It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the renaming of Wood haven Drive (SR 2002), located in Cape Fear
Township, Castle Hayne community commencing approximately 1,830 feet from the Blue Clay
Road/Woodhaven Drive intersection, extending 1,390 feet north and recorded as part of Plat Book
5, Page 125 of the New Hanover County Registry; and it further appearing that a public hearing was
held on Tuesday, January 3, 1995, at which time ~ll persons were heard on the question of whether
or not the naming would be in the public interest; and it further appearing that notice of said hearing
was transmitted to all resident owners and prominently posted in at least two (2) locations along said
road, and published in the Star News local newspaper, and the Board of County Commissioners is
of the opinion that ~aid road in New Hanover County should be renamed and the renaming of same
is in the public interest, the description of which is delineated on the attached exhibit.

NOW, THEREFORE, IT IS ORDAINED AND DECREED that the above described road
is hereby renamed PROSPERITY LANE.
IT IS FURTHER ORDERED that a copy of this ordinance be recorded in the office of the
Register of Deeds of New Hanover County, North Carolina, and that notice of the action taken by
the Board of County Commissioners be transmitted to the postmaster having jurisdiction over the
road, the North Carolina Board of Transportation and to any city within five (5) miles of said road
in accordance with N.C. General Statutes 153A-240.

It appearing to the Board of County Commissioners of New Hanover County that
consideration has been given to the assignment of house numbers on PROSPERITY LANE,
numerical range 5300-5499, SUNRAY ROAD, numerical range 5300-5499, and WOODHA VEN
DRIVE, numerical range 5300-5499
WHEREAS, ready and accurate identification of developed property is important for the
delivery of general County services, for the operation of commercial enterprises, for the response of
emergency and public safety vehicles, and for the convenience of the general public, and
WHEREAS, a comprehensive and systematic property numbering system is an efficient means
of identifying property within the County; and
WHEREAS, such a system will promote the health, safety, and welfare of the citizens of New
Hanover County
THEREFORE, it further appearing that a public hearing was held on the 3rd day of January,
1995,at which time all persons were heard on the question of whether or not assigning house numbers
would be in the public interest, and it further appearing that notice of said hearing was prominently
posted in at least two (2) locations along said street, that notice of the time, place and subject matter
of the hearing was prominently posted at the County Courthouse and published in a newspaper of
general circulation in the County
NOW, THEREFORE, it is ordained and decreed that the above house number assignments
be made
It is further ordered that a copy of this ordinance be transmitted to the Postmaster having
jurisdiction over the road, to the Board of Transportation, Sheriffs 911 Dispatcher and to any city
within five miles of said road in accordance with N.C General Statute 153A-240.

It appearing to the Board of County Commissioners of New Hanover County that

Road/Blue Clay Road intersection extending 1,340 feet to its termination and being a part of
Woodhaven Subdivision, and recorded as part of Plat Book 5, Page 125 of the New Hanover County
Registry and it further appearing that a public hearing was held on Tuesday, January 3, 1995, at which
time all persons were heard on the question of whether or not the renaming would be in the public
interest; and it further appearing that notice of said hearing was transmitted to all resident owners and

WHEREAS, the North Carolina Department of Transportation has received a grant from the US
Department of Transportation authorized by Section 18 of the Federai Transit Act of 1991, as
amended, to provide assistance for rural public transportation projects; and
WHEREAS, the purpose of these transportation funds is to provide grant monies to local ~gendes for
the provision of rural public transportation services; and
WHEREAS, Article 2B of Chapter 136 of the Nor,;! Carolina General Statutes and the Governor of
North Carolina have designated the North Carolina Department of Transportation (NCDOT) as the
agency responsiblp for administering funds received through Section 18 of the Federal Transit Act of
1991; and

Designating January 16, 1995 as Martin Luther King, Jr. Day
Whereas, Dr. Martin Luther King, Jr. was a clergyman, civil rights leader, and
Nobel Peace Prize Winner;
Whereas, his activities and his non,violent posture contributed significantly to the
advancement of civil rights in the United States; and
Whereas, the third Monday in January has been established as a national holiday
in honor of Dr. Martin Luther King, Jr.; and
Whereas, the Board of Commissioners of New Hanover County desires to join
with federal and state government, other local governments, and private citizens and
organizations in commemorating the birthday of Dr. Martin Luther King, Jr.;
Now, Therefore, We Hereby Proclaim, January 16,1995 as
Dr. Martin Luther King, Jr. Day;

RESOLUTION
OF THE
DISTRICT BOARD OF COMMISSIONERS
OF THE
NEW HANOVER COUNTY WATER & SEWER DISTRICT
WHEREAS, the City of Wilmington was beginning the formal bid
process to purchase a Positive Displacement Combination Sewer
Cleaner and the Water & Sewer District of New Hanover County was
budgeted to also purchase the identical piece of equipment this
fiscal year;
AND WHEREAS, to promote efficiency, the Water & Sewer District
was included and named in the City's bidding process;
AND WHEREAS, the City is scheduled to award the bid for a
Posi ti ve Displacement Combination Sewer Cleaner to Clean Earth
Environmental Group, a Division of Schuler Industries of
Birmingham, Alabama in the amount of One Hundred Forty-one Thousand
Six Hundred Fifty-five Dollars ($141,655.00) and No Cents;
AND WHEREAS, funds have been previously appropriated and are
now or will be in subsequent years budgets in Account No.
800-470-4197-5940 to cover this contract;
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of New Hanover County that the purchase of a Positive
Displacement Combination Sewer Cleaner in accordance with the City
of Wilmington's Contract with Clean Earth Environmental Group a
Division of Schuler Industries of Birmingham, Alabama in the amount
of One Hundred Forty-one ~housand Six Hundred Fifty-five Dollars
($141,655.00) be approved, and that the contract documents to be on
file at the City of Wilmington.

provides public water services or plans to provide such services shall, either individually or
together with other such units of local government, prepare and submit a local water supply
plan; and
WHEREAS, as required by the statute and in the interests of sound local planning, a
water supply plan for New Hanover County has been developed and submitted to the Board
of Commissioners for approval; and
WHEREAS, the New Hanover County Board of Commissioners finds that the water
supply plan is in accordance with the provisions ofN.C.G.S. 143-355(1) and that it will provide
appropriate guidance for the future development of water supplies for New Hanover County,
as well as useful information to the Department of Environment, Health and Natural Resources
for the development of a state water supply plan as required by statute;

Hanover County that the water supply plan entitled "New Hanover County International
Airport Water System Local Water Supply Plan", dated December 20, 1994, is hereby

Resources, Division of Water Resources; and
BE IT FURTHER RESOLVED that the Board of Commissioners intends that this plan
shall be revised to reflect changes in relevant data and projections at least once every five years
or as otherwise requested by the Department in accordance with the statute and sound planning

quality in our estuarine creeks and sounds; and
WHEREAS, the development of the Futch Creek Watershed Management Plan will help
to further this objective,
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of New
Hanover County.
1 That the contract for the development of the Futch Creek Watershed Management
Plan between New Hanover County and the North Carolina Department of
Environment, Health, and Natural Resources be and the same is hereby approved.
2. That the Chairman and the Clerk be and they are hereby authorized to sign and
execute the said contract for and on behalf of New Hanover County and forward
the same to the North Carolina Department of Environment, Health, and Natural
Resources.
3. That upon final execution, a copy of said contract be filed with the minutes.

RESOLUTION
OF THE
BOARD OF COMMISSIONERS
OF
NEW HANOVER COUNTY
WHEREAS, G.S. 143, Article 3D, provides guidelines for the
procurement of architectural, engineering, and surveying services
by unit of local government; and
AND WHEREAS, G.S. 143-64.32 states that units of local
government may in writing exempt from the provisions of Article 3D
proposed projects "where an estimated professional fee is in an
amount less than thirty thousand dollars ($30,000.00)";
NOW, THEREFORE, BE IT RESOLVED that the Board of County
Commissioners of New Hanover County does hereby exempt New Hanover
County projects from the procurement procedures set out in
G.S. 143, Article 3D, for architectural, engineering and surveying
services when the estimated professional fee on any project is in
an amount less than thirty thousand dollars ($30,000.00).

RESOLUTION OF THE
NEW HANOVER COUNTY BOARD OF COMMISSIONERS
GUARANTEEING FUNDING TO THE CITY
FOR EXPENSES FOR DOWNTOWN PARKING
WHEREAS, at a special meeting of the Board of Commissioners on
June 2, 1994, the County Commissioners adopted a resolution
authorizing New Hanover County to participate in a joint venture
with the City of Wilmington for the demolition/construction of a
downtown parking deck; and
WHEREAS, the Board of Commissioners authorized the County
Manager to enter into an agreement with the City of Wilmington to
provide funding not to exceed $600,000.00 over a five-year period
to offset the operating loss resulting from the
demolition/construction of the parking deck; and
WHEREAS, the Board of Commissioners is now willing, under
certain conditions, to provide additional funding for the proposed
parking deck.
NOW, THER~FORE, BE IT RESOLVED by the Board as follows:
1. If the downtown office building project is terminated
before December 31, 1996 through no fault of the City of
Wilmington, New Hanover County will pay the City a sum not to
exceed $400,000.00, to be applied toward the increased expense
incurred or to be incurred by the City in replacing parking
downtown.
2. The County Manager is authorized to enter into an
agreement with the City of Wilmington to provide funding not to
exceed $600,000.00 over a five-year period to offset the operating
loss resulting from the demolition/construction of the parking
deck.
