( S J ~ f)r\;~ ':- '..... ....,c \ ..... -,.....) -- ~\~.; :::> I ~h {Ir Dc:[/S : [\'I HANOVER CO NC '96 JUN 26 PM 3 08 STATE OF NORTH CAROLINA COUNTY OF NEW HANOVER BEFORE THE BOARD OF COUNTY COMMISSIONERS In the Matter of Closing An Unnamed Road in Crestwood Subdivision ORDER It appearing to the Board of County Commissioners of New Hanover County that a Resolution ofIntent to close an unnamed road was adopted by the County Commissioners on the 15th of April, 1996, and it further appearing that said resolution called for a hearing to be held on the 3 rd day of June, 1996, at which time the County Commissioners would hear complaints and comments of interested persons, and it further appearing that notice of said hearing was published in the Wilmington Star News Newspaper in accordance with the Road Closing Ordinance of New Hanover County, and after conducting such hearing the County Commissioners are of the opinion that the unnamed road in the County of New Hanover should be closed and are satisfied that the closing of same is not contrary to the public interest, and that no individual owning property in the vicinity of the roads will be deprived of reasonable means of ingress and egress to his property by such closing, the legal description of said road being as follows: Being all of a 30 foot unnamed road right-of-way beginning at the southwest corner of lot 131 which is a part of the northern right-of-way of Ashford Avenue, Crestwood Subdivision Section 7 recorded in Plat Book 13, page 2 of the New Hanover County RegistrY' commencing from said point 162 feet north-northwest to a point in the southern property line of lot 101 Crestwood Subdivision, Section 6 recorded in Plat book 10, page 47 of the New Hanover County RegistrY' and extendingfrom said point 30 feet south to the northeastern corner of lot 132, Plat Book 13, page 2 of the New Hanover County RegistrY' commencing from said point 172 feet south-southeast which is the northern boundry of lot 132, Plat Book 13 Page 2, commencingfrom said point 30 feet north which is the southeastern corner of lot 132 to the point of beginning. NOW, THEREFORE, IT IS ORDERED AND DECREED that the above described road be and the same is hereby closed and except a 20 foot section (1 0 fee~ on each side of the centerline of the right-of-way) for drainage easement purposes. Mat E5ilS Jr, ice-Chairman V/y~ k to the Board NEW HANOVER COUNTY BOARD OF COMMISSIONERS RESOLUTION WHEREAS, New Hanover County is a political subdivision of North Carolina which is dedicated to the principles of accountability and good government; and WHEREAS, the increase in unfunded mandates has placed a financial burden on New Hanover County and its tax payers; and WHEREAS, since fiscal year 1991 92, New Hanover County has experienced an increase of 82 percent in the local share of Medicaid funding. Further, in the 1996-97 budget year, New Hanover County faces a 23 percent increase in the County's share for the Medicaid Program. WHEREAS, North Carolina is one of only seven states which requires counties to match a percentage of Medicaid cost as well as a percentage of AFDC match. Further, North Carolina is the only state which requires counties the burden be placed on local tax payers; and WHEREAS, New Hanover County would commit its savings from the Medicaid match and AFDC match to local school needs. NOW, THEREFORE, BE IT RESOLVED, that the New Hanover County Board of Commissioners hereby requests the State of North Carolina to assume responsibility and financial liability for all social programs. The excessive fiscal burden placed on New Hanover County by unfunded mandated programs undemlines the County's ability to provide basic services to the citizens and to fund infrastructure, capital needs, and public schools. BE IT FURTHER RESOLVED, that copies of this Resolution, adopted this the third day of June, 1996 shall be transmitted to the Governor of North Carolina, to the Lieutenant Governor of North Carolina, to President Pro Tempore of the North Carolina Senate, to the Speaker of the North Carolina House of Representatives, to member of the New Hanover County Legislative Delegation, and to the North Carolina Association of County Commissioners.
