Middle Point Section 1 (Harlandale Drive, Tillson Court and
Denly Court)
WHEREAS, the attached petition has been filed with the Board of County Commissioners
of the County of New Hanover requesting that the above described road(s), the location of which
has been indicated in red on the attached map, be added to the Secondary Road System; and
WHEREAS, the Board of County Commissioners is of the opinion that the above
described road(s) should be added to the Secondary Road System, if the road(s) meets minimum
standard and criteria established by the Division of Highways of the Department of Transportation
for the addition of roads to the Systems.
NOW, THEREFORE, be it resolved by the Board of Commissioners of the County of
New Hanover that the Division of Highways is hereby requested to review the above described
roads(s), and to take over the road(s) for maintenance if they meet established standards and
criteria.

We the undersigned, being property owners on HARLANDALE DRIVE TILLSON COURT AND
DENL Y COURT (Describe or give local name or Secondary Road Number) in NEW HANOVER
county do hereby request the Division of Highways of the Department of Transportation to ADD the
above described road.
We further advise that the road requested to ~ is ~ miles in length and at the present time
there are 35 occupied homes located on the road and having entrances into the road.
Finallv we agree to dedicate to the division of Highways a right-of-way of the necessary width to
construct the road to the minimum construction standards required by the Division of Highways. This
right-of-way will extend the entire length of the road that is requested to be improved and will include the
necessary areas outside the right-of-way for cut and fill slopes and drainage. Also, we agree to dedicate
additional right-of-way in the public road intersections for sight distance and design purposed and to
execute said right-of-way agreement forms that will be submitted to us by representatives of the Division
of Highways.

I The New Hanover County Commission hereby approves the conveyance of the following lots to Cape Fear
Habitat for Humanity (CFHH) for the construction of single family owner-occupied residences.

Please take notice that the Wilmington City Council adopted a resolution dated October
21, 1997 and the Board of Commissioners of New Hanover County adopted a resolution on
October 20, 1997 authorizing the conveyance by private sale to Cape Fear Habitat for Humanity
(CFHH), a non-profit corporation, for the following described propertY'

This property will be conveyed to Cape Fear Habitat for Humanity (CFHH) without
monetary consideration to be used in a program with the purpose of constructing a single family
residence for lower and moderate income persons or families. This conveyance is made pursuant
to the authority ofG.S. 160A-279 for the public purpose of providing lower and moderate income
housing. The conveyance shall not be consummated until ten (10) days after the publication of this
notice.

Section 9 - The President of the institution is hereby authorized to transfer amounts from
one function to another in the same fund within the limitations set forth for the State Fund
and Plant Fund by the State Board of Community Colleges. Any such transfer shall be
reported to the Board of Trustees at its next regular meeting and entered into its minutes.
Section 10 - Copies of the Budget Resolution shall be immediately sent to the local tax-
levying authorities, and the State Board of Community Colleges.

WHEREAS, on October 1, 1997, Time Warner Cable submitted an FCC-1240 Updating
Maximum Permitted Rates filing for the New Hanover County, NC-O 140;
WHEREAS, the County is certified with the FCC to regulate basic cable rates and services
within the franchise area, and is authorized by the FCC to review rate filings submitted by Time
Warner Cable;
WHEREAS, the FCC has issued rules allowing cable operators to make annual adjustments
to regulated cable service rates using the FCC 1240 form to recover external costs (past and present),
changes in the number of regulated channels, and inflation;
WHEREAS, the FCC has issued rules allowing Time Warner Cable to incorporate provisions
of the Time Warner Cable Social Contract into its FCC-1240 filing system, allowing for the recovery
of projected system upgrade costs, and the recovery of reductions in basic tier (Lifeline) rates with
adjustments to the CPS tier.
WHEREAS, the County is authorized to toll the time needed to review Time Warner Cable's
FCC-1240 rate filing by no more than a maximum of90 days beyond the initial 30 days allowed by
the FCC, totaling 120 days; and,
WHEREAS, the County is authorized to issue an accounting order, effective for 12 months,
requiring the cable operator to maintain a complete and accurate accounting of all revenues and costs
associated with the aforementioned rate filing.
IT IS THEREFORE ORDERED:
THAT, the time period in which the County has to review Time Wanter Cable's FCC 1240
rate filing is tolled 90 days past the original 30 days (120 days total) allowed by the FCC, extending
the total review period deadline to January 28,1998;
THAT, Time Warner Cable is directed to provide the County with any, and all, necessary
information requested by the County so that a comprehensive review of the FCC-1240 rate filing may
be conducted;
THAT, Time Warner Cable is directed to maintain a complete and accurate accounting of all
costs and revenues associated with the aforementioned FCC 1240 rate filing; and,
THAT, the accounting order contained within this filing shall remain in effect for a period of
12 months from the executed date of this order.

A regular meeting of the Board of Commissioners of New
Hanover County was duly held on October 20, 1997, at ~ am,
in the Assembly Room of the New Hanover County Courthouse in

following resolution
WHEREAS, the Board of Commissioners of New Hanover
County desires to ~rovide for the holding of a public hearing in
connection with the installment financing by the County of the
construction of sewer interceptors, the acquisition of buildings
and rights therein and the acquisition of equipment and the
refinancing by the County of the acquisition of land; NOW,
THEREFORE,
BE IT RESOLVED by the Board of Commissioners Of New
Hanover County, as. follows
(1) The. public hearing upon the proposed installment
financing and refi~cin9 by the County of the improvements
hereinbefore described shall be held on the 3rd day of November,
1997, at 6:30 o'clock PM, in the Assembly Room of the New
Hanover county Courthouse, 24 North Street, Wilmington, North
Carolina
(2) The Clerk of the Board of Commissioners is hereby
directed to cause a notice of such hearing to be published in a
qualified newspaper no fewer than ten days prior to such public
hearing

I. The New Hanover County Commission hereby approves the conveyance of the following lots to Cape Fear
Habitat for Humanity (CFHH) for the COnstruction of single family owner-occupied residences.

This declaration (the "Declaration") is made pursuant to the requirements of the United
States Treasury Regulations and is intended to constitute a Declaration of Official Intent to
Reimburse under such Treasury Regulations.
The undersigned is authorized to declare the official intent of the County of New
Hanover North Carolina (the 'Issuer") with respect to the matters contained herein.
1. Expenditures to be Incurred. The Issuer anticipates incurring expenditures (the
'Expenditures") for the acquisition of the Perry Brothers Building in behalf of
Cape Fear Community College. Acquisition costs for the above-referenced
building are estimated to be Three Hundred Fifty Thousand Dollars ($350,000).
2. Plan of Finance. The Issuer intends to finance costs of the above-referenced
acqusition with proceeds of the Issuer's tax exempt debt (the "Borrowing").
3. Maximum Principal Amount of Debt to be Issued. The maximum principal
amount of the Borrowing to be incurred by the Issuer to finance the Project is
estimated to be Three Hundred Fifty Thousand Dollars ($350,000).
4. Declaration of Official Intent to Reimburse. The Issuer hereby declares its
official intent to reimburse itself with the proceeds of the Borrowing for any of the
Expenditures incurred by it prior to the Borrowing, including but not limited to
expenses incurred prior to the date of this Resolution.
