ORDER, released December 31, 1996, the FCC
stated that cable operators may adjust maximum permitted rates in their subsequent rate filings to
account for unrecovered changes in external costs incurred between September 30, 1992, and the
operator's initial date of regulation;
WHEREAS, on July 25, 1997, the County received a report from its consultants indicating that
Falcon's said filing was in compliance with FCC rules and procedures, and that the County in its
discretion, could find the requested maximum permitted rate to be reasonable.
WHEREAS, New Hanover County is certified with the FCC to regulate BST rates assessed by
Falcon Cable Media, serving franchise NC-OI52, County of New Hanover
.
WHEREAS, a stated policy of the 1992 Cable Act is to ensure that "consumer interests are
protected in the receipt of cable service. "
IT IS A FINDING:
THAT Falcon Cable Media has justified its BST maximum permitted rate adjustment request of
$26.71,
THAT Falcon Cable Media has failed to meet the ~76.309 of the FCC Customer Service
obligations where" Under normal operating conditions, telephone answer time by a customer
representative, including wait time, shall not exceed thirty (30) seconds when the connection is made.
These standards shall be met no less than ninety (90) percent of the time under normal operating
conditions, measured on a quarterly basis."
IT IS THEREFORE ORDERED:
THAT, Falcon's requested BST rate of$26.71 be found unreasonable; and
THAT, the BST rate assessed subscribers by Falcon Cable Media for the Projected Period
covered by the FCC Form 1240 within unincorporated areas of New Hanover County, NC-0152, shall
not exceed the current rate of$25 70.

BY THE COUNTY OF NEW HANOVER:
WHEREAS, on June 30, 1997, Falcon Cable Media (Falcon) submitted an FCC-1205
Equipment and Installation Costs filing for regulated cable services with New Hanover County, NC-
0152. This filing was submitted with an FCC-1240 filing and covers the rates that may be charged
subscribers served by Falcon within unincorporated New Hanover County for a 12-month period
beginning on October I, 1996, which is the Projected Period set out in the FCC-1240 filing;
WHEREAS, on August 25, 1997 the County received a report from its consultants indicating
that Falcon's said FCC-l205 filing was in compliance with Federal Communications Commission
procedures, allowing for the adjustment of equipment and installation rates based on updated capital and
labor cost information;
WHEREAS, New Hanover County has authority to regulate equipment and installation rates
for basic cable service assessed subscribers within NC-OIS2, New Hanover County, by Falcon;
WHEREAS, Falcon has elected to use fixed rates in the calculation of its Hourly Service
Charge for installation and maintenance of regulated customer equipment;
WHEREAS, Falcon has not filed to continue to collect from its subscribers a Wire Maintenance
Agreement fee of$1.50; and
WHEREAS, a stated policy of the 1992 Cable Act is to ensure that "consumer interests are
protected in the receipt of cable service. "

IT IS A FINDING:
THAT Falcon FCC1205 filing is in compliance with Federal Communications Commission
procedures and there is evidence Falcon can support a maximum Hourly Service Charge of$73.26, and
monthly fees of$1.95 for non-addressable converters, and $0.27 for remote controls for 1997-98; but
THAT Falcon Cable Media has failed to meet the ~76.309 of the FCC Customer Service
obligations where "installations, outages and service calls, under normal operating conditions, each of
the following standards will be met no less than ninety five (95) percent of the time measured on a
quarterly basis. Standard installations are to be performed within seven (7) business days after an
ORDER has been placed and, excluding conditions beyond the control of the operator, Falcon Cable
Media is to begin working on service interruptions promptly and in no event later than 24 hours after
the interruption becomes known;" and
THAT Falcon Cable Media has failed to comply with the FCC's provisions regarding
Communications between cable operators and cable subscribers where billing and complaint procedures,
including the address and telephone number of the local franchise authority's cable office are to be
printed on the customer's monthly invoice.
IT IS THEREFORE ORDERED:
THAT, the Hourly Service Charge assessed subscribers within NC-OI52, New Hanover
County, shall not exceed the current maximum permitted rate of$63.34; and the monthly lease rate for
non-addressable converters shall not exceed $1.88, and the monthly lease rate for remote controls shall
not exceed $0.18;
THAT, Falcon suspend its Wire Maintenance Agreement service fee beginning October 1,
1997; and
THAT, the failure to file for the Wire Maintenance Agreement charge is the basis for the
suspension of the Wire Maintenance Charge.

AND WHEREAS, the County Engineer, the Finance Director and the County Manager recommend that the
contract be awarded to North Carolina Equipment Company of Wilmington, North Carolina, the lowest responsible
bidder, in the net amount of Thirty-eight Thousand Eight Hundred Thirty-nine DoIlars ($38,839 00);
AND WHEREAS, funds have been previously appropriated and are now in Account No. 800-470-4197-6400
to cover this contract;
AND WHEREAS, a budget amendment is submitted for approval to budget the revenue received from the sale
of the surplus equipment as trade-in;
NOW THEREFORE, BE IT RESOLVED by the New Hanover County Water and Sewer District Board of
Commissioners that the contract for the purchase of a loaderlbackhoe and the sale as trade-in of surplus equipment for
the Water Sewer District, Bid # 98-0007 be awarded to North Carolina Equipment Company in the net amount of
Thirty-eight Thousand Eight Hundred Thirty-nine DoIlars ($38,839 00); the budget amendment budgeting the revenue
received is approved, and that the District is hereby authorized and directed to execute the contract, contract form to be
approved by the County Attorney
