NEW HANOVER COUNTY BOARD OF COMMISSIONERS REQUEST FOR BOARD ACTION MEETING DATE: November 16, 2009 CONSENT ITEM: 2 DEPARTMENT: Health PRESENTER(S): Eric Ireland, Deputy Health Director CONTACT(S): Eric Ireland, Deputy Health Director SUBJECT: Ratification of Application and Acceptance of Grant Funding to Implement North Carolina's Smoke- Free Restaurant and Bar Law BRIEF SUMMARY: New Hanover County Health Department (NHCHD) has been notified by the North Carolina Department of Health and Human Services Division of Public Health Chronic Disease & Injury Section Tobacco Prevention & Control Branch of the availability of $7,617 in funds we may apply to receive for implementation of North Carolina's Smoke-Free Restaurant and Bar Law. Of these funds, $1,512 is designated for purchase of coasters for distribution to restaurants and bars and $6,105 may be used for public education, such as media publicity and advertisements. The application was released with a short deadline, with submissions due by Friday, October 23, 2009, resulting in the need to request ratification of the application for the grant funding. No matching County funds are required and no new positions are requested. The program will end once the funding ends. RECOMMENDED MOTION AND REQUESTED ACTIONS: Ratify application, accept grant funds in the amount of $7,617 to implement North Carolina's Smoke-Free Restaurant and Bar Law, and adopt ordinance for budget amendment 10-094. This funding is made possible through TPCB by a grant from the North Carolina Health and Wellness Trust Fund ~HWTF}, A total of $240,000 has been made available to distribute to local health departments that submit an application by actober 23, 2009. Funds are available through June 30, 2010. However, all service activities must be completed by May 31, 2010. II, BACKGROUND The North Carolina Tobacco Prevention and Control Branch TPCB}works to improve the health of North Carolina residents by promoting smoke-free environments and tobacco-free lifestyles. our goal is to build a capacity of diverse organizations and communities to implement and carry out effective, culturally appropriate strategies to reduce deaths and health problems due to tobacco use and secondhand smoke. The TPCB works in these four goal areas: • Prevent the initiation of tobacco use among young people • Eliminate exposure to secondhand smoke • Promote quitting tobacco among adults and youth • Identify and eliminate tobacco-related health disparities among populations House Bill 2, An Act to Prohibit Smoking in Certain Public Places and Certain Places of Employment, passed in 2008-2009 and was signed by the Governor on May 19, 2009. Beginning January 2, 2010, the public will see these new changes as a result of this new law: ~ Smoking will not be allowed in enclosed areas of almost all restaurants and bars. The new law does not apply to certain cigar bars that are open only to people over the age of 21, ~ Smoking will not be allowed in enclosed areas of lodging establishments, such as hotels, motels, bed and breakfasts, and inns, if the establishment prepares and serves food or drink. An establishment may designate up to 20°0 of its guest rooms as smoking rooms. • Local governments, such as cities and counties, will have new authority to adopt local laws regulating smoking in public places. A local law may not change the state law to allow smoking in restaurants, bars and lodging establishments, but it could prohibit smoking in more places. There are several limitations on and exceptions to this new local authority. 2 Board of Commissioners Meeting 2-2-2 Local Health Departments are statutorily responsible for implementation, yet no funding was appropriated for the implementation of House Bill 2. In meetings with the Division of Public Health and the Health and wellness Trust, the primary bill sponsor asked that the Health and Wellness Trust Fund and the Tobacco Prevention and Control Branch, NC Division of Public Health work together using existing resources to educate the public and the business community about the benefits of the new law, and to work with local health directors and local boards of health to provide assistance with the implementation. III, SCOPE OF SERVICES Funds are divided into two separate areas as outlined below. Counties may request funding for either, or both areas. Maximum available funding has been pre-established per county or district health department, using a formula based on the number of restaurants in each county. I. Funding for Education and Implementation: A total of $200,000 is available for activities, materials and paid media to aid in the promotion of the new law, and for education of the public and business community about the benefits of the new law. Allowable expenses include: • Travel to educate health department staff, businesses or the public about the new law, • Travel to meetings or registration for trainings about implementation of the new law, • Printing of materials to help with the implementation of the new law, • Postage for educating the businesses about the new law, • Purchase of supplies to help with the successful education and implementation efforts for the new law in their county, • Placement of approved media messages to promote the benefits of the smokefree restaurants, especially in larger counties serving major media markets. These will benefit a broader area than the county. TPCB Director or Public Education and Communications will approve media messages. • Temporary staff costs for local health departments to do task work related to implementation in year 1. Task work may include, for example, developing a page for the local health department website to report success of the smokefree restaurant and bars law's implementation in the county, etc. • Equipment costs under $500 to be used for implementation of the new law. II. Funding for Restaurant and Bar Coasters: An additional $40,000 is available to counties interested in purchasing restaurant and bar coasters to use as a business incentive, from a HWTF approved vendor. Should this funding be requested, orders will be placed on behalf of the Health Department, and the Health Department will be billed directly from the vendor. Initial design ideas include the NC Quitline logo on one side with the text "Time to quit? We can he1p." The reverse side will have blue text reading "We can all breathe easier. NC restaurants and bars are smoke-free as of January 2, 2010."} Coasters have been used by other states successfully implementing new smoke-free restaurant and bar laws as a business incentive and a means to educate customers. Estimated costs are approximately $.02 per coaster, not including shipping, Note: This funding must appear as a separate and distinct line item in the grant budget, and will also be used for any associated shipping costs. 3 Board of Commissioners Meeting 2-2-3 Funding Guidelines or Restrictions: 1. Local Health Departments shall not use sums awarded under this Agreement to substitute or supplant funds from other sources that are currently supporting any existing services. 2. All travel and subsistence expenses must be reimbursed under the prevailing State rates and policies for State employees. State travel rates may be found in the Budget Manual at www.osbm.state.nc.us. Out-of-state or international travel shall not be reimbursed under this Agreement. 3. Indirect costs are prohibited under this Agreement. 4. Local Health Departments shall maintain full, accurate and verifiable financial records, supporting documentation, and all other pertinent data for this Agreement for a period of five (5) years following the end of the Payment Period. 5. Local Health Departments shall not use these funds to support or engage in any effort to participate in political activities or lobbying, including but not limited to support of or opposition to candidates, ballot initiatives, specific legislation, referenda and other similar activities. 6. Funds may not be used for research. 7. Funds may not be used for enforcement activities related to the new law. 8. Counties receiving funding will be required to submit to TPCB a brief mid-cycle programmatic report by March 1, 2010, and an end-of-cycle narrative report detailing expenditure of funds by August 31, 2010. Request and Justification for Receipt of Funds: Maximum available funding for education and implementation has been pre-established per county or district health department, using a formula based on the number of restaurants in each county derived from the Department of Environment and Natural Resources restaurant database. Funding shall be in the amount of $9.80 per restaurant. Additional funding for the purchase (and related shipping costs) of restaurant and bar coasters has been divided into three tier levels, also based on the number of restaurants in each county. Funding will be distributed through the Aid-To-County Database. GENERAL INFORMATION ON SUBMITTING APPLICATIONS 1. Award or Rej ection All qualified applications will be evaluated and award made to that agency or organization whose combination of budget and service capabilities are deemed to be in the best interest of the funding agency. The funding agency reserves the unqualified right to reject any or all offers if determined to be in its best interest. Successful applicants will be notified by (10/30/2009) 2. Decline to Offer Any agency or organization that receives a copy of the RFA but declines to make an offer is requested to send a written "Decline to Offer" to the funding agency. Failure to respond as requested may subject the agency or organization to removal from consideration of future RFAs. 3. Cost of Application Preparation Any cost incurred by an agency or organization in preparing or submitting an application is the agency's or organization's sole responsibility; the funding agency will not reimburse any agency or organization for any pre-award costs incurred. 4. Elaborate Applications Elaborate applications in the form of brochures or other presentations beyond that necessary to present a complete and effective application are not desired. 5. Oral Explanations The funding agency will not be bound by oral explanations or instructions given at any time during the competitive process or after awarding the grant. 6. Reference to Other Data Only information that is received in response to this RFA will be evaluated; reference to information previously submitted will not suffice. 7. Titles Titles and headings in this RFA and any subsequent RFA are for convenience only and shall have no binding force or effect. 8. Form of Application Each application must be submitted on the form provided by the funding agency, and will 11 Board of Commissioners Meeting 2-2-11 be incorporated into the funding agency's Performance Agreement (Agreement Addendum). 9. Exceptions All applications are subject to the terms and conditions outlined herein. All responses will be controlled by such terms and conditions. The attachment of other terms and conditions by any agency and organization maybe grounds for rejection of that agency or organization's application. Funded agencies and organizations specifically agree to the conditions set forth in the Performance Agreement (Agreement Addendum). 10. Advertising In submitting its application, agencies and organizations agree not to use the results therefrom or as part of any news release or commercial advertising without prior written approval of the funding agency. 11. Right to Submitted Material All responses, inquiries, or correspondence relating to or in reference to the RFA, and all other reports, charts, displays, schedules, exhibits, and other documentation submitted by the agency or organization will become the property of the funding agency when received. 12. Competitive Offer Pursuant to the provision of G.S.143-54, and under penalty of perjury, the signer of any application submitted in response to this RFA thereby certifies that this application has not been arrived at collusively or otherwise in violation of either Federal or North Carolina antitrust laws. 13. Agency and Organization's Representative Each agency or organization shall submit with its application the name, address, and telephone number of the person(s) with authority to bind the agency or organization and answer questions or provide clarification concerning the application. 14. Subcontracting Agencies and organizations may propose to subcontract portions of work provided that their applications clearly indicate the scope of the work to be subcontracted, and to whom. All information required about the prime grantee is also required for each proposed subcontractor. 15. Proprietary Information Trade secrets or similar proprietary data which the agency or organization does not wish disclosed to other than personnel involved in the evaluation will be kept confidential to the extent permitted by NCAC TO1: OSB.1501 and G.S.132-1.3 if identified as follows: Each page shall be identified in boldface at the top and bottom as "CONFIDENTIAL." 12 Board of Commissioners Meeting 2-2-12 Any section of the application that is to remain confidential shall also be so marked in boldface on the title page of that section. 16. Participation Encouraged Pursuant to Article 3 and 3C, Chapter 143 of the North Carolina General Statutes and Executive Order No. 77, the funding agency invites and encourages participation in this RFA by businesses owned by minorities, women and the disabled including utilization as subcontractor(s) to perform functions under this Request for Applications. 17. Agreement Addendum The Division will issue an Agreement Addendum to the recipient of the RFA funding. Expenditures can begin immediately upon receipt of a completely executed Agreement Addendum. Please be advised that successful applicants may be required to have an audit in accordance with G.S.143C-6-22 and G.S.143C-6-23 as applicable to the agency's status. Also, the Agreement Addendum may include assurances that the successful applicant would be required to execute when signing the Agreement Addendum. Applicants must submit documentation of its DUNS number. DUNS is the abbreviation for the Data Universal Numbering System developed and regulated by Dun & Bradstreet. If your agency does not have a DUNS number, please use the Dun & Bradstreet (D&B) online registration (httpa/fedgov.dnb.com/webform) to receive one free of charge. V. APPLICATION PROCUREMENT PROCESS AND APPLICATION REVIEW The following is a general description of the process by which applicants will be selected for funding for this project. 1. RFAs are being sent to prospective local health departments via email. 2. All questions concerning the specifications in this Request for Applications should be emailed to Elisabeth.Constandy@dhhs.nc.~ov and will be received until 12:00 p.m. on October 21, 2009. As an addendum to this RFA, a summary of all questions and answers will be emailed via the Local Health Director's email distribution list by 12:00 p.m. on October 22, 2009. 3. Applicants shall submit this application via email to Elisabeth.Constandy@dhhs.nc. ~ ov. Faxed applications will not be accepted. Applicants will receive email confirmation upon receipt of the application. 4. All applications must be received by the Department of Health and Human Services by the date and time on the cover sheet of this RFA. 5. At their option, the application reviewers may request additional information from any or all applicants for the purpose of clarification or to amplify the materials presented in any part of the application. However, agencies and organizations are cautioned that the reviewers are not required to request clarification: therefore, all applications should be complete and reflect the most favorable terms available from the agency or organization. 7. Applications will be evaluated by a committee according to completeness, content, experience with similar projects, ability of the agency's or organization's staff, cost, etc. The award of a grant to one agency and organization does not mean that the other applications lacked merit, but that, all facts considered, the selected application was deemed to provide the best service to the State. 8. Agencies and organizations are cautioned that this is a request for applications, and the funding agency reserves the unqualified right to reject any and all applications when such rej ections are deemed to be in the best interest of the funding agency. 9. EVALUATION CRITERIA SCORING OF APPLICATIONS Applications shall be scored based on the narrative responses in the Application Form, and on the proposed budget in the Application Form. Applications will be evaluated for feasibility of plans, including media if applicable. Counties eligible to receive higher levels of funding in both Education and Implementation and Restaurant and Bar Coaster line items will be expected to include more detailed plans for regional media campaigns. Scoring is as follows: 0 NO VALUE Applicant did not address the application area. 1=: AVERAGE Applicant adequately addressed the application area. 2 EXCELLENT Applicant provided a superior response to the application area. Scoring will be determined based on funds applied for. Should the applicant apply for both line items of funding (Education and Implementation, AND Restaurant and Bar Coasters), a total of 4 points will be available. Should the applicant apply for only one line item of funding (Education and Implementation, OR Restaurant and Bar Coasters), a total of 2 points will be available. Burpeau, Deputy County Attorney SUBJECT: Approval of Updated Records Retention and Disposition Schedule and its September 28, 2009 Amendment for the New Hanover County Sheriff's Office BRIEF SUMMARY: The North Carolina Department of Cultural Resources, Division of Archives and History, Local Unit of the Government Records Branch, has published an updated Records Retention and Disposition Schedule and a September 28, 2009 Amendment for use by Sheriff Offices across the state. By enacting the guidelines and amendment, Sheriff's Offices can enhance and standardize their records policy and avoid having to retain obsolete documents. The schedule and the amendment are on file for review in the Sheriff's Office, Commissioners' Office, and the County Manager's Office. The Local Records Unit of the Government Records Branch amended item # 89 -sexual offender records, after discussion with staff members at the NC Department of Justice. There was concern about destroying records when offenders moved from the jurisdiction. The disposition schedule was modified to retain the records until court petition and review by the state, the length of the court order, or 30 years, whichever is greater. This is to ensure that records will be retained in the event the offender moves back into your jurisdiction. Also amended was the records retention for people in the Sexually Violent Offenders Program. Records used to be retained until known dead or moved from jurisdiction. Now reads retain until known dead or after 90 years. The Records Retention and Disposition Schedule is the primary way the Department of Cultural Resources gives its consent to destroy records as outlined in G.S. 121-5 and G.S.132-3. Sheriff McMahon is in agreement with the updated Records Retention and Disposition Schedule and September 28, 2009 Amendment. In order to record the donation, a budget amendment is required for accounting purposes. This budget amendment allows for recognition of the value of the equipment and the addition of the equipment to the County's asset listing. The equipment has a fair market value of $10,307. Brief on Functions: The Board of Adjustment is a recognition of human frailty. If it were possible for the legislative body to write a perfect zoning ordinance which would meet the needs of the community while at the same time avoiding hardship in individual cases, there would be no need for this board. Because that has been found near impossible, the Board of Adjustment has been introduced as an integral part of almost every smoothly operating zoning enforcement mechanism, serving as a "pop-off valve" to relieve pressures resulting from hardship cases. In New Hanover County, the duties of the Board fall into two general categories: Interpretation and Granting Variances. Inter retation: The function of the Board of Adjustment which is most closely similar to that of the courts is interpretation of the Ordinance. This function involves ~a} interpreting the meaning of parts of the Ordinance which are unclear, fib} applying the Ordinance to particular fact situations, and, if necessary, ~c} correcting any mistakes or abuses of discretion which the Building Inspector may have made in administering the Ordinance. In exercising this power, the basic principle #or the Board tv keep in mind is that it must not vary the Ordinance. Its function here is to interpret and apply what the governing body has written, not to vary that legislative pronouncement to fit its own ideas. Its decisions must be in accord with what the Board believes to be the actual meaning and intent of the Ordinance. Grantin of Variances: General Statute 153A-345~d} provides that, "when practical difficulties or unnecessary hardships would result from carrying out the strict letter of a zoning ordinance, the Board of Adjustment may, in passing upon appeals, vary or modify any regulation or provision of the Ordinance relating to the use of land, so that the spirit of the Ordinance is observed, public safety and welfare secured, and substantial justice done." Basically, a variance is a permit, which the Board may grant in certain situations, enabling a property owner to make use of his property in some way which is in conflict with the literal provisions of the Ordinance. Sometimes a lot so small or so peculiarly shaped that the owner would have great difficulty in complying with the yard requirements and yet erecting a suitable building. Sometimes contours of the terrain are such as to crea#e hardships in complying with these requirements. Sometimes the lot is located in a cluster of nonconforming uses which will prevent the owner from securing any reasonable return from his land if he complies with the Ordinance has where a lot in a residential district is surrounded by nonconforming business structures}. When the Board grants exemptions from harsh provisions, it is "granting a variance."
